SUBJECT: Update on Notice of Violation on property located at 14875 Mina de Oro Road,
David and Marilyn Gillispie, owners.
ABSTRACT
Update on Notice of Violation for failure to obtain a Conditional Use Permit for the
operation of a horse boarding facility; failure to remove a modular dwelling unit for
which the temporary use permit has expired; and failure to rectify the existing grading
violation on the property.

This action is not subject to CEQA review.
FISCAL IMPACT
None.
ADDITIONAL PUBLIC NOTIFICATION AND CORRESPONDENCE
None.
RECOMMENDATION
It is recommended that the City Council direct staff to file the notice of violation if
the Sullivan Stables have not been moved to the main stable area by August 4 or if
progress toward resolution of the violations stalls at any time before full resolution
of all violations has been reached.

SUBJECT: Update on Notice of Violation for: failure to obtain a Conditional
Use Permit for the operation of a horse boarding facility; failure to
remove a modular dwelling unit for which the temporary use permit
has expired; and failure to rectify the existing grading violation on
property located at 14875 Mina de Oro Road, David and Marilyn
Gillispie, owners.
BACKGROUND
On July 11 the City Council considered a recommendation from staff that a notice of
violation be placed on the Gillispie property for the above referenced violations which have
been on-going for several years, More recently, a horse rental business, operated by a
Mr, and Mrs. Sullivan, has been established on the southwestern portion of the lot in newly
erected structures for which no building permits have been issued. This new activity,
which has been the subject of complaints from neighbors, is located in an inappropriate
area which has inadequate facilities. Staff has contacted the Sullivan's and Mrs, Gilli;spie
about removing the facility. Mrs. Gillispie has indicated that the operation will be moved
up to the main stable area, included in the overall CUP application and the structures
removed
At the July 11 hearing, the City Council directed that the notice of violation be filed unless
the application for Conditional Use Permit, which was initiated in May 1994 was completed
within two weeks, On July 25, Mrs. Gillispie submitted much of the additional information.
An attorney, Jack Mitchell, has also contacted staff to discuss what is needed for Mrs.
Gillispie to finish the application.
FINDINGS
Because some progress has been made, staff has not filed the notice of violation. If the
Sullivan Stable operation has not been moved to the main stable area by August 4,
however, staff recommends that the notice of violation be filed. Likewise, if additional
violations occur, or if progress toward resolution of the existing violations stalls again, staff
recommends that the notice of violation be filed.
