Res 02-040RESOLUTION NO. 02-040 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA SUPPORTING THE CITY OF SAN DIEGO'S APPEAL TO THE STATE COASTAL COMMISSION FOR RENEWAL OF THE MODIFIED NPDES PERMIT FOR THE CITY OF SAN DIEGO'S POINT LOMA WASTEWATER TREATMENT PLANT DISCHARGE TO THE PACIFIC OCEAN THROUGH THE POINT LOMA OCEAN OUTFALL WHEREAS, on February 11 2002, the United States Environmental Protection Agency issued Tentative Order No. R-92002-0025, Modified NPDES Permit No. CA0107409 for the City of San Diego; and WHEREAS, the City Council adopted Resolution No. 02-018, on March 12, 2002, endorsing the Environmental Protection Agency's Tentative Order No. R-92002-0025, Modified NPDES Permit No. CA0107409 for the City of San Diego; and WHEREAS, this tentative order was based on careful review by the Environmental Protection Agency of all available scientific evidence which indicates that the current system of treatment performed at the Point Loma Wastewater Treatment Plant causes no environmental harm to the ocean or shoreline environments; and WHEREAS, the State Coastal Commission is required to certify the City of San Diego's application for renewal of Tentative Order No. R-92002-0025, Modified NPDES Permit No. CA0107409; and WHEREAS, the State Coastal Commission denied certification of the City of San Diego's application for renewal of Tentative Order No. R-92002-0025, Modified NPDES Permit No. CA0107409; and WHEREAS, the State Coastal Commission, by denying to certify the City of San Diego's application for renewal of Tentative Order No. R-92002-0025, Modified NPDES Permit No. CA0107409, overruled its own staff, the United States Environmental Protection Agency, and the Regional Water Quality Control Board; and WHEREAS, the State Coastal Commission failed to include any findings or basis of support for its denial; and WHEREAS, the expenditures necessary to upgrade the plant to an unneeded and unwarranted level of secondary treatment would impose unnecessary financial burdens on the ratepayers of the Participating Agencies of the Metropolitan Sewerage System. Resolution No. 02-040 Page 2 NOW, THEREFORE, BE IT RESOLVED, that for and on the behalf of the citizens of Poway, the City Council of the City of Poway hereby declares its support for the City of San Diego's Appeal to the State Coastal Commission for renewal of the Modified NPDES Permit for the City of San Diego's Point Loma Wastewater Treatment Plant to continue its discharge of treated wastewater to the Pacific Ocean at its present level of treatment.
