ABSTRACT
The maintenance of public landscape improvements within Landscape Maintenance District
86-2 requires funding. The California Landscape and Lighting Act of 1972 [ACT] allows
for the collection of assessments from parcels annexed into the district for this
purpose. In order to collect assessments, Chapter 3 of the ACT requires a resolution
declaring the intention to levy and collect assessments and an Engineer's report.
There are currently 106 residential parcels in Zone A of the district and 166
residential parcels in Zone B. No FY 1995/96 assessment increases are proposed for
either Zone.

The landscape maintenance district was formed on May 20. 1986 to maintain
landscape improvements and soundwalls required as conditions of approval for
the various subdivisions included within the district boundaries. The
district is comprised of two zones. "A" and "B." Zone B consists of the
Sycamore Creek properties. and Zone A consists of all other properties within
the district

FINDINGS
The estimated value of the LMD improvements for Zones "A and "8" are $525.000
and $565.000. respectively. The proposed 1995/96 assessments for Zone "A" will
remain at the FY 1994/95 rate of $186.16 per year [or $15.51 per month] per
unit based on the assessment revenue amount of $18.523 divided by the number
of units (99.5).
The proposed assessments for Zone "8" will remain at the FY 1994/95 rate of
$240.90 per year [or $20.08 per month] per year based on the assessment
revenue amount of $39.990 divided by the number of units (166).
An Engineer's Report and assessment recommendations for the district must be
presented for City Council consideration and public comment on an annual
basis. This report [Attachment 2J has been found to be technically correct as
presented.
ENVIRONMENTAL REVIEW
This item is not subject to CEQA review.
FISCAL IMPACT
Sufficient revenues will be generated by assessments to offset the District's
maintenance costs.

DECLARING THE INTENTION TO LEVY AND COLLECT
ASSESSMENTS WITHIN POWAY LANDSCAPE MAINTENANCE
DISTRICT 86-2 FOR FISCAL YEAR 1995/96
WHEREAS. the Clty Councll of the City of Poway desires to levy and
collect assessments within Poway Landscape Maintenance District 86-2 for the
purpose of maintaining. servicing. and operatlng public landscape facilities
located within the territory comprised of said district as shown in Exhibit
"A" of the Engineer's Report that is on file in the City Clerk's Office.
pursuant to the Landscape and Llghting Act of 1972; and
WHEREAS. the public interest and convenience require the maintenance.
service, and operation of public landscaping and soundwalls within said
territory.
NOW. THEREFORE, BE IT RESOLVED by the City Council of the City of Poway

FOR
POWAY LANDSCAPE MAINTENANCE ASSESSMENT
DISTRICT 86-2 FOR FISCAL YEAR 1995/96

District 86-2 was formed on May 20, 1986 for the purpose of financing the
maintenance of landscape improvements installed in conjunction with new
subdivisions within the boundaries of the district (Exhibit A). This report
sets forth the findings and engineering analysis for Poway Landscape
Maintenance District 86-2 for fiscal year 1995/96.
FINDINGS
The Landscape and Lighting Act of 1972 (Act) allows assessments to be levled
for the maintenance of certain public improvements within a subject district
according to benefit rather than estimated value (Section 22573).
The necessary revenue required to maintain the landscaping improvements within
Poway Landscape Maintenance District 86-2 have been calculated according to
benefit for fiscal year 1995/96 as provided for by the Act. All assessments
collected within this District will be expended on maintenance, utilitles, and
administration of District 86-2 landscaping improvements.
There have been no new parcels annexed into the district during the last
fiscal year. Eagle Point (aka La Paz Summit) landscape improvements were
accepted November 14, 1994; therefore, maintenance of the subdivision's LMD
improvements will begin November 1995.
ENGINEERING and BENEFIT ANALYSES
The name of this district is Poway Landscape Maintenance Assessment District
86.2, The boundary of the district is shown on Exhibit A. Property lines and
dimensions of each lot or parcel of land within the landscaping maintenance
district are shown in detail on the County of San Diego Assessor's maps.
These maps are on file in the County Assessor's Office, 1600 Pacific Highway,
Room 103, San Diego, California 92101.
On February 25, 1992, by Council Resolution No. 92-039, any commercial
properties are to be subzoned within a district. At this time, Landscape
Maintenance District 86-2 does not contain any annexed commercial parcels.
Assessments for the residential lots within the district will be calculated on
a per unit basis by dividing the required revenue by the total units within
each district.

Assessments will be collected from properties annexed into each zone of the
district. However. assessments cannot be collected from public-owned parcels
(i .e.. all public streets. public avenues. public lanes. public roads. public
drives, public courts. public alleys. all easements and rights-of-way. all
public parks. greenbelts and parkways. and all public school property being
used for public school purposes)
FACILITIES AND MAINTENANCE
The facilities to be maintained by the district are defined as the landscape
and hardscape improvements within the rights-of-way adjacent to portions of
Poway Road and within portions of the interior of the La Paz (aka Eagle Paint)
subdivision for Zone "A. Zone "B" facilities include improvements adjacent to
portions of Garden Road. Sycamore Valley Road. Quiet Valley Road. Hidden
Valley Road. the sloped areas abutting the trail. and two mini parks.
*Under current City policy. subdivisions consisting of five or more lots
that do not have direct access through. or are not immediately adjacent to
developments containing improvements maintained by a landscape maintenance
district. shall be assessed at 50 percent. The Heritage (eight parcels) is a
subdivision subject to this policy.
