A condition of approval for this permit requires that the applicant notify all of the center tenants and tenants of the · 1 building located on the northeast corner of Poway Road and Midland Road of the carnival a minimum of one week before setup for the event. RECOMMENDATION It is recommended that the City Council approve Temporary Use Permit 95-23 subject to the conditions contained in the attached proposed resolution. BACKGROUND Section 17.26.030A of the Poway Municipal Code provides regulations for temporary uses within the City. The Code requires a temporary use permit approval by the City Council for major outdoor events or enterprises. FINDINGS Phil Spears and the Poway High School Band Boosters are requesting approval to sponsor an carnival on the Mega Foods/K-Mart site on Thursday, June 1, 1995 through Sunday, June 4, 1995. The carnival is intended to be a fundraising venture by the Poway High School Band. Christiansen Amusement plans to setup the c rnival on May 30 and May 31, 1995, and breakdown on June , 1995. The carniva will be sited on the wes erly half of the center p rking ct along Midland Rca . The easterly half of t e parking lot will be ava lable or carnival user park ng and other center tenan parking. The carnival wi 1 include adult and kids rides, games and food The hours of opera ion for the carnival will be 5-10 p.m. on Thursday, 5-11 p.m. Friday, 1-11 p.m. Saturday and 1-10 p.m. on Sunday. Christiansen Amusements have personnel who provide securi~y'for the carnival. A condition of approval for the project require that the applicant provide on- site portable restroom facilities. P- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING TEMPOP~qRY USE PERMIT 95-23 WHEREAS, Temporary Use Permit 95-23, Phil Spear and the Poway High School Band Boosters, applicants, requests approval to sponsor a fundraising carnival presented by Christiansen Amusements on the Mega Foods/K-Mart site located at the intersection of Poway Road and Midland Road on June 1, 1995 through June 4,1995. ;and WHEREAS, on May 23, 1995 the City Council considered the above-referenced item. NOW, THEREFORE, the City Council does hereby resolve as follows: Section : Pursuant to the procedure of the City of Poway, this project is not subject to CEQA because it is categorically exempt, Class 4{e} and 11(c) in that, the event is a temporary use of land that will involve the temporary siting of portable structures. Section 2: Fin That the proposed use is in accordance with the purposes and standards of Section 17.26.030 of the Poway Municipal Code. ion: The City Council hereby approves Temporary Use Permit 95-23 subject to the following conditions: APPLICANT SHALL CONTACT THE DEPARTMENT OF PI. ANNING SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: 1. Site shall be developed in accordance with the approved site plans on file in the Planning Services Department and the conditions contained herein. 2. Fire and County Sheriff's Departments shall be contacted for appropriate permits and inspections prior to the of the activity. 3. Temporary signs shall be reviewed by the Planning Services Department for compliance with the Sign Ordinance prior to installation. 4. Approval of this activity shall not excuse compliance with all other sections of the Zoning Ordinance and all other applicable City ordinances presently in effect. 5. This approval shall become null and void on June 6, 1995 at which time the site shall be restored to its original condition. 4 of e I~LAY 2 3 1995 ITEM 2b Resolution No. P- Page 2 6. Any speakers used for music or sound amplification shall be directed inward toward the event area. 7. The applicants shall provide liability ' for the carnival to the City, prior to the event, an policy naming the City as ADDITIONALLY INSURED for a minimum of $1,00,000. 8. The activity shall be conducted so that it is in compliance with Section 8.08 of the Poway Municipal Code which is the Noise Ordinance. 9. A minimum of four chemical restrooms shall be provided. At least one of the shall be disabled accessible. 10. A sign showing location of the restrooms must be posted. 11. Any dumpsters used for the event must be removed by June 6, 1995. 12. The event sites shall be left free of debris, litter, or any other evidence of the temporary use upon completion of the use. 13. All food and drink operated for profit shall secure the necessary Health Department permit and State seller's permit. 14. Inspection from the State Division of Industrial Safety shall be obtained for the amusement rides and equipment. 15. Vendors preparing food in temporary booths must provide floors, walls, and ceilings for the entire stand. 16. Waste-water disposal from food units shall be acceptable sewer or holding tanks. 17. Provision for temporary electrical power will require an electrical permit and an inspection approval by the Building Safety Inspection Division. 18. The applicant shall notify center tenants and tenants of the ' 1 building located on the northeast corner of Poway Road and Midland Road of the carnival a ~'one week before setup for the event. 19. The existing telephone poles and lines that have been installed in the center parking lot area shall be removed prior to setup for the event. APPLICANT SHALL CONTACT THE DEPARTMENT OF SAFETY SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: 1. Do not obstruct any fire lane. 2. All tents are to be tagged with State Fire Marshal approval. 3. Fire extinguishers shall be provided within 75 feet of travel. The minimum rating of each fire extinguisher shall be 2AIOBC. 5 of 8 Resolution No. P- Page 3 4 Maintain emergency vehicle access to all buildings, streets, fire hydrants and sprinkler connections affected by the carnival.
