A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA,
APPROVING A SPECIFIC PLAN AMENDMENT 84-01CCC TO THE
SOUTH POWAY SPECIFIC PLAN TO ALLOW 3 STORIES WITHIN THE EXISTING
35-FOOT HEIGHT LIMIT FOR HOTELS OR MOTELS IN THE
SOUTH POWAY SPECIFIC PLAN AREA
WHEREAS, Chapter 17.47 (Specific Plan Regulations) of Title 17 (Zoning
Development Code) of the Poway Municipal Code provides the requirements for the
initiation, preparation and adoption of Specific Plans in accordance with Section 65450,
et seq. of the California Government Code (Article 8, Specific Plan); and
WHEREAS, Section 17.47.00.C (Initiation) of the Zoning Development Code
provides that the City Council may initiate the preparation of, or amendment to, a
Specific Plan on property by Resolution; and
WHEREAS, on October 2, 2001, the City Council initiated Specific Plan
Amendment 84-01CCC by Resolution; and
WHEREAS, Specific Plan Amendment 84-01CCC allows 3 stories within the
existing 35-foot height limit for hotels or motels within the South Poway Specific Plan
Planned Community; and
WHEREAS, on November 13, 2001, the City Council held a duly advertised
public hearing to solicit comments from the public, both pro and con, relative to this
application.
NOW, THEREFORE, the City Council does hereby resolve as follows:
Section 1: The proposed Specific Plan Amendment is Categorically Exempt from the
requirements of the California Environmental Quality Act (CEQA) pursuant to CEQA
Guidelines Section 15061(b)3 because it would result in no change to the existing
height limit for buildings and would not result in any physical change to the environment.
Section 2: The City Council hereby approves Specific Plan Amendment 84-01CCC as
follows:
A. The South Poway Specific Plan, Volume 2, is amended as follows:
Chapter 3, Section IV, Subsection A, Item 3 is amended to add the following text:
3. Height
The maximum height of a hotel or motel shall not exceed 35 feet.
No more than 3 stories shall be contained within the 35-foot height
limit.
