Res 01-097RESOLUTION NO. 01-097 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA MAKING CERTAIN REQUISITE FINDINGS THAT THE AFFORDABLE HOUSING ASSISTANCE AND REFERRAL PROGRAM IS OF BENEFIT TO THE REDEVELOPMENT PROJECT AREA WHEREAS, the Poway Redevelopment Agency (the "Agency") and ElderHelp of San Diego ("ElderHelp") are desirous of entering into a contractual agreement (the "Agreement") for the provision of the Affordable Housing Assistance and Referral Program (the "Program") to assist Iow and moderate income residents within the Paguay Redevelopment Project Area (the "Project Area") and the City of Poway (the "City") in accessing affordable housing; and WHEREAS, the Agency is required by California Government Code Section 33334.2 to set-aside and expend an amount not less than 20% of the taxes which are allocated to the Agency to increase, improve, and preserve the community's supply of Iow and moderate income housing available at affordable housing cost, such amounts being held in the Agency's Low- and Moderate-Income Housing Fund (the "Housing Fund"); and WHEREAS, California Health and Safety Code Section 33334.2 (e)(8) states that the Agency may provide subsidies from the Housing Fund monies to, or for the benefit of, very Iow, Iow and moderate income persons and families to the extent that those households are unable to obtain affordable housing on the open market; and WHEREAS, the Program will assist persons and families of Iow and moderate incomes, as defined in Section 50093 of the California Health and Safety Code, to obtain safe, decent, and sanitary housing at a cost which is affordable pursuant to the definition found in California Health and Safety Code 50052.5; and WHEREAS, the expenditure of Housing Fund monies to fund the Program will be of benefit to the Project because the Program will operate both within and outside of the Project Area; and WHEREAS, through the adoption of Resolution 93-071, on May 25, 1993, the City Council made general findings that the use of Housing Fund monies to increase, improve and preserve the community's supply of Iow- and moderate-income housing located outside the Redevelopment Project Area benefits the Redevelopment Project; and WHEREAS, the Program serves as an integral component of a balanced affordable housing program for the Project Area and the community to increase, improve, and preserve the supply of housing in Poway available to persons and families with Iow and moderate incomes. Resolution No. 01-097 Page 2 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as follows: Section 1: The recitals hereof are true and correct and are hereby incorporated into this Resolution. Section 2: The City finds that very Iow income households, lower income households and persons and families of Iow or moderate incomes have difficulty in obtaining housing in the Project Area and the City at affordable costs on the open market. Section 3: The City finds that the use of the Housing Fund to satisfy the Agency's obligations to ElderHelp of San Diego, pursuant to the Agreement, is for the purpose of increasing the community's supply of housing available to persons and families of Iow and moderate incomes at affordable housing cost pursuant to California Health and Safety Code Section 33334.2. Section 4: The City finds that, pursuant to California Health and Safety Code Section 33334.2(g), the use of Agency Housing Fund moneys for the purpose of the Agency fulfilling its obligations, as stated in the Agreement, will be of benefit to the Project Area and areas of the community outside of the Project Area.
