DATE: April 18, 1995 SUBJECT: First Amendment to the Agreement with the Metropolitan Transit District Board to Regulate Taxicabs in Poway ABSTRACT The City' s agreement with the Metropolitan Transit Development Board (MTDB) to regulate taxicabs in Poway expires on June 30, 1995. The first amendment for renewal of the agreement between the City of Poway and MTDB is for a three-year period through June 30, 1998. Staff is recommending that the City Council authorize the amendment for extending the agreement with MTDB for an additional three years . ENVIRONMENTAL REVIEW City Council action to extend the agreement with MTDB to regulate taxicabs in Poway is not considered a project under CEQA, and therefore, is not subject to review. FISCAL IMPACT The regulation of taxicabs by MTDB for the City of Poway is paid through fees charged to the operations and does not impact the City's budget. ADDITIONAL PUBLIC NOTIFICATION AND CORRESPONDENCE Additional notification sent to MTDB Taxicab Administrator Barbara Lupro. Foley, Principal Management Analysy~ DATE: April 18, I995 SUBJECT:' First Amendment to the Agreement with the Metropolitan Transit Development Board to Regulate Taxicabs in Poway BACKGROUND The state law enabling the Metropolitan Transit Development Board (MTDB) to assume the responsibility for regulating taxicabs was passed in 1987. The Public Utilities Code Section 12066, authorizes MTDB to regulate taxicabs by contracting with cities in their jurisdiction. The purpose of MTDB regulating taxicabs is to unify the operating, equipment, and administrative regulations throughout the region. The benefits of a regional approach include improving service quality and vehicle condition, in addition to the convenience for operators as a result of dealing with one agency (MTDB) for permits and rules, rather than each individual city in which they work. FINDINGS MTDB began regulating taxicab services in the City of Poway in 1991 under a 4- year agreement. Since MTDB began regulating taxicab services, the following improvements have been initiated: · implemented a vigorous vehicle inspection program staffed by certified mechanics; · instituted a driver safety training class; · established a Taxicab Committee chaired by an MTD Board member with eight members representing small and large operations and four community representatives; and · developed a comprehensive system to handle taxicab passenger complaints ACTION: 2 of 5 APR 1 8 1995 I'~-~ 23 Agenda Report April 18, 1995 Page 2 The attached first amendment for renewal of the agreement between the City of Poway and MTDB is for a three-year period from July 1, 1995 through June 30, 1998. JLB:JDF:RLT:PRF Attachment: 1 - First Amendment to Agreement 3 of 5 APR 18 1995 ITEM MTDB Dc No. TAXI 590.9 FIRST AMENDMENT TO AGREEMENT FOR ADMINISTRATION OF TAXICAB SERVICE REGULATIONS This Agreement is entered into by and between the City of Poway, a municipal corporation (hereinafter called "City") and the San Diego Metropolitan Transit Development Board, a public agency, (hereinafter called "MTDB") for a period July 1, 1995 through June 30, 1998. WHEREAS, MTDB is authorized under Section 12066, Chapter 2, Division 11 of the California Public Utilities Code (PUC) to enter into contracts to regulate taxicab services within a city in its area of jurisdiction; and WHEREAS, the City of Poway is within MTDB's jurisdiction created January 1, 1976 under Section 120050 et. seq., Chapter 2, Division 11 of the California Public Utilities Code; and WHEREAS, the City regulates taxicabs in accordance with Poway Municipal Code Chapter 5.20; and WHEREAS, the City desires that MTDB regulate taxicab vehicles and services pursuant to PUC Section 120266 in accordance with MTDB's Uniform Ordinance and implementing policies and regulations; and WHEREAS, the City and MTDB entered into an agreement to authorize MTDB to regulate taxicab services for the four-year period from July 1, 1991 through June 30, 1995; and WHEREAS, the City and MTDB desire to now extend the period through June 30, 1998. NOW, THEREFORE, in consideration of the above, the City and MTDB agree as follows: 1. MTDB will adopt, administer, and enforce its taxicab Ordinance No. 11, policies and regulations, as in effect on July 1, 1995, and as thereafter from time to time amended by MTDB, and thereby, regulate taxicab vehicles and services rendered wholly within the City's corporate limits during the period ending June 30, 1998 pursuant to PUC Section 120266. 2. MTDB will collect and administer all such regulator fees, fines, and forfeitures as now or hereafter provided by the MTDB Ordinance No. 11, policies and regulations. 3.
