ABSTRACT This report concerns initiation of an amendment to the South Poway Specific Plan for the proposed Poway Entertainment Center Project pursuant to Chapter 17.47 of the Poway Zoning Development Code. Consideration of the project is scheduled for July 18, 1995. ENVIRONMENTAL REVIEW Initiation of a specific plan amendment is not subject to CEQA. The Draft EIR prepared for the project was distributed for a 45-day public review period which began on May - 12, 1995. The EIR addresses the requested specific plan amendment under the environmental issue area of Land Use and Planning. FISCAL IMPACT None. ADDITIONAL PUBLIC NOTIFICATION AND CORRESPONDENCE The agenda report for this it&l was sent to the applicant and their prime consultant, Rick Planning Group. RECOMMENDATION It is recommended that the City Council adopt the resolution initiating South Poway Specific Plan Amendment 84-01Z. Pursuant to Chapter 17.47 of the Poway Municipal Code, specific plan amendments are "initiated" by resolution. This item is specifically limited to the initiation of the specific plan amendment. The public hearing for the consideration of the actual development application has been scheduled for the meeting of July 18, 1995. FINDINGS Prior to the hearing of the development application for the proposed project, it is necessary for the City Council to adopt a resolution "initiating" the proposed specific plan amendment. Consideration of the application itself will be at the July 18, 1995 meeting. ENVIRONMENTAL REVIEW Initiation of a specific plan amendment is not subject to CEQA. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA INITIATING AN AMENDMENT TO THE SOUTH POWAY SPECIFIC PLAN, SPECIFIC PLAN AMENDMENT (SPA 84-01Z) WHEREAS, Chapter 17.47 (Specific Plan Regulations) of Title 17 (Zoning Development Code) of the Poway Municipal Code provides the requirements for the initiation, preparation and adoption of specific plans in accordance with Section 65450, et seq. of the California Government Code (Article 8, Specific Plan); and WHEREAS, Section I7.47.020.C (Initiation) of the Zoning Development Code provides that the City Council may initiate the preparation of, or amendment to, a specific plan on property by resolution; and WHEREAS, the City has received I planning application from Bill Silva Presents, applicant, for the development of the proposed Poway Entertainment Center (outdoor amphitheater) project to be located within the South Poway Specific Plan area; and WHEREAS, the planning application includes a request to amend the South Poway Specific Plan (SPA 84-0IZ) to add an amphitheater land use category along with specific development requirements to appropriate sections of the South Poway Development Plan and Development Standards in areas currently designated as Light Industrial, Industrial Park, Commercial and Open Space (1 Dwelling Unit); and WHEREAS, the site of the subject project is located on the southerly 74.0 acre portion of Assessor's Parcel NWllber (APN) 323-091-01 situated at the southeast corner of Scripps Poway Parkway and Danielson Street in the South Poway Business Park; and WHEREAS, the City Council may consider the initiation of Specific Plan Amendment (SPA 84-0IZ) as provided above, and the action to initiate the requested amendment is specifically li.ited to such purpose and is prerequisite to the duly advertised public hearing for the entire develo~nt application. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Poway hereby initiates proposed Specific Plan Amendment (SPA 84-0IZ) in accordance with the provisions of the Poway Zoning Development Code as identified above.
