ABSTRACf
Because of difficulties in enforcing existing posted speed limits, the Sheriff's
Department requested an updated review of speed limits on Martincoit Road. This issue
was reviewed by the Traffic Safety Committee (TSC) on May 9, 1995. The TSC approved
staff's findings and recommendation.

adoption; and, 3) approve the attached Resolution rescinding Resolution 83-074.

Backaround
Several complaints have been received by the Sheriff's Department and by City
staff concerning speeding on Martincoit Road, particularly near Rostrata Road.
The Sheriff's Department has responded to the complaints by maintaining a
periodic presence in the area, but enforcement of the posted speed limits has
proven difficult because of a short 25 MPH speed limit that is posted on a
portion of the street. The Sheriff's Department has requested that an updated
speed limit review be performed. Staff has completed updated studies and the
Traffic Safety Committee (TSC) reviewed and approved the findings at the May
9, 1995 meeting.
Traffic/Site Conditions
Martincoit Road is a 36 foot wide rural residential collector. Martincoit
terminates at Espola Road on its north end and at Orchard Gate Road at its
south end. An all-way stop sign exists at Rostrata, an east west running
collector which tees into Martincoit. The all-way stop is emphasized by red
flashing lights at the intersection. Other minor residential streets intersect
with Martincoit at irregular intervals.

Findinas
Staff completed a drive-through of Martincoit Road to observe existing roadway
conditions. Sight visibility at all intersections was observed and found to be
adequate except for the intersection at Stone Canyon Road. Bushes and trees
appear to have overgrown and cause reduced visibility for cars approaching
Martincoit from Stone Canyon. A work request has been submitted for tree and
bush trims to improve sight distance.
Markings, such as signs, striping, and legends also were reviewed. All are
visible and in good condition. It was noted that two 25 mph speed limit signs
appear to have been incorrectly installed in the southbound direction; one at
the north end of Martincoit near Espola, and the other just south of Rostrata.
Both are in areas identified by speed survey data as 35 MPH zones.
Painted Rock Elementary School is located on Martincoit Road between Sagewood
and Green Valley Creek. All school warning signs, including the school speed
zone signs, are properly placed and visible. The main school parking lot is on
the opposite side of Martincoit. A midblock school crosswalk connects the
parking lot with the school grounds. School crosswalk signs are properly
posted and visible.
Previous speed surveys and documentation for Martincoit Road were reviewed.
Speed surveys from 1981, 1986, and 1991 support a posted 35 MPH speed limit on
two segments of Martincoit (from Espola to Rostrata and from Rostrata to Stone
Canyon Road). No Council Resolution or Ordinance establishing the 35 MPH speed
limit has been adopted.
A 1983 Council action (Resolution 83-074, Attachment F) established a 25 MPH
speed limit on Martincoit from Green Valley Creek to Rostrata (a 1500 foot
segment). This action was a result of citizen complaints of unsafe conditions
at the .s. curve just south of Painted Rock Elementary School. The complaints
noted that several accidents had occurred in the curves, resulting in cars
leaving the road and stopping in front yards. The 1983 Council item indicated
that restricted sight visibility, design speed of the curves, and a dip
section at Green Valley Creek justified establishing the 25 MPH limit.
In addition to installing 25 MPH signs between Green Valley Creek and
Rostrata, curve warning signs and chevrons were installed to improve
visibility of the .s. curves. The signs appear to have been effective in
eliminating the accidents. No additional complaints were received and no
accidents involving the curves have been reported.
A ball-bank analysis of the .s. curve south of Painted Rock School was
completed. The survey is included as Attachment C. The most easterly of the

two curves contained the slowest comfortable speed (26 HPH northbound). In
addition to the ball-bank analysis, ,design speeds were calculated for all
horizontal and vertical curves along Hartincoit using the Caltrans Highway
Design Hanual. Speeds were calculated for horizontal curves based on both
sight visibility and comfortable speed using superelevation. See address/curve
diagram, Attachment D. Two curves, (both south of Stone Canyon), were recorded
to have sight distance below the 35 HPH design speed. Only one of the curves
has a comfortable speed above 30 HPH, however.
New speed surveys were completed in three segments along Hartincoit; between
Espola Road and Painted Rock School, between Painted Rock School and Rostrata,
and between Rostrata and Stone Canyon Road. Following are the 85th percentile
speeds found in those areas:
Espola to Painted Rock 39 HPH both directions
Painted Rock to Rostrata 39 HPH both directions
Rostrata to Stone Canyon 45 MPH both directions
The Sheriff's Department has determined that use of radar on Hartincoit would
constitute a speed trap. Section 40802 of the California Vehicle Code
addresses speed traps and the use of radar in enforcing posted speed limits.
The section sets conditions which must exist if radar is to be used in speed
enforcement. Generally stated, Section 40802 requires that a road must meet
specific conditions as to width, length, and number of lanes if it is to be
prima facie zoned at 25 HPH. Otherwise, an Engineering and Traffic Survey must
be completed to determine the speed limit which would be radar enforceable.
One paragraph in Section 40802 allows for 'local interpretation' of this
requirement. The paragraph indicates that roads noted on Federal Functional
Classification Haps as local streets and roads may be prima facie zoned. The
Functional Classification definition of a local street or road is more general
than the strict definition stated in the Vehicle Code. This general definition
has provided an opportunity to eliminate speed surveys that don't support
speed limits on some problem streets. Where possible, staff and the Sheriff's
Department have been working to increase the use of the Functional
Classification maps in supporting 25 HPH prima facie speed limits.
Hartincoit Road is shown on the Federal Functional Classification maps as an
unclassified street. Its function, as defined in the Highway Functional
Classification Concepts, Criteria and Procedures manual (Rev. Har 1989)
published by the U.S. Department of Transportation, is that of a collector
street. Because of this, Hartincoit requires an Engineering and Traffic Survey
to support the posted speed limit.
The 1983 action to establish the 1500 foot 25 HPH speed limit used safe design
speed, a dip at Green Valley Creek, and the proximity of the school as
justification for establishing the limit. Using current references and
procedures, these issues are more properly addressed using signs instead of
reducing the speed limit.
Based on the updated speed and accident data, a 35 MPH speed limit from
Rostrata Road to Stone Canyon Road, and a 30 HPH speed limit from Espola Road

justified by the following conditions which may not be readily apparent to the
average driver: 1) Moderate pedestrian activity with no pedestrian facilities,
2) Hidden residential driveways, and 3) Curves having lower design speeds than

RESOLUTION NO. 83-074
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
ESTABLISHING A 25 MILE PER HOUR SPEED LIMIT
ON MARTINCOIT ROAD
WHEREAS, Section 22.358 of the California Vehicle Code
permits the establishment of a reduced speed zone in the City
of Poway, where based upon an engineering and traffic study, a
speed limit lower than the normal is safe and reasonable by reason
of special conditions; and
WHEREAS, engineering studies indicate that local roadway
conditions allow a safe and reasonable speed of 25 miles per hour.
NOW, THEREFORE, BE IT RESOLVED that in accordance wi th said
Section 22.358, that a 25 mile per hour speed limit is hereby
established on Martincoit Road between Rostrada Road and Green Valley
Creek.
PASSED and ADOPTED by the City Council of the City of Poway,
California at a regular meeting thereof this 11th day of October ,
1983.

ORDINANCE NO.
AH ORDINANCE OF THE CITY OF POWAY, CALIFORNIA
ADDING TO SECTION 10.32.020 OF THE POWAY MUNICIPAL CODE
ESTABLISHING SPEED LIMITS ON MARTINCOIT ROAD FROM
ESPOLA ROAD TO STONE CANYON ROAD
THE CITY COUNCIL OF THE CITY OF POWAY DOES ORDAIN AS FOLLOWS:
Section 1: Pursuant to Section 22358 of the California Vehicle Code
permitting decrease of local speed limits upon the completion and
recommendation of an engineering and traffic survey; a 30 mph speed limit on
Martincoit Road from Espola Road to Rostrata Road; and, a 35 mph speed limit
on Martincoit Road from Rostrata Road to Stone Canyon Road is hereby
established.
Section 10.32.020 of the Poway Municipal Code shall be amended to include:
Martincoit Road. The prima facie speed limit on Martincoit Road from
Espola Road to Rostrata Road is decreased to and established at 30 miles
per hour.
Martincoit Road. The prima facie speed limit on Martincoit Road from
Rostrata Road to Stone Canyon Road is decreased to and established at 35
miles per hour.
Said speed limits are reduced 5 mph from the 85th percentile speed based
on the following unusual conditions: 1) Design speed for roadway geometry
is below 85th percentile speed; 2) Moderate pedestrian activity with no
pedestrian facilities, and 3) Hidden residential driveways.
Section 2: This Ordinance shall take effect and be in force thirty (30) days
after the date of its passage; and before the expiration of fifteen (15) days
after its passage, it shall be published once with the names of members voting
for and against the same in the Powav News Chieftain, a newspaper of general
circulation published in the City of Poway.
Introduced and first read at a regular meeting of the City Council of the
City of Poway held the 20th day of June, 1995, and thereafter PASSED AND
ADOPTED at a regular meeting of said City Council held the 11th day of July,
1995, by the following roll call vote:

RESCINDING RESOLUTION NO. 83-074 ESTABLISHING SPEED LIMITS
ON A SEGMENT OF MARTINCOIT ROAD
Whereas, Section 22358 of the California Vehicle Code permits the
establishment of local speed limits in the City of Poway; and
Whereas, the City Council has determined that an Ordinance establishing
speed limits on Martincoit Road should be adopted,
NOW, THEREFORE, BE IT RESOLVED that Resolution B3-074 shall hereby be
rescinded effective August 10, 1995.
PASSED, ADOPTED AND APPROVED by the City Council of the City of Poway,
California at a regular meeting thereof this 20th day of June, 1995.
