SUBJECT: Temnorarv Use Permit 95-12, Powa¥ Kiwanis, Applicant: A
request for approval to hold an Earth Day Mountain Bike
Challenge and Road Ride which will pass through Poway on
Sunday, April 2, 1995.
FINDINGS
The applicant is requesting approval of a temporary use permit for an Earth Day
Mountain Bike Challenge and Road Ride. The ride will be held on Sunday, April
2, 1995. The different routes will begin between 7:00 a.m. and 9:30 a.m. All
routes will begin and end at the Bernardo Winery and will follow the courses
itinerary outlined in Attachment B. A map outlining a summary of streets in the
City of Poway which will be utilized is provided in Attachment C. The purpose
of the ride is to promote cycling as a fun and recreational sport as well as an
alternative form of transportation. The ride will be the first event in the 1995
Tour De Poway Cycling Series. A portion of the net proceeds will benefit
Children's Hospital. ~
Section 17.26.030.A of the Poway Municipal Code provides regulations for
temporary uses within the City. The code requires approval by the City Council
for major outdoor events.
Pertinent departments have been contacted and specific conditions or requirements
have been established.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING TEMPORARY USE PEPJ4IT 95-12
WHEREAS, Temporary Use Permit 95-12, Poway Kiwanis, Applicant, requests
approval to hold an Earth Day Mountain Bike Challenge and Road Ride on Sunday,
April 2, 1995.
WHEREAS, on March 28, 1995, the City Council held a hearing on the above
referenced item.
NOW, THEREFORE, the City Council does hereby resolve as follows:
Section 1: Environmental Findinqs:
Pursuant to the procedure of the City of Poway, implementing the
California Environmental Quality Act of 1970, the above-referenced project
is categorically exempt, Class 4{e).
Section 2: Findinq~:
1. The proposed use is in accordance with the purposes and standards of
Section 17.26.030 of the Zoning Ordinance.
2. The generation of traffic will not adversely impact the capacity and
physical character of the surrounding streets and/or the Circulation
Element of the General Plan.
Section 3: City Council Decision:
The City Council hereby approves Temporary Use Permit 95-12 subject to the
following conditions:
1. The bike ride shall be conducted as shown on the approved
site/traffic plans of file in the Planning Services Department.
2. This approval shall become null and void the evening of April 2,
1995.
3. The applicant shall obtain an insurance bond indemnifying the City
of Poway from possible liability in an amount not less than one
million dollars.
4. Approval of this activity does not waive compliance with all other
sections of the Zoning Ordinance and other applicable ordinances
presently in effect.
5. All participants shall obey all signs and signals as posted. The
California Vehicle Code is to be strictly enforced.
6. Emergency vehicle access to any roads or buildings in the proposed
routes are to remain open.

7. Public streets, off-street parking sites, and areas within and
adjoining the proposed area for the event shall be cleared of
debris, and litter after the event. Temporary signage, and any
other evidence of the event shall be removed upon its completion.
8. All electric works shall meet current code requirements.
APPROVED and ADOPTED by the City Council of the City of Poway, State of
California, this 28th day of March, 1995.
