SUBJECT: Amendment No. i to the Agreement Between the County of San Diego and the
City of Poway for Public Transportation Services for FY 1994-95 through
FY 1996-97
ABSTRACT
At the March 28, 1995 City Council meeting, the Council approved the transit service
levels for FY 95-96. Amendment No. 1 to the agreement between the City and the County
(Exhibit A) allows County staff to implement the transit service levels approved by the
City Council for FY 95-96. Staff is recommending that the City Council approve
Amendment No. 1 for public transportation services in FY 95-96, and authorize the
County and SANDAG to implement the appropriations from Poway's Unallocated TDA Reserve
approved by the City Council on March 28, 1995.
ENVIRONMENTAL REVIEW
Amendment No. 1 to the agreement between the City and County is not considered a
project under CEQA, and therefore, is not subject to CEQA review.
FISCAL IMPAC~
Amendment No. 1 will also authorize the County to implement the appropriations from
Poway's Unallocated TDA Reserve approved by the City Council on March 28, 1995.

Additional notification sent to County Transportation and SANDAG staff.
RECOMMENDATION
It is recommended that the City Council approve the attached Amendment No. 1 to the
Agreement Between the County of San Diego and the City of Poway for Public
Transportation Services for FY 94-95 through FY 96-97, and authorize the Mayor to
execute the agreement on behalf of the City of Poway and authorize the County and
SANDAG to implement the appropriations from Poway's Unallocated TDA Reserve as approved
by the City Council on March 28, 1995.

SUBJECT: Amendment No. 1 to the Agreement Between the County of San
Diego and the City of Poway for Public Transportation
Services for FY 1994-95 through FY 1996-97
BACKGROUND
The City of Poway has contracted with the County of San Diego to provide
public transportation services requested by the City. The agreement permits
the County to claim a mutually agreed upon apportionment from Poway's local
Transportation Development Act (TDA) funds for transit services.
FINDINGS
Under the current agreement, the County administers all of the City's transit
services, which include the fixed route, call-a-ride, express bus, and
airporter services. County administrative services include route planning,
financial management, contract administration, and oversee the transit
provider. These services are funded completely by the City's annual TDA fund
allocation. The current agreement allows the County to file the City's TDA
claim for transit services in an amount up to, but not exceeding, the City's
annual TDA allocation.
On March 28, 1995, the City Council approved the transit service levels for FY
95-96 and authorized an appropriation of $20,390 from the City's TDA reserve
funds for the capital improvement projects approved for FY 95-96.

COUNTY OF SAN DIEGO AND THE CITY OF POWAY
FOR PUBLIC TRANSPORTATION SERVICES FOR
FY 1994-95 THROUGH FY 1996-97
This first amendment to the above-referenced Agreement, is entered into this
day of , 1995, by and between the County of San

Diego, (hereinafter referred to as the County Transit System and the
City of Poway (hereinafter referred to as "CITY").
WITNESSETH:
WHEREAS, CTS and City entered into a three-year Agreement on May 17,
1994, whereby CTS agreed to provide public transportation services as
requested by City; and
Whereas, this Agreement permits CTS to claim for local transportation
purposes, a mutually agreed upon apportionment from the City's Local
Transportation Fund; and
WHEREAS, City has requested CTS to modify service levels and make other
changes in response to direction of the Poway City Council; and
WHEREAS, CTS has entered into several multi-year transportation
contracts for the benefit of an with the concurrence of City.
NOW, THEREFORE, it is agreed as follows:
1. This amendment shall become effective on July 1, 1995.
2. ARTICLE 3. Compensation for Services is amended as follows:
Change paragraph 3.1 to read as follows:
3.1 City agrees that CTS may file an annual claim with the Local
Transportation Planning Agency of San Diego County (under
the provisions of the Mills-Alquist-Deddeh Act starting with
Section 99260) for Transportation Development Act (TDA)
funds available to the City. For FY 1995-96, City and CTS
agree that this amount shall not exceed $802,383. These
funds shall be used for transit operations ($792,383) and
City administrative expenses ($10,000). In each subsequent
year of the Agreement, prior to April 1, City and CTS shall
revise the claim amount based on the level of service
approved by the City Council.
Change paragraph 3.1.1 to read as follows:
3.1.1 For FY 1995-96, additional claims in the amount of $20,390
shall be filed on behalf of City. These funds shall be
claimed to augment existing capital reserve accounts for
accessible bus stop improvements ($10,000), radio
communication equipment improvements ($8,000), and
construction of the future Poway Transit Center ($2,390).
Funds claimed under this Section 3.I.1 shall not be expended
without prior authorization of the City Council.
