RECOMMENDATION It is recommended that the City Council approve Temporary Use Permit 95-10 subject to the conditions contained in the attached proposed resolution. Gardner, Planning Intern DATE: April 4, 1995 MANDATORY ACTION DATE: May 23, 1995 SUBJECT: Temporary Use Permit 95-10, Children's Asthma Leaque, Applicant: A request for approval to hold the 18th Annual "Bike for Breath" bicycle ride which will pass through Poway on Sunday, June 4, 1995. FINDINGS The applicant is requesting approval of a temporary use permit for the 18th Annual "Bike for Breath" fun ride. The ride will be held on Sunday, June 4, 1995. There will be three different routes of 30 miles, 60 miles, and 100 miles. The riders will begin and end in the Carmel Mountain Ranch area of San Diego, and will depart between 7:00 a.m. and 8:45 a.m. A map indicating the course and the Poway streets to be utilized is available in Attachment B. Section 17.26.030.A of the Poway Municipal Code provides regulations for temporary uses within the City. The code requires approval by the City Council for major outdoor events. Pertinent departments have been contacted and specific conditions or requirements have been established. P- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWA¥, CALIFORNIA APPROVING TEMPORARY USE PERMIT 95-10 WHEREAS, Temporary Use Permit 95-10, Children's Asthma League, Applicant, requests approval to hold the 18th Annual "Bike for Breath" Bicycle Ride on Sunday, June 4, 1995. WHEREAS, on April 4, 1995, the City Council held a hearing on the above referenced item. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: Environmental Findinq~: Pursuant to the procedure of the City of Poway, implementing the California Environmental Quality Act of 1970, the above-referenced project is categorically exempt, Class 4(e). Section 2: Findinqs: 1. The proposed use is in accordance with the purposes and standards of Section 17.26.030 of the Zoning Ordinance. 2. The generation of traffic will not adversely impact the capacity and physical character of the surrounding streets and /or the Circulation Element of the General Plan. Section 3: City Council Decision: The City Council hereby approves Temporary Use Permit 95-10 subject to the following conditions: 1. The bike ride shall be conducted as shown on the approved site/traffic plans of file in the Planning Services Department. 2. This approval shall become null and void the evening of June 4, 1995. 3. The applicant shall obtain an insurance bond indemnifying the City of Poway from possible liability in an amount not less than one million dollars. 4. Approval of this activity does not waive compliance with all other sections of the Zoning Ordinance and other applicable ordinances presently in effect. 5. All participants shall obey all signs and signals as posted and remain in provided bike lanes. The California Vehicle Code is to be strictly enforced. s of 6 APR J~ 1995 ITEM Resolution No. P- Page 2 6. Emergency vehicle access to any roads or buildings in the proposed routes are to remain open. 7. Public streets, off-street parking sites, and areas within and adjoining the proposed area for the event shall be cleared of debris, and litter after the event. Temporary signage, and any other evidence of the event shall be removed upon its completion. 8. All electric works shall meet current code requirements.
