RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
POWAY, CALIFORNIA, AMENDING THE OLD COACH
WATER LINE PROJECT DEVELOPMENT FEE
WHEREAS, on June 5, 2001, the City Council of the City of Poway (the "City
Council") adopted Resolution No. 01-042 establishing the Old Coach Road Water Line
Project Development Fee (the "Development Fee"), pursuant to the provisions of the
California Government Code Section 66000 et seq. and in accordance with the Old
Coach Road Water Line Development Fee Report (the "Development Fee Report"), for
the reasonable cost of constructing the additional water line for increased development
in the water line service area; and
WHEREAS the City Council found and determined that the purpose of the
Development Fee is to provide for the construction of the water supply and distribution
system for the Service Area; and
WHEREAS Assessor's Parcel No. 277-010-09-00 (the "Additional Parcel")was
excluded from the Development Fee, although it falls within the service area of the Old
Coach Road Water Line (the "Water Line"), due to prior private agreements that had the
Additional Parcel obtaining water service from a source other than the Water Line; and
WHEREAS, there is now a possibility that the Additional Parcel may connect into
the Water Line in the future; and
WHEREAS, the City Council has heretofore received and reviewed the Amended
Old Coach Road Water Line Project Development Fee Report prepared by Harris &
Associates (the "Engineer") under and pursuant to Government Code Section 66000, et
seq. (the "Amended Development Fee Report"), which Amended Development Fee
Report is hereby incorporated by reference into this Resolution; and
WHEREAS, the Amended Development Fee Report now includes the
Development Fee applicable to the Additional Parcel at which time the Additional Parcel
shall choose to connect into the Water Line.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway
as follows:
Section 1. The above recitals are all true and correct.
Section 2. The City Council hereby finds and determines that the Additional
Parcel would use the additional capacity built into the Water Line were it to connect into
the Water Line.

Section 3. The City Council hereby approves the Amended Development Fee
Report.
Section 4. The City Council hereby amends the Development Fee as shown in
the Amended Development Fee Report.
PASSED, ADOPTED and APPROVED by the City Council of the City of Poway,
State of California, this 13m day of November 2001.
