Res 02-005RESOLUTION NO. 02-005 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA DETERMINING THAT 27 SPECIFIC PUBLIC IMPROVEMENT PROJECTS ARE OF BENEFIT TO THE PAGUAY REDEVELOPMENT PROJECT WHEREAS, the Poway Redevelopment Agency is authorized to carry out the redevelopment of the Paguay Redevelopment Project Area; and WHEREAS, the Poway Redevelopment Agency, in partnership with the local business and residential community, has identified a need for 27 specific public improvement projects to improve the community (the "Public Improvement Projects"); and WHEREAS, Attachment "A" to this report identifies each specific Public Improvement Project, its location, whether it is within the Redevelopment project area or not, its specific benefit to the Paguay Redevelopment Preject Area, the blighting conditions which will be eliminated by the Public Improvement Projects, and how each Public Improvement Project is authorized by the Paguay Redevelopment Plan and the Redevelopment and Housing Implementation Plan; and WHEREAS, the Public Improvement Projects are proposed to be located within the Paguay Redevelopment Project Area and the improvements are necessary for the execution of the Paguay Redevelopment Project under the provisions of California Community Redevelopment Law (Health and Safety Code, Section 33000 et seq.) and pursuant to the Redevelopment Plan for the Paguay Redevelopment Project which was adopted on December 13, 1983, by Ordinance No. 117 of the City Council and amended on June 15, 1993, by Ordinance No. 415 of the City Council; and WHEREAS, the City has made every reasonable effort to seek alternative sources of funds for the Public Improvement Projects, through solicitation of grants and donations, imposition of appropriate fees, and use of other City funds, but these funds have been insufficient to pay for the full cost of the Public Improvement Projects, as more specifically described in the staff report accompanying this Resolution; and WHEREAS, Section 33445 of the California Health and Safety Code requires the City Council to determine that each of the Public Improvement Projects is of benefit to the Paguay Redevelopment Project, that no other reasonable means of financing are available to the City, and that the Public Improvement Projects will assist in the elimination of blighting conditions inside the Paguay Redevelopment Project area. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as follows: Section 1. The City Council hereby determines that each of the identified Public Improvement Projects will be of benefit to the Paguay Redevelopment Project and the surrounding community for the reasons which are specified in Attachment "A". Resolution No. 02-005 Page 2 Section 2. The City Council further determines that no other reasonable means of financing the Public Improvement Projects are available to the community. The City finds that City staff has made every reasonable effort to seek alternative sources of funds prior to consideration of Redevelopment Agency funds for the Public Improvement Projects, grents have been sought, donations requested, and other City funds have been utilized for other projects as apprepriate within the guidelines of fiscal prudence, but the City has sufficient funds to pay for necessary services. The City Council further finds that development fees, property tax, sales tax and other sources of City revenue will not be sufficient to pay for the identified Public Improvement Projects. Section 3. The City Council hereby determines that the payment of funds for the Public Improvement Projects will assist in the elimination of one or more blighting conditions inside the Paguay Redevelopment Project Area, for the reasons which are specified in Attachment "A." Section 4. The City Council hereby determines that the payment of funds for the Public Improvement Projects is consistent with the Redevelopment and Housing Implementation Plan, for the reasons which are specified in Attachment "A." Section 5. The City Council hereby determines that each of the Public Improvement Projects is provided for in the Paguay Redevelopment Plan, as specified in Attachment Section 6. The City Clerk shall certify to the adoption of this Resolution. Section 7. If any part of this Resolution is held to be invalid for any reason, or if the approval of the funding of one or more of the Public Improvement Projects is held to be invalid, such decision shall not affect the validity of the remaining portion of this Resolution or of the approval of the remaining Public Improvement Projects, and this City Council hereby declares that it would have approved the remaining portion of this Resolution and the remaining Public Improvement Projects if such invalid portion thereof had been deleted. Project Description: Construction of a train depot at the south-eastern portion of Old Poway Park. Wood-style construction of approximately 1400 square feet with 1200 square feet covered platform. To house staff offices, ticket office/gift shop, & railroad library. Benefit to Project Area: This project is of benefit to the Paguay Redevelopment Project Area in that the construction of a train depot for the recreational train at Old Poway Park provides enhanced recreational opportunities within the Project Area for the benefit of local residents and the entire community. Recreational opportunities contribute to the elimination of blighting conditions within the Project Area and provide a community-wide benefit. Section 400 of the Amended Redevelopment Plan and Section II C of the Redevelopment and Housing Implementation Plan identify a number of goals and objectives of the Redevelopment Project Area. Included in these goals are: * Provision of needed improvements to the community's educational, cultural, residential and community facilities to better serve the Project Area. · The acquisition and development of new parks and recreational facilities to meet General Plan requirements. Section 500 of the Amended Redevelopment Plan provides specific action to eliminate and prevent the reoccurrence of conditions of blight, and to strengthen the economic base of the Project Area including: · Development or redevelopment of land by private enterprise or public agencies for purposes and uses consistent with this Redevelopment Plan. The Redevelopment and Housing Implementation Plan addresses the relationship of redevelopment activities to the elimination of blight, and re-examines the goals of the Redevelopment Plan and the blighting conditions present in the Project Area. In addition, the Redevelopment and Housing Implementation Plan specifies the project and expenditures with which the Agency proposes to eliminate blight during the next five years. Resolution No. 02-005 Page 5 Project Name: Skateboard Park Project #: Project Location: 259 This project is located both within the Paguay Redevelopment Project Area and immediately adjacent to the Project Area. Project Description: City's share of costs for development of a 14,400 square- foot skateboard park. The skate surface is to be constructed of concrete and includes bowls, rails, and steps. Project also includes landscaping, restroom, bus stop and shade structure. Benefit to Project Area: This project is of benefit to the Paguay Redevelopment Project Area in that the development of a skateboard park provides enhanced recreational opportunities within the Project Area for the benefit of local residents and the entire community. Recreational opportunities contribute to the elimination of blighting conditions within the Project Area and provide a community-wide benefit. The Skateboard Park, primarily designed for younger residents, will reduce damage to public and private facilities in the community by the provision of an appropriate area for skateboarding. Section 400 of the Amended Redevelopment Plan and Section H C of the Redevelopment and Housing Implementation Plan identify a number of goals and objectives of the Redevelopment Project Area. Included in these goals are: · Provision of needed improvements to the community's educational, cultural, residential and community facilities to better serve the Project Area. · The acquisition and development of new parks and recreational facilities to meet General Plan requirements. Section 500 of the Amended Redevelopment Plan provides specific action to eliminate and prevent the reoccurrence of conditions of blight, and to strengthen the economic base of the Project Area including: · Development or redevelopment of land by private enterprise or public agencies for purposes and uses consistent with this Redevelopment Plan. Resolution No. 02-005 Page 6 Project Name: Community Road Widening Project #: Project Location: 288 This project is located within the Paguay Redevelopment Project Area. Project Description: Widen Community Road to ultimate width of four lanes from Poway Road to Aubrey; include new right turn at Twin Peaks and Community; relocation of existing signal & elimination of existing free fight turn lane. Also complete 4 lane width to Poway Road. Benefit to Project Area: This project is of benefit to the Paguay Redevelopment Project Area by providing traffic cimulation improvements within the Project Area to alleviate persistent conditions of blight resulting from inadequate street improvements. Community Road is an older street that shows signs of physical deterioration. It presents circulation problems because it is not wide enough to handle current or projected traffic volumes. Traffic circulation improvements contribute to the elimination of blighting conditions within the Project Area and benefit the entire community. Section 400 of the Amended Redevelopment Plan and Section II C of the Redevelopment and Housing Implementation Plan identify a number of goals and objectives of the Redevelopment Project Area. Included in these goals are: · The elimination of traffic circulation deficiencies and the provision of future access to accommodate regional traffic demands and service currently undevelopable outlying areas. · Provision of adequate roadways and traffic and circulation improvements to correct street alignment problems and substandard alleys, to eliminate road hazards and to provide adequate street and freeway access throughout and nearby the Project Area. Section 500 of the Amended Redevelopment Plan provides specific action to eliminate and prevent the reoccurrence of conditions of blight, and to strengthen the economic base of the Project Area including: Acquisition, installation, development, construction, reconstruction, redesign, replanning or reuse of streets, utilities, curbs, gutters, sidewalks, traffic control devices, flood control facilities and other public improvements, public facilities, utilities or other structures. The Redevelopment and Housing Implementation Plan addresses the relationship of redevelopment activities to the elimination of blight, and re-examines the goals of the Redevelopment Plan and the blighting conditions present in the Project Area. In addition, the Redevelopment and Housing Implementation Plan specifies the project and expenditures with which the Agency proposes to eliminate blight during the next five years. Project Description: This project provides funding assistance for a proposed facility dedicated to the exposition of and instruction in the fine arts. Benefit to Project Area: This project is of benefit to the Paguay Redevelopment Project Area in that the development of a Community Fine Arts Center Facility within the Project Area provides enhanced cultural opportunities for the benefit of local residents and the entire community. Provision of a Fine Arts Facility contributes to the elimination of blighting conditions within the Project Area and provides a community-wide benefit. Section 400 of the Amended Redevelopment Plan and Section H C of the Redevelopment and Housing Implementation Plan identify a number of goals and objectives of the Redevelopment Project Area. Included in these goals are: · Provision of needed improvements to the community's educational, cultural, residential and other community facilities to better serve the Project Area. Project Description: Acquisition of floodway parcels along Rattlesnake Creek in the Old Poway area (Midland and Community Roads). Benefit to Project Area: This project is of benefit to the Paguay Redevelopment Project Area in that the acquisition of floodway parcels for potential sports fields within the Project Area provides enhanced recreational opportunities for the benefit of local residents and the entire community. Recreational opportunities contribute to the elimination of blighting conditions within the Project Area and provide a community-wide benefit. Section 400 of the Amended Redevelopment Plan and Section II C of the Redevelopment and Housing Implementation Plan identify a number of goals and objectives of the Redevelopment Project Area. Included in these goals are: · Provision of needed improvements to the community's educational, cultural, residential and community facilities to better serve the Project Area. · The acquisition and development of new parks and recreational facilities to meet General Plan requirements. Project Description: City portion of funding for the installation of an orchestra pit lift in the forestage area of the Poway Center for the Perforating Arts. Benefit to Project Area: This project is of benefit to the Paguay Redevelopment Project Area in that the installation of an orchestra pit lift at the Poway Center for the Performing Arts within the Project Area provides enhanced cultural opportunities for the benefit of local residents and the entire community. This project will also expand the types of uses and performances at the Performing Arts Center. Cultural opportunities contribute to the elimination of blighting conditions within the Project Area and also provide a community-wide benefit. Section 400 of the Amended Redevelopment Plan and Section II C of the Redevelopment and Housing Implementation Plan identify a number of goals and objectives of the Redevelopment Project Area. Included in these goals are: · Provision of needed improvements to the community's educational, cultural, residential and other community facilities to better serve the Project Area. Section 500 of the Amended Redevelopment Plan provides specific action to eliminate and prevent the reoccurrence of conditions of blight, and to strengthen the economic base of the Project Area including: · Rehabilitation, alteration, remodeling, improvement, modernization, or reconstruction of buildings, structures and improvements. · Development or redevelopment of land by private enterprise or public agencies for purposes and uses consistent with this Redevelopment Plan. Project Name: Project #: Project Location: Project Description: Resolution No. 02-005 Page 11 Acquisition of Commercial Site 344 This project is located within the Paguay Redevelopment Project Area. Land acquisition and environmental mitigation for the acquisition of A Plus Auto Repair, located at 13123 Poway Road. Benefit to Project Area: The land acquisition and environmental mitigation of the commercial site is part of the expansion of Tarascan Drive south of Poway Road to Civic Center Drive. The business is within the Project Area and is being relocated from the Town Center Area to the Auto General Commercial Zone. The project is of benefit in that the extension of Tarascan will alleviate traffic congestion for the benefit of local residents and the entire community. Additionally, the environmental mitigation of the site provides a community-wide benefit. Both traffic circulation improvements and environmental mitigation contribute to the elimination of blighting conditions within the Project Area. Section 400 of the Amended Redevelopment Plan and Section II C of the Redevelopment and Housing Implementation Plan identify a number of goals and objectives of the Redevelopment Project Area. Included in these goals are: · The elimination of traffic circulation deficiencies and the provision of future access to accommodate regional traffic demands and service currently undevelopable outlying · Provision of adequate roadways and traffic and circulation improvements to correct street alignment problems and substandard alleys, to eliminate road hazards and to provide adequate street and freeway access throughout and nearby the Project Area. Section 500 of the Amended Redevelopment Plan provides specific action to eliminate and prevent the reoccurrence of conditions of blight, and to strengthen the economic base of the Project Area including: * Acquisition, installation, development, construction, reconstruction, redesign, replanning or reuse of streets, utilities, curbs, gutters, sidewalks, traffic control devices, flood control facilities and other public improvements, public facilities, utilities or other structures. · Taking any action the Agency determines as necessary and consistent with state, federal and local laws to remedy or remove a release of hazardous substances on, under or from property within the Project Area or to remove hazardous waste from the property. The Redevelopment and Housing Implementation Plan addresses the relationship of redevelopment activities to the elimination of blight, and re-examines the goals of the Redevelopment Plan and the blighting conditions present in the Project Area. In addition, the Redevelopment and Housing Implementation Plan specifies the project and expenditures with which the Agency proposes to eliminate blight during the next five years. The Redevelopment and Housing Implementation Plan explains how these programs and projects will eliminate blight, and establishes a program for monitoring the progress of these activities. Resolution No. 02-005 Page 12 Project Name: Community Road #3 Pressure Reducing Station Project #: 359 Project Location: This project is located within the Paguay Redevelopment Project Area. Project Description: Construct a domestic water pressure reducing station near Community Road and Scripps Poway Parkway with a 3,500 GPM approximate capacity; 8 inch main valve, with 2.5 inch secondary valve. Benefit to Project Area: This project is of benefit to the Paguay Redevelopment Project Area in that the development of a pressure reducing station within the Project Area provides enhanced ability to deliver domestic water to local residents and businesses within the community. Inadequate water infrastructure is one of the most prevalent conditions of blight cited by the Redevelopment Plan. The pressure reducing station contributes to the elimination of blighting conditions within the Project Area and provides a community-wide benefit. Section 400 of the Amended Redevelopment Plan and Section II C of the Redevelopment and Housing Implementation Plan identify a number of goals and objectives of the Redevelopment Project Area. Included in these goals are: The elimination of deficiencies in trunk line sewer and water distribution systems, to increase system capacities and extend lines as required to serve the Project Area's ultimate build out population in conformance with the General Plan. Section 500 of the Amended Redevelopment Plan provides specific action to eliminate and prevent the reoccurrence of conditions of blight, and to strengthen the economic base of the Project Area including: Acquisition, installation, development, construction, reconstruction, redesign, replanning or reuse of streets, utilities, curbs, gutters, sidewalks, traffic control devices, flood control facilities and other public improvements, public facilities, utilities or other structures. The Redevelopment and Housing Implementation Plan addresses the relationship of redevelopment activities to the elimination of blight, and re-examines the goals of the Redevelopment Plan and the blighting conditions present in the Project Area. In addition, the Redevelopment and Housing Implementation Plan specifies the project and expenditures with which the Agency proposes to eliminate blight during the next five years. The Redevelopment and Housing Implementation Plan explains how these programs and projects will eliminate blight, and establishes a program for monitoring the progress of these activities. Resolution No. 02-005 Page 13 Project Name: Poway Road Specific Plan Implementation Project #: 383 Project Location: This project is located both within the Paguay Redevelopment Project Area and immediately adjacent to the Project Area. Project Description: Lease buy-outs, hazardous materials clean up, relocations, acquisitions and studies related to the redevelopment of commercial facilities along Poway Road. Benefit to Project Area: This project is of benefit to the Paguay Redevelopment Project Area in that the implementation of the Poway Road Specific Plan provides for the revitalization of Poway's existing commercial corridor thereby providing employment opportunities and strengthening the City's economic base. Implementation of the Poway Road Specific Plan enhances the Project Area and contributes to the elimination of blighting conditions within the Project Area and provides a community-wide benefit. Section 400 of the Amended Redevelopment Plan and Section II C of the Redevelopment and Housing Implementation Plan identify a number of goals and objectives of the Redevelopment Project Area. Included in these goals are: · The elimination of environmental deficiencies and visual blight, especially along Poway Road. · Provision for the enhancement and renovation of businesses within the Project Area to promote their economic viability. · Stimulation of investment of the private sector in the full development of the Project Area. Section 500 of the Amended Redevelopment Plan provides specific action to eliminate and prevent the reoccurrence of conditions of blight, and to strengthen the economic base of the Project Area including: · Rehabilitation, alteration, remodeling, improvement, modernization, or reconstruction of buildings, structures and improvements. · Development or redevelopment of land by private enterprise or public agencies for purposes and uses consistent with this Redevelopment Plan. The Redevelopment and Housing Implementation Plan addresses the relationship of redevelopment activities to the elimination of blight, and re-examines the goals of the Redevelopment Plan and the blighting conditions present in the Project Area. In addition, the Redevelopment and Housing Implementation Plan specifies the project and expenditures with which the Agency proposes to eliminate blight during the next five years. The Redevelopment and Housing Implementation Plan explains how these programs and projects will eliminate blight, and establishes a program for monitoring the progress of these activities. Resolution No. 02-005 Page 14 Project Name: Poway Road Street Improvements Project #: 384 Project Location: This project is located both within the Paguay Redevelopment Project Area and immediately adjacent to the Project Area. Project Description: Develop scope of work and implement street improvements along Poway Road. The improvements will include furniture, lighting, and a district-wide signage Plan. Benefit to Project Area: This project is of benefit to the Paguay Redevelopment Project Area in that the implementation of the Poway Road Street Improvements within the Project Area provides for the revitalization of Poway's existing commemial corridor thereby providing employment oppommities and strengthening the City's economic base. Implementation of the Poway Road Street Improvements enhances the Project Area and contributes to the elimination of blighting conditions within the Project Area and provides a community-wide benefit. Section 400 of the Amended Redevelopment Plan and Section II C of the Redevelopment and Housing Implementation Plan identify a number of goals and obi ectives of the Redevelopment Project Area. Included in these goals are: · The development of new streetscapes and the establishment of design controls for redevelopment, rehabilitation, and development of commercial areas. · The elimination of environmental deficiencies and visual blight, especially along Poway Road. Vacated property will be combined with adjacent RDA property and used for future commercial purposes. Benefit to Project Area: This project is of benefit to the Paguay Redevelopment Project Area in that the relocation of the four mobilehomes will allow for adjustment of the Poinsettia Senior Mobilehome Park's western boundary. The four homes will be relocated to Agency-owned property located just south of the current location. The vacated area will be combined with the adjacent Redevelopment Agency property to the west. Benefit to Project Area: This project is of benefit to the Paguay Redevelopment Project Area in that the emergency access road provides a second vehicular access into the Old Winery Estates Subdivision. The emergency access road was recommended by the Safety Services Department to increase the fire and emergency response for the benefit of local residents and the entire community. Enhanced Safety Services access contributes to the elimination of blighting conditions within the Project Area and provides a community-wide benefit. Section 400 of the Amended Redevelopment Plan and Section II C of the Redevelopment and Housing Implementation Plan identify a number of goals and objectives of the Redevelopment Project Area. Included in these goals are: · The elimination of traffic circulation deficiencies and the provision of future access to accommodate regional traffic demands and service currently undevelopable outlying areas. · Alleviation of certain environmental deficiencies including substandard vehicular and pedestrian circulation systems, insufficient street lights, off-street parking and other similar public improvements. Section 500 of the Amended Redevelopment Plan provides specific action to eliminate and prevent the reoccurrence of conditions of blight, and to strengthen the economic base of the Project Area including: Acquisition, installation, development, construction, reconstruction, redesign, replanning or reuse of streets, utilities, curbs, gutters, sidewalks, traffic control devices, flood control facilities and other public improvements, public facilities, utilities or other structures. The Redevelopment and Housing Implementation Plan addresses the relationship of redevelopment activities to the elimination of blight, and re-examines the goals of the Redevelopment Plan and the blighting conditions present in the Project Area. In addition, the Redevelopment and Housing Implementation Plan specifies the project and expenditures with which the Agency proposes to eliminate blight during the next five years. Replaces the driveway into the Community Park; installs a 40-foot road, curb gutters, and sidewalk the entire length. Benefit to Project Area: This project is of benefit to the Paguay Redevelopment Project Area by the provision of traffic cimulation improvements within the Project Area to alleviate persistent conditions of blight resulting from inadequate street improvements. Civic Center Drive is an older street that shows signs of physical deterioration. Traffic improvements contribute to the elimination of blighting conditions within the Project Area and benefit the entire community. The raised medians will be landscaped to provide a more attractive streetscape for the benefit of local residents and the entire community. The raised medians contribute to the elimination of blighting conditions within the Project Area and provide a community-wide benefit. All work will be historic in nature with wood finish to match existing buildings. Benefit to Project Area: This project is of benefit to the Paguay Redevelopment Project Area in that the construction of a railroad project within the Project Area provides enhanced recreational oppommities within the Project Area for the benefit of local residents and the entire community. Recreational opportunities contribute to the elimination of blighting conditions within the Project Area and provide a community-wide benefit.
