ENVIRONNENTAL REVIEW The proposed use is Categorically Exempt, Class 4. FISCAL INPACT None. ~NCE Area residents who live on Sycamore Avenue immediately adjacent to the west side of the park were given a written 30-day advance notice of the event by the Community Services Department. It is recommended that the City Council approve Temporary Use Permit 95-19 subject to the conditions contained in the attached proposed resolution. BACKGROUND Section 17.26.030 of the Poway Municipal Code allows temporary events including carnivals, rodeos, parades or similar outdoor with the approval of a temporary use permit by the City Council. FINDINGS Jack Cook of t'e Pomerado Commu ity B nd in onjunction with the City of Poway propose a two ay community ban fest val wh ch will be held in Old Poway Park the weekend o May 20, 1995 an May 1, 199 Approximately 8 concert bands, ranging in s ze from 35 - 6 mem er il each present free hour long performances in the gazebo area of the par uring the two day event. The hours the bands are to play are between noon an p.m. on Saturday, and 1:30 p.m. to 6:00 p.m. on Sunday. It is anticipate hat the event will draw a maximum overall attendance of a couple thousand people. The festival coordinators have received verbal approval to use the Farmers Market area on Sunday and after the market on Saturday for event parkin . Severa Volunteer Park Rangers will assist in traffic control and other event operat ons. Staff therefore recommends that TUP 95-19 be approved subject to conditions. The proposed use is Categorically Exempt, Class 4 from the California E 1 Quality Act in that the festival is a minor use of land having negligible effects on the t. None. ADDITIONAL PUBLIC NOTIFICATION AND CORRESPONDENCE Notice of the event was handled similar to other special events in Old Poway Park. Area residents who live on Sycamore Avenue immediately adjacent to the west side of the park were given a written 30-day advance notice of the event by the Community Services Department. P- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING TEMPOP~ARY USE PERMIT 95-19 HEREAS, Temporary Use Permit 95-19, submitted by Jack Cook/Pomerado Commun ty Band and the City of Poway, applicants, requests approval to hold a commun ty band festival on May 20, 1995 and May 21, 1995 in the Old Poway Park which s located in the Open Space Recreation zone; and WHEREAS, on May 16, 1995, the City Council held a duly advertised public hearing to solicit comments from the public, both pro and con, relative to this application. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: E 1 Fi : Pursuant t the procedures of the City of Poway implemen ing the California 1 Quality Act of 1970, the above-reference project is Categor cally Exempt, Class 4 in that the event is a minor use of lan that will have negligible effects on the Section : The use is in accordance with the purposes and standards of Section 17.26.020 of the Zoning Ordinance. Section 3 :ision: The City Council hereby approves Temporary Use Permit 95-19 subject to the following conditions: Upon approval the applicant shall submit in writing that all conditions of approval have been read and understood. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF PLANNING SERVICES. SITE DEVELOPMENT 1. Site shall be developed in accordance with the approved site plans on file in the Planning Services Department and the conditions contained herein. 2. Any necessary permits for electrical power shall be secured from the Building Services Division and inspections shall be conducted before power is allowed to be used. 3. Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other applicable City Ordinances in effect at the time of building permit ' 4. Written authorization shall be obtained from the property owners of all privately owned lots used for event parking and shall be provided to the Planning Services Department prior to the date(s) of the festival. 6. All event parking shall be provided free of charge. 7. Additional restroom facilities shall be provided. 8. Emergency vehicle access shall be ~ to all buildings. 9.
