A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA
APPROVING A REGULATORY FEE AS A SURCHARGE TO WATER AND
SEWER FEES, INCREASING DEVELOPMENT FEES, AND A NEW
REGULATORY FEE FOR CERTAIN COMMERCIAL AND INDUSTRIAL BUSINESSES,
TO RECOVER THE COST TO COMPLY WITH THE
NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) ORDER NO.
2001-01
WHEREAS, the Poway Municipal Code authorizes the City Council to establish
certain fees and deposits for the processing, checking, and inspection of grading plans
and permits by resolution; and
Whereas, Article Xl, Section 7 of the California State Constitution authorizes a
regulatory fee to defray the cost of the NPDES program; and
WHEREAS, on February 21, 2001, the San Diego Regional Water Quality
Control Board adopted National Pollutant Discharge Elimination System (NPDES) Order
2001-01, requiring all agencies within San Diego County to administer Storm Water
Pollution Prevention Plans for proposed and existing development projects.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway
as follows:
1. Resolution No. 95-104 is hereby amended to include the following
inspection and plan check fees:

The fees adopted herein are to cover the expenses of the City of Poway,
its officers, employees, agents, contractors, and assigns incurred for all
engineering, administrative, professional, and technical services including,
but not limited to, all those necessary to accept, process, check, examine,
revise, administer, prepare, and approve grading plans, improvement
plans, Storm Water Pollution Prevention Plans, erosion control plans,
subdivision maps, parcel maps, boundary adjustments, reversions,
mergers, certificates of compliance, plats, dedications, covenants,
agreements, and related reports, studies, calculations, exhibits, and
permits, and to inspect and administer the construction of same, and to
ascertain or determine their compliance with the Poway Municipal Code,
State Subdivision Map Act, and any other applicable local, county, state,
or federal code, statue policy, or regulation.
The following regulatory fees are approved and shall be included as part
of the City's regular bill for water and sewer services:
Developed property with a residential water meter or sewer service shall
pay $4.20 per month or $8.40 bimonthly.
Developed commercial or industrial property, including property developed
with multifamily units, with water meters less than 2 inches in size shall
pay $4.36 per month or $8.72 bimonthly.
Developed commercial or industrial property, including property developed
with multifamily units, with water meters 2 inches or greater in size shall
pay $11.63 per month or $23.26 bimonthly.

Existing commercial or industrial establishments required under the Order
to obtain additional permits will also pay a fee to cover cost of this
program. This fee will be billed annually and will be based on the following
schedule:

Mid Priority $400
Low Priority $200
This revised fee schedule will take effect sixty (60) days from the date of
approval of this resolution.
PASSED, ADOPTED, AND APPROVED, by the City Council of the City of
Poway at a regular meeting this 9th day of April 2002.
