Li nda Snvder. Aoolicant: A request for approval to perform additional grading on a residential lot located at 14652 Sunset Mountain Way within the Rural Residential B zone. APN: 278-280-32, 33 BACKGROUND On July 16, 1991 the City Council approved Conditional Use Permit 91-07 and Minor Development Review 91-19 on the subject property permitting the construction of a 6,000 square foot two story residence and a 1,264 square foot detached accessory apartment. The residence was completed in May 1993 and to date the accessory apartment has not been constructed. The applicant is requesting approval to conduct additional grading on the site to provide better access to the garage and more level area to site a swimming pool. The area that is to be graded will impact a visually prominent knoll. A condition of approval for CUP 91-07 and MDRA 91-19 required that future grading of the hillside portions of the subject lot be approved by the City Council. FINDINGS The 8.58 acre property is located on a prominent ridgeline east of Espola Road. The two-story residence is sited in a "saddle" between two knolls and is visible from some vantage points along Espola Road. In March 1995 the City issued the applicant a "Stop Work Notice" for grading work that was being undertaken on the ACTION: 2 of 9 J '"\ - - Agenda Report August 15, 1995 Page 2 site which required a grading permit. Approximately 3-4 feet of the upper portion of a knoll located southwest of the residence was graded. Engineering and Planning staff advised the applicant that a grading permit would be required to complete the work she desired and to perform the required remedial work on the site. The grading plan has been designed to reconstruct the top of the knoll which was disturbed, to push back an existing 14 foot high manufactured slope away from the house to allow the development of a wider driveway area near the garage, and to extend the rear yard terrace area out to provide more room to develop a pool. The project will result in the removal of approximately 4,000 square feet of coastal sage habitat. The applicant proposes to mitigate the removed coastal sage through dedication of an open space easement over a portion of the site containing coastal sage scrub. The area that is to be dedicated as open space is adjacent to land designated as open space and which also contains coastal sage habitat (See Attachment D). The proposed grading is consistent with the goals and strategies listed in the General Plan for hillside development and is consistent with the standards listed in the Grading Ordinance. Staff therefore recommends approval. ENVIRONMENTAL REVIEW This project is not subject to the California Environmental Quality Act in that it is grading associated with the development of accessory structures including a swimming pool and the widening a driveway. P- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING MINOR DEVELOPMENT 95-22 (HILLSIDE/RIDGELINE) ASSESSOR'S PARCEL NUMBERS 278-280-32, 33 WHEREAS, Minor Development Review 95-22 (Hillside/Ridgeline), submitted by Linda Snyder, applicant, requests approval to perform additional grading on a residential lot located at 14652 Sunset Mountain Way within the Rural Residential B zone; and WHEREAS, on August 15, 1995 the City Council held a duly advertised public hearing to solicit comments from the public, both pro and con, relative to this application. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: Environmental Findinas: Minor Development Review 95-22 (Hillside/Ridgeline) is not subject to the California Environmental Quality Act, in that it is Categorically Exempt Class 3, as the project is gradi ng associ ated with the development of accessory structures including a swimming pool and the widening of a driveway. By local ordinance, the areas disturbed in the grading process which contain Coastal Sage Scrub plant community are to mitigated through the on-s i te dedication of equal or better Quality habitat, at a 1:1 ratio. Section 2: Findinas: 1. The proposed project is consistent with the general plan in that it proposes the additional grading which will allow the development of a accessory structures on a site which is designated for residential use. 2. That the proposed development will not have an adverse aesthetic, health, safety or architecturally related impact upon adjoining properties, in that the grading has been designed to appear natural and minimize visible impacts. A planting plan will provide for full revegetation of all visible slopes. 3. That the proposed development is in compliance with the Zoning and Grading Ordinance, in that it complies with the property development standards of the RR-B zone. 4. That the proposed development encourages the orderly and harmonious appearance of structures and property within the City, in that the surrounding properties consist of large rural residential lots with widely spaced hillside homesites. Section 3: Citv Council Decision: The City Counc il hereby approves Minor Development Review 95-22 (Hillside/Ridgeline) subject to the following conditions: AUG 1 5 1995 ITEM 12 . 4 of 9 - - - Resolution No. P- Page 2 Within 30 days of approval the applicant shall submi tin writ i ng that all conditions of approval have been read and understood. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF PLANNING SERVICES. SITE DEVELOPMENT 1. Site shall be developed in accordance with the approved grading plans on file in the Planning Services Department and the conditions contained herein. 2. Revised grading plans incorporating all conditions of approval shall be submitted to the Planning Services Department prior to issuance of grading permit. 3. Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other applicable City Ordinances in effect at the time of grading permit issuance. 4. The westerly and southerly side of the knoll that is to be reconstructed during the grading project shall be hydroseeded with a coastal sage scrub hydroseed mix to hasten revegetation. If the hydroseeding is not done during the rainy season, temporary irrigation shall be provided to ensure germination. This shall be accomplished prior to grading certification or March 1, 1996 whichever is first. 5. The grading of the site, specifically the City required reconstruction of the knoll, shall be completed prior to February 1, 1996. 6. Approximately 4,000 square feet of coastal sage scrub will be removed with the project. The applicant shall mitigate the removed coastal sage scrub at a minimum 1:1 ratio prior to grading permit issuance. The mitigation can be accomplished through approved on-site open space dedication to the City of Poway, payment of a mitigation in-lieu fee or approved off-site open space dedication of coastal sage habitat to the City of Poway. 7. Grading and clearing operations within areas containing coastal sage scrub shall not occur between the months of February and August because that is the nesting season of the California Gnatcatcher. 8. Future grading of the hillside portions of the subject lot shall be prohibited unless approved by the City Council. COMPLIANCE WITH THE FOllOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF ENGINEERING SERVICES. 1. A grading plan for the development of the property shall be submitted to the City's Engineering Services Department for review and approval prior to issuance of the grading permit and start of grading operation.
