BACKGROUND
The proposed City of Poway Subarea Habitat Conservation Plan (Poway Subarea
HCP) and companion I.plementing Agreement/Management Authorization (IA/MA)
documents have been prepared by the City of Poway/Poway Redevelopment Agency
to comply with the requirements of the Natural C~nities Conservation
Planning (NCCP) Act of 1991, and the NCCP Process and Conservation
"Guidelines", as adopted in Novelber, 1993 by the California Department of
Fish and Game (CDFG) in collaboration with the U.S. Fish and Wildlife Service
(USFWS).
The proposed documents have also been prepared to satisfy the related
biological impact .itigation measure identified in the certified Final
Environmental Impact Report for the approved Scripps Poway Parkway Extension
project, as well as the Federal Endangered Species Act and California
Endangered Species Act penlitting requirements for said project.
FINDINGS
Pursuant to Section 4(d) of the Federal Endangered Species Act (ESA), the
Guidelines incorporate the "special rule" for the "threatened" California
gnatcatcher. The Guidelines provide that a habitat conservation plan, or NCCP
plan, must ulti~tely be prepared by local jurisdictions and/or landowners in
order to adequately protect and preserve the gnatcatcher and its coastal sage
scrub habitat.

The proposed Poway Subarea HCP is a comprehensive multi-species and multi-
habitat conservation planning tool that when implemented will sustain adequate
populations of sensitive plant species, wildlife species, and their habitats
within the Plan's Resource Conservation Area (see Attachment B).
The IA/MA is a binding agreement that will be signed by the USFWS, CDFG, and
the City. This agreement identifies the responsibilities and obligations of
the signatory parties regarding the implementation of the Plan.
In conjunction with Plan approval, the City of Poway/Poway Redevelopment
Agency will receive and administer long-term permits issued by the USFWS and
CDFG. These permits will allow the removal of habitat and the "incidental
take" of plant and wildlife species covered by the Plan and IA/MA, for public
and private development projects anticipated by the City's General Plan and
Redevelopment Plan, provided that such projects are in compliance with the
Poway Subarea HCP and companion IA/KA.
Proposed General Plan Amendment, GPA 95-02 would adopt the proposed Poway
Subarea HCP and companion IA/KA documents, and amend relevant elements of the
General Plan to incorporate by reference those documents. GPA 95-02 is one of
several actions that require approval 1n connection with the adoption of the
Plan and IA/KA. Other necessary actions include associated Zoning Ordinance
-- Amendment 95-01, associated Grading Ordinance Amendment, and associated Poway
Redevelopment Agency resolution of approval. The public hearing for GPA 95-02
and associated iteRS will be held on August IS, 1995.
T~ City Council resolution adopting GPA 95-02 will rescind two prior Council
resolutions which include 1.) Resolution No. 94-058, which established a
policy concerning reIOval of coastal sage scrub pursuant to the interi.
strategy of the NCCP Gu1delines, aad 2.) Resolution No. P-90-S9, which adopted
an interi. replac.-ent standard as .itigation for coastal sage scrub impacts,
and established a .itigation fund.
In order to incorporate by reference the Poway Subarea HCP and companion IA/MA
into the General Plan, the amendment will involve appropriate text changes,
including ~ification or addition of specific policies and implementation
strategies contained in relevant elements of the General Plan.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
INITIATING GENERAL PLAN AMENDMENT, GPA 95-02
WHEREAS, the City Council of the City of Poway recognizes that the need
may arise to amend the City's General Plan; and
WHEREAS, Section 65350, et seq., of the California Government Code
describes the procedures for amending General Plans; and
WHEREAS, Section I7.46.020B of the Poway Municipal Code (ZOfting
Ordinance) provides that a change in the boundaries of any zone or a change in
regulations may be initiated by resolution of the City Council; and
WHEREAS, the City of Poway/Poway Redevelopment Agency has prepared the
proposed City of Poway Subarea Habitat Conservation Plan (Poway Subarea HCP)
and companion Implementing Agreement/Management Authorization (IA/MA)
documents; and
WHEREAS, the subject proposed documents have been prepared to camply
with the requirements of the State Natural Communities Conservation Planning
(NCCP) Act of 1991, the NCCP Process and Conservation Guidelines (NCCP
Guidelines) approved in November, 1993 by the California Department of Fish
.- and Game, and U.S. Fish and Wildlife Service Section 4(d) Special Rule for the
California gnatcatcher, as incorporated in the approved NCCP Guidelines; and
WHEREAS, the subject proposed documents have also been prepared to
