ENVIRONMENTAL REVIEW - The previously certified Final Environmental Impact Report (EIR) and Final Subsequent EIR for the South Poway Specific Plan adequately addresses the potential environmental impacts of the proposed development. FISCAL IMPACT The sales of earthmoving equipment will generate sales tax to the City. ADDITIONAL PUBLIC NOTIFICATION AND CORRESPONDENCE Notice of this hearing was published in the Poway News Chieftain and mailed to 16 property owners within 500 feet of the project site. RECOMMENDATION It is recommended that the City Council approve Development Review 95-10 subject to the conditions in the attached resolution. APN: 317-280-36 BACKGROUND This application is for the construction of a 15,390 square foot sales and service facility for earthmoving equipment. The proposed site is located at the S. E. corner of Danielson Street and Parkway Centre Drive within the Light Industrial land use designation of the South Poway Specific Plan. ROO Equipment Company (formerly Whitney Machinery) plans to relocate from Miramar Road in San Diego to this new location. Sales of new equipment only is planned from this site. Sales of any used equipment would occur at their Riverside, California facil ity. Headquarters of RDO Equipment Company is in Fargo, North Dakota. All building masonry surfaces and retaining walls on-site are to be constructed of tan split-face block. The roofing will be standing seam metal in a saddle tan color with burnished slate top and bottom trim at the fascia. The hollow metal doors and roll up doors will also be in the saddle tan color. Two raised display pads for construction equipment are shown at the intersection of Daniel son Street and Parkway Centre Drive and just west of the driveway entrance near the northeast corner of the site. Wrought iron fencing of eight feet in height was proposed for the west frontage and to the east and west of the parts and sales building. Chain link fencing was ACTION: 2 of 15 UG 2 2 1995 - - .--. Agenda Report August 22, 1995 Page 2 proposed for the south property frontage along Scripps Poway Parkway and along the east property line. Wrought iron fencing is recommended along the Scripps Poway Parkway frontage to enhance the appearance from that side. The existing berm in that vicinity will be 9raded to a 2:1 slope. Vinyl-coated chain link fencing of eight feet in height is allowable with landscaping in the side yard area along the east property line. Staff has met with the applicants and their representatives over the past several months to discuss details of their proposal in order to expedite construction of the facility by January 31, 1996. They have submitted the building and grading plans for checking and expect to break ground by late August or early September 1995 to meet a five month construction schedule. FINDINGS The proposed construction equipment sales and service facility is a permitted use within the South poway Specific Plan. Approval is recommended with the findings and conditions of the attached resolution. P- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING DEVELOPMENT REVIEW 95-10 ASSESSOR'S PARCEL NUMBER 317-280-36 WHEREAS, Development Review 95-10, was submit ted by ROO Equipment applicant, for approval of the construction of a 15,390 square foot sales and service facility for an earthmoving equipment dealer located at the southeast corner of Danielson Street and Parkway Centre Drive in the Light Industrial land use designation of the South Poway Specific Plan. WHEREAS, the City Council of the City of Poway has read and considered said report and has considered other evidence presented at the public hearing. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: Environmental Findinas: The previously certified Final Environmental Impact Report (EIR) and Final Subsequent EIR for the South Poway Specific Plan adequately addresses the potential environmental impacts of the proposed development. Section 2: Findinas: 1. The approved project is consistent with the South Poway Specific Plan and the general plan in that an earthmoving equipment sales and service facility is a permitted land use within the Light Industrial land use designation. 2. That the approved project wi 11 not have an adverse aesthetic, health, safety, or architecturally related impact upon adjoining properties in that the design of the building for the intended purpose conforms to the criteri a of the South Poway Development Standards and will be compatible with current and future buildings in the vicinity. 3. That the approved project encourages the orderly and harmonious appearance of structures and property within the City in that the architecture incorporates features provided for in the South Poway Development Standards. Section 3: Citv Council Decision: The City Council hereby approves Development Review 95-10, subject to the following conditions: Within 30 days of approval (1) the applicant shall submit in writing that all conditions of approval have been read and understood; and (2) the property owner shall execute a Covenant on Real Property. 4 of 15 ATTACHMENT A AUG 2 2 1995 ITEM 9 ". - - ... Resolution No. P- Page 2 COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF PLANNING SERVICES. SITE DEVELOPMENT 1. Site shall be developed in accordance with the approved site plans on file in the Planning Services Department and the conditions contained herein. 2. Revised site plans and building elevations incorporating all conditions of approval shall be submitted to the Planning Services Department prior to issuance of building permits. 3. Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other applicable City Ordinances in effect at the time of building permit issuance. 4. Trash receptacle shall be enclosed by a six foot high masonry wall with view-obstructing gates pursuant to City standards. Location shall be subject to approval by the Planning Services Department. 5. All roof appurtenances, including air conditioners, shall be architecturally integrated, screened from vi ew and sound buffered from adjacent properties and streets as required by the Planning Services ," Department and the revised equipment screening provisions of the South Poway Development Standards. 6. The applicant shall comply with the latest adopted Uniform Building Code, Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code, Uniform Fire Code, and all other applicable codes and ordinances in effect at the time of building permit issuance. 7. Wrought iron fencing is to be installed along the Parkway Centre Drive and Scripps Poway Parkway frontages. Vinyl-coated chain link fencing (in a color compatible with the wrought iron fencing) is to be installed along the east property line. 8. For a new commercial or industrial development,'or addition to an existing development, the applicant shall pay development fees at the established rate. Such fees may include, but not be limited to: Permi t and Pl an Checking Fees, School Fees, Water and Sewer Service Fees. 9. Future expansion of the facil ity will require a modification to this development review approval. 10. All proposed utilities within the project shall be installed underground. 11. Bay doors facing Parkway Centre Drive shall be adequately screened by landscaping within one year or kept closed sufficiently to screen views - from passersby. 12. This approval shall become null and void if building permits are not issued for this project within two years from the date of proj ect approval. PARKING AND VEHICULAR ACCESS 1. All parking lot landscaping shall include a minimum of one 15 gallon size tree for every three spaces. For parking lot islands, a minimum 12 inch wide walk adjacent to parking stalls shall be provided and be separated from vehicular areas by a six inch high, six inch wide portland concrete cement curb. 2. Parking lot lights shall be shielded low pressure sodium directed downward, and have zero cutoff. Parking lot illumination shall achieve a uniformity ratio of 3 to 1 (average to minimum) and a maintained average of one foot candle and a minimum of 0.3 foot candle. 3. Parking lot fixtures shall be pole mounted, 25 feet maximum height, above finished grade of the parking surface. 4. All parking spaces shall be double striped. 5. The parking layout shall comply with the Americans with Disabilities Act (ADA) , 1.e. 1:25 ratio for accessible spaces with at least one van accessible space designated. LANDSCAPE IMPROVEMENTS 1. Complete 1 andscape construct ion documents shall be submitted to and approved by the Planning Services Department prior to the issuance of building permits. Plans shall be prepared in accordance with City of Poway Guide to Landscape Requirements (latest edition). 2. Street trees, a minimum of 15 gallon size or larger, shall be installed in accordance with the City of Poway Guide to Landscape Requirements and sha 11 be planted at an average of 30 feet on center spacing along all streets. 3. Landscaped areas within the adjacent publ ic right-of-way, as well as private street easements, shall be permanently and fully maintained by the owner. 4. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debri s. The trees shall be encouraged and allowed to reta i n a natural form. Pruning should be restricted to maintain the health of the trees and to protect the public safety. Unnatural or excessive pruning, including topping, is not permitted. 6 of 15 AUG 2 2 1995 ITEM 9 ~ - - - Resolution No. P- Page 4 SIGNS Any signs proposed for this development shall be designed and approved in conformance with the Sign Ordinance. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF ENGINEERING SERVICES. SITE DEVELOPMENT 1. A grading plan for the development of the property shall be submitted to the City's Engineering Services Department for review and approval prior to issuance of a grading permit and start of grading operation. Rough grading of the site must be completed and shall meet the City's Engineering Services inspector's approval prior to issuance of a building permit. 2. A ri ght-of-way permi t shall be obtained from the City's Engineering Services Department for any work to be done within the publ ic street right-of-way or any City-held easement. Said work shall include, but is not to be limited to, construction of driveway approach, sewer lateral installation, water service line installation, street construction (including concrete curb, gutter, and sidewalk). Permit shall be obtained prior to start of work. 3. Please contact Engineering Services for payment of water, drainage, and sewer prior to building permit issuance. a. Water fees given are based on a 2" meter. Fees will vary based on the size of the meter. 2" meter $695.00 Expansion fee $2,400.00 San Diego County Water Authority fee $7,348.00* (*This fee may go up soon.) b. Appropriate sewer fees, if any, will be collected prior to final occupancy of the building. 4. Provisions must be made for industrial waste coming from the use of the site. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF SAFETY SERVICES. 1. Roof covering shall be fire retardant as per UBC Section 3203(e) and City of Poway Ordinance No. 64. 7 of 15 ~UG 2 2 1995 ITEM 9 " Resolution No. P- Page 5 2. The buildings shall display their numeric address in a manner visible from the access street. Minimum size of the building numbers shall be sixteen inches on the front facade of the building. Building address shall also be displayed on the roof in a manner satisfactory to the Director of Safety Services, and meeting Sheriff's Dept. - ASTREA criteria. 3. The building owner will be required to install an approved fire sprinkler system, meeting P.M.C. requirements. The entire system is to be monitored by a central monitoring company. System post indicator valves with tamper switches, also monitored, are to be located by the City Fire Marshal prior to installation. 4. A 'Knox' Security Key Box shall be required for the building at a location determined by the City Fire Marshal. A 'Knox' padlock shall be required for the fire sprinkler system Post Indicator Valve. 5. Fi re Department access for use of fi re fighting equipment shall be provided to the inunediate job construction site at the start of construction and maintained at all times until construction is completed. 6. Permanent access roadways for fire apparatus shall be designated as 'Fire Lanes' with appropriate signs and curb markings. 7. A minimum 2A:I0BC fire extinguisher is required for every 3,000 square feet and 75 feet of travel distance. 8. Material Safety Data Sheets shall be required for all hazardous and/or toxic substances used in each building. 9. An Emergency Contingency Plan and Hazardous Materials Disclosure shall be fil ed wi th the County of San Di ego Department of Health and copies provided to the Fire Department. 10. Prior to delivery of combustible building material on site, water and sewer systems shall satisfactorily pass all required tests and be connected to the public water and sewer systems. In addition, the first lift of asphalt paving shall be in place to provide adequate, permanent access for emergency vehicles. The final lift of asphalt shall not be installed until all other construction activity has been substantially completed to the satisfaction of the City. 11. N.F.P.A. Standard 704, Hazardous Materials Labeling, shall be provided as necessary throughout the bUilding. 12. All openings between Shop and B-2 (Sales and Parts) shall be fire rated. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF PUBLIC SERVICES. 1. APN: 317-280-36 BACKGROUND Staff has discussed the conditions of approval with the appl icant and agreed that some modifications were appropriate as outlined in the attached resolution and the letter from SNR Construction. FINDINGS In order to meet the construction schedule of the applicant, staff allowed processing of the site and building plans without revisions to refl ect conformance with the South Poway Development Standards. Some revised conditions were generated after plan checking the site plan and grading plan. In addition, the applicant has concerns about some of the conditions that have been reviewed by staff with revisions made to the resolution of approval. This project will also be the first one to use the variable bUilding/parking lot setback based on building height as approved by the City Council in June 1995. The parking lot/building setback along Parkway Centre Drive is allowed to be 20 feet rather than 25 feet based on a 16 foot building height for the office building, the nearest portion of the building. RECOMMENDATION It is recommended that the City Council approve Development Review 95-10 subject to the conditions in the attached resolution. A 'Knox' Security Key Box shall be required for the building at a location determined by the City Fire Marshal. Dear Mr. Streeter, As we discussed, our client, ROO Equipment Co. has objected to the following items ,~ferenced in the council resolutions which you sent to me on August 8,1995, The basis for their objection is due to the cost associated with meeting the conditions. We offer the following, SITE DEVj;LOPMENT . We have discussed my concern over item #4 relating to the trash enclosure. Our plans do not indicate a separate trash enclosure as it was our intent to store the trash receptacle in the loading dock area which would be screened from Danielson by a proposed 14' tall masonry wall. We request that the reference to a trash enclosure with view obstructing gates be removed from the list of conditions. If the Parts Warehouse were to be expanded into the loading dock area at a future date, a separate trash enclosure would be constructed per the city standards. Item #7 indicates a requirement for wrought iron fence along the Scripps Poway Parkway frontage. Our plans had shown an 8' high vinyl coated chain link fence at thi,s area. It is our intent to install the fencing at the bottom of the slope as shO'Nl'l on our site plan rather than at the top. Because the slope is in excess of 10' high, it is our contention that the fence won't really be visible from Scripps poway Parkway. We also intend to plant vines at the fence line and train them to grow on the fence. For these reasons, we feel that we are justified in not spending the additional money to install wrought iron fencing at this area when will not be visible from the street. . t . As we have discussed, the planting areas as designed do not allow for the planting of fifteen (15) new trees. Our preliminary landscepe plan shows only seven (7) new trees. As a result of the . meeting between yourself, Gary Hoyt and I on Friday of last week, we are revising our . . landscape plan to increase the planting areas by creating paninsula type planters replacing a few proposed pa~ing spaces and we will increase slightly the number of trees. I was concerned that if this item were to remain on the list of conditions, we would be stuck installing (15) trees once the City Council approves them. Maybe the wording can be revised to reflect "aggregating" the tree quantity into additional planter spaces. ~NDSCAPEIMPROVEMENTS Item #2 refers to street trees which I think in this case does not relate to this project as the frontages along Danielson and Parkway Centre have already been planted during the initial development stage. The frontage along Scripps Powey Parkway is not planted. but responsibility for landscaping this area is an issue I need to take up with Public Services. In any event the original planting scheme for the south slopa indicates trees to be planted in excess of the 30' spacing referenced in the conditions. SAFETY SERVICES CONDITIONS Item #6 refers to permanent access roadways for fire apparatus and "fire lanes". Initially, Garry MacPherson had talked about requiring a paved fire lane around the building. Due to the weight of the apparatus, this would have resulted in 'paving a 20' wide x approximately 500' long fire lane around the building. The cost associated with meeting this condition would have exceeded $25,000. Garry and I discussed this issue at length and he agreed that in light of the heavy density of fire sprinklers heads required and the ability to reach all parts of the building with fire hoses from the proposed parking area and drive approaches, the fire lane would not be needed: He did require that the curbs at the entries be painted red and signs posted stating "NO PARKING - FIRE LANE". The above represents the conditions to the City Council Resolutions with which we take exception. As alluded to above, we have some concern over the cost associated with . landscaping the south slope along Scripps Poway Parkway as we feel that this area should have been improved during the Parkway Business Center's early development stages and not passed on to the new property owner. We are pursuing a final judgment from Public Services and will incorporate that final decision into our landscape & irrigation submittal if needed.
