ABSTRACT

Staff recommends acceptance of the public improvements and release of the securities.

RECOMMENDATION
It is recommended that the City Council accept the public improvements subject to the
conditions outlined in the agenda report and direct the City Clerk to release the
securities.

for Indian Trails Subdivision, TM 88-07, Indian Trails

BACKGROUND:
On January 31, 1989, the City Council approved Tentative Tract Map 88-07 for
an 11 lot division of 14.46 acres of land located between Indian Trails Road
and Pomerado Road (Attachment 1). On October 24, 1989, Vladic Construction,
Inc., the original owner of this project, executed a standard agreement and
posted bonds to insure construction of the public improvements for this
subdivision. The final map was approved by City Council on November 14, 1989.
Construction commenced in December of 1989 and a portion of the grading was
done before all work stopped on April 11, 1990. The contractor filed a stop
notice on July 19, 1990 for payment of $84,436.50 in unpaid invoices.
The property suffered severe erosion damage in the winter of 1990-91.
Adjacent properties located on Indian Trails Road and Pomerado Road were
damaged by siltation. When Vladic Construction failed to respond, City crews
performed emergency repairs and City staff hired a private contractor to
repair the damage and install erosion control measures. Most of these costs
have been borne by the security deposit posted by Vladic Construction.
The original owner has since declared bankruptcy and new owners have taken
over the project. The new owners applied for and obtained a time extension to
the standard agreement subject to conditions. The original standard agreement
expired on October 27, 1991 and was extended for 12 months to October 27,
1992.

The public improvements that were required were installation of sidewalk, curb
and gutter, street lights, fire hydrants, storm drainage systems, and
construction of a public street. The public improvements have been completed.
FINDINGS:
Although the public improvements have all been completed, private drainage
patterns on Lots 8 and 9 need to be changed. The changes are necessary in
order to provide proper flow towards Indian Trails Road rather than towards
properties to the north located outside of the subdivision.
The Engineering Services Department has considered the public facilities to be
complete and ready for acceptance with the following conditions:
1. Lot 8 shall be regraded and the drainage inlets in the rear yard be
removed so that runoff will flow from the rear yard to the front yard
and onto Indian Trails Road. This condition shall be completed prior
to building permit issuance for Lot 8.
2. Lot 9 shall be regraded to cause runoff to flow from the
northeasterly inlet to the southerly inlet thereby reducing runoff
towards property to the north of the subdivision.
3. Repair erosion to the McAtee property from the discharge of the brow
ditch at the northeast corner of Lot 9. Extend the brow ditch and
install an improved energy dissipator at the northeast corner of Lot
g so that the drainage system ends at the very northeast corner of
the subdivision.
4. Monitor the drainage pattern resulting from the conditions outlined
above for a period of 12 months to determine its impact on the McAtee
property located to the north and whether an underground drainage
system will be required.

We cannot appear in person on such short notice as we will be
out of town. For the record we wanted you to know attachment 1
the map of Indian Trails Subdivision is incorrect. The north-
easterly corner of the subdivision does not end at the street
on Del Norte but 150 feet from the street. The brow ditch
emptys onto our property. It cannot reach the street without
going across our property. We are enclosing a corrected copy
of the vicinity map.
