APN: 323-270-16 BACKGROUND The Wiederrich Chiropractic Clinic has operated at the subject location at the southeast corner of Welton Lane and Poway Road si nce the 1 ate 1970' s. The present building is 1,697 square feet in size, The new building is proposed to incorporate the old square footage, wrapping around the present one and adding a wing onto the east side, The new building footprint will also move closer to Poway Road, FINDINGS The subject, 49 acre loti s bounded on the north by Poway Road, the west by Welton Lane, the east by a self-serve car wash, and on the south by a one-acre resi dent i a 1 property, The south one-half of the property is presently undeveloped. The proposal under discussion includes the expansion of the office building, construction of a new, larger parking lot behind the building, frontage improvements along Welton Lane, and completion of new landscaping, r ACTION 2 of 12 MAY 2 ITEM 1995 I )) 9 Agenda Report May 2, 1995 Page 2 The building proposed is the first structure being designed with the new Poway Road Specific Plan architectural guidelines in mind, The design standards for the Automotive/General Commercial District envision a post-modern look, with clean lines and muted colors in off white, grays, blues, mauve, and pale terra cotta. This building is sympathetic to the guidelines. The improvements to Welton Lane (a private road) recommended by staff consist of extending curb, gutter and sidewalk south to the first driveway cut. Beyond that point it is recommended that landscaping be extended to the edge of Welton Lane. ENVIRONMENTAL REVIEW The subject project is exempt under CEQA, Class 1, the minor alteration of existing private structures; additions to existing structures provided that the addition will not result in an increase of more than: (1) (2) 50 percent of the fioor area of the structure before the addition, or 2,500 square feet, whichever is less; or 10,000 square feet if: (A) The project is in an area where all public services and facilities are available to allow for maximum development permissible in the General Plan and (B) The area in which the project is located is not environmentally sensitive. FISCAL IMPACT The property is located within the Poway Redevelopment Agency project area, Its redevelopment will cause reassessment for property tax purposes, Tax increment wi 11 accrue to the agency. P- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING DEVELOPMENT REVIEW 95-04 ASSESSOR'S PARCEL NUMBER 323-270-16 WHEREAS, Development Revi ew 95-04, was submitted by Lester Wi ederri ch, appl i cant, for approval of the constructi on of a 2,497 square foot medi ca 1 offi ce complex to replace the existing 1,697 square foot building located at 14103 Poway Road, in the MS zone. WHEREAS, The City Council of the City of Poway has read and considered said report and has considered other evidence presented at the public hearing. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: Environmental FindinGs: The subject project i s exempt under the provi si ons of the Cali forni a Environmental Quality Act, Class 1. Section 2: Findinqs: 1. The approved project is consistent with the general plan in that medical office buildings are a permitted land use within the Poway Road convnerci a 1 corri dor. 2. That the approved project wi 11 not have an adverse aestheti c, hea lth, safety, or archi tecturally related impact upon adjoi ni ng properties in that the design of the building utilizes the guidelines set out in the Poway Road Specific Plan, for structures located within the Automotivej General Commercial District, That the proposed project encourages the orderly and harmonious appearance of structures and property within the City in that the architecture references several nearby, newly developed complexes which also reflect the post-modern style articulated in the Poway Road Specific Plan. 3, Section 3: City Council Decision: The City Council hereby approves Development Review 95-04, subject to the following conditions: Within 30 days of approval (1) the applicant shall submit in writing that all conditions of approv~ have been read and understood; and (2) the property owner shall execute a Covenant on Real Property. 4 of 12 MAY 2 1995 ITEM 9 Resolution No, P- Page 2 COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. APPROVED BY THE DEPARTMENT OF PLANNING SERVICES. SITE DEVELOPMENT 2. 3, 5 of 12 COMPLIANCE SHALL BE 1. Site shall be developed in accordance with the approved site plans on file in the Planning Services Department and the conditions contained herein. Revised site plans and building elevations incorporating all conditions of approval shall be submitted to the Planning Services Department prior to issuance of building permits. 4. Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other applicable City Ordinances in effect at the time of building permit issuance. Trash receptacle shall be enclosed by a six foot high masonry wall with vi ew-obstruct i ng gates pursuant to City standards. Locati on shall be subject to approyal by the Planning Services Department. 5, All roof appurtenances, including air conditioners, shall be architecturally integrated, screened from view and sound buffered from adjacent properties and streets as required by the Planning Services Department. The applicant shall comply with the latest adopted Uniform Building Code, Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code, Uniform Fire Code, and all other applicable codes and ordinances in effect at the time of building permit issuance. 6. 7. This approyal shall become null and yoid if building permits are not issued for this project within two years from the date of project approval. PARKING AND VEHICULAR ACCESS 1. All parking lot landscaping shall include a minimum of one 15 gallon size tree for every three spaces. For parking lot islands, a minimum 12 inch wide walk adjacent to parking stalls shall be provided and be separated from vehicular areas by a six inch high, six inch wide portland concrete cement curb, 2, Parki ng lot 1 i ghts shall be low pressure sodi um and have a maxi mum height of 18 feet from the finished grade of the parking surface and be directed away from all property lines, adjacent streets and residences, All parking spaces shall be double striped, 3. Comp 1 ete 1 andscape constructi on documents shall be submitted to and approved by the Pl anni ng Servi ces Department pri or to the i ssuance of building permits. Plans shall be prepared in accordance with City of Poway Guide to Landscape Requirements (latest edition), Street trees, a minimum of 15 gallon size or larger, shall be installed in accordance with the City of Poway Guide to Landscape Requirements and shall be planted at an average of 30 feet on center spaci ng along all streets. 2. 3. Landscaped areas within the adjacent public right-of-way, as well as private street easements, shall be permanently and fully maintained by the owner. 4, All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. The trees shall be encouraged and allowed to retain a natural form. Pruning should be restricted to maintain the health of the trees and to protect the public safety, Unnatural or excessive pruning, including topping, is not permitted, Any signs proposed for this deyelopment shall be designed and approved in conformance with the Sign Ordinance. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. APPROVED BY THE DEPARTMENT OF ENGINEERING SERVICES. SITE DEVELOPMENT 6 of 12 COMPLIANCE SHALL BE 1. The applicant shall pay a $500.00 inspection fee to the City's Engineering Services Department prior to building permit issuance. Such fee is to be used to pay for City Inspector's time in making necessary inspections for the project site that are required prior to issuance of said building permit and/or Certificate of Occupancy. A right-of-way permit shall be obtained from the City's Engineering Services Department for any work to be done within the publ ic street right-of-way or construction of driveway approach, sewer lateral installation, water service line installation, and street construction. 2, 3. A Traffic Mitigation Fee in the amount of $1,188.00, shall be paid or a security bond posted prior to issuance of a building permit. If a securi ty bond is posted, payment of the fees shall be made pri or to issuance of a Certificate of Occupancy. The subject property owner shall participate in a road maintenance agreement for Welton Lane, prior to occupancy. The easterly s i de of Welton Lane, from Poway Road to the northerly edge of the project's northerly driveway, shall be improved with concrete curb, gutter and sidewalk. In addition, a disabled (wheelchair) access ramp shall be constructed at the curb return. All work shall be in conformance with the City of Poway standards and specifications. 5. 6, An improvement plan, prepared by a State Registered Civil Engineer, shall be submi tted by the City for revi ew and approval pri or to start of construction. Plan checking fee and additional inspection fee sh~l be paid to the City at first submittal of improvement plans. Grading improvements to the site, shall be made in such a way that discharge of surface water to adjacent lower property shall be through the drainage mechanism of a natural swale, hollow or depression. Increase in volume or velocity by collecting the water in pipes or artificial ditches must be avoi ded. It i s reconunended that wherever possi bl e, surface drainage, and water from roof drains be directed toward Poway Road. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. APPROVED BY THE DEPARTMENT OF SAFETY SERVICES. COMPLIANCE SHALL BE 1. Roof coveri ng shall be fi re retardant as per UBC Secti on 3203 (e) and City of Poway Ordinance No, 64. 2. The buildings shall display their numeric address in a manner visible from the access street. Minimum size of the building numbers shall be six inches on the front facade of the building. Building addresses shall also be di sp 1 ayed on the roof i n a manner sati sfactory to the Di rector of Safety Services, and meeting Sheriff Dept. ASTREA criteria. Every building hereafter constructed shall be accessible to Fire Department apparatus by way of access roadways wi th all-weather dri vi ng surface of not less than 20 feet of unobstructed width, with adequate roadway turning radius capable of supporting the imposed loads of fire apparatus having a minimum of 13'6" of vertical clearance. The road surface type shall be approved by the City Engineer, pursuant to the City of Poway Municipal Code. (16' One Wav parking lot is okay,) 3. 4. The building owner will be required to install an approved fire sprinkler system, meeting P,M.C. requirements. The entire system is to be monitored by a central monitoring company. System post indicator valves with tamper switches, also moni tored, are to be located by the Ci ty Fi re Marshal pri or to installation, 5. A 'Knox' Security Key Box shall be required for the building at a location determined by the City Fire Marshal. A 'Knox' padlock shall be required for the fire sprinkler system Post Indicator Valve. Resolution No, P- Page 5 Fire Department access for use of fire fighting equipment shall be proYided to the immediate job construction site at the start of construction and maintained at all times until construction is completed, A minimum 2A:I0BC fire extinguisher is required for every 3,000 square feet and 75 feet of travel distance. If medical gasses are planned to be used in this building, they shall be installed to meet requirements of the Uniform Fire Code Article 74- Compressed Gasses. An Emergency Contingency Plan and Hazardous Materials Disclosure shall be fil ed wi th the County of San Di ego Department of Health and copi es provided to the Fire Department. Material Safety Data Sheets shall be required for all hazardous and/or toxic substances used in each building. An Emergency Contingency Plan and Hazardous Materials Disclosure shall be fil ed wi th the County of San Di ego Department of Health and copi es provided to the Fire Department. Prior to delivery of combustible building material on site, water and sewer systems shall satisfactorily pass all required tests and be connected to the public water and sewer systems. In addition, the first lift of asphalt paving shall be in place to provide adequate, permanent access for emergency vehi cl es. The fi na 1 1 i ft of asphalt shall not be inst~led until ~l other construction actiYity has been substantially completed to the satisfaction of the City. N.F.P,A. Standard 704, Hazardous Materials Labeling, shall be provided as necessary throughout the building.
