ABSTRACI'
At their July 11, 1995 meeting, the Redevelopment Agency approved the developer
selection process for the Bowron Road and Brookview sites as recommended by the
Redevelopment and Hous ing Advi sory Committee. The question of how the Agency Board
members could, if desired, directly participate in this process was deferred to allow an
analysis of what impact this participation would have relative to the requirements of
the Brown Act. The City Attorney has advised that a developer selection subcommittee
may be subject to the requirements of the Brown Act if the Agency members are appointed
- by formal action.

This item is not subject to CEQA review.
FISCAL IMPACI'
There is no fiscal impact resulting from this action.
ADDITIONAL PUBLIC NOTIFICATION AND CORRESPONDENCE

RECOMMENDATION
It is recommended that the Redevelopment Agency Board review the findings of this report
and, if deemed appropriate, identify up to two Board members to participate directly in
the developer selection process.

SUBJECT: Discussion Regarding Agency Board Member Participation in Developer
Selection Process for Affordable Housing Sites
BACKGROUND
At thei r July 11, 1995 meeting, the Redevelopment Agency approved the process for
selecting developers for the Bowron Road and Brookview affordable housing sites, as
recommended by the Redevelopment and Housing Advisory Committee (RDHAC). This process
involves the creation of a review panel to oversee developer selection and to
ultimately make a recommendation to the Redevelopment Agency for final approval. The
Review Panel would be comprised of 2 - 3 members from the Redevelopment and Housing
Advisory Committee, the Agency's affordable housing consultant, David Rosen, and Agency
staff. The July 11, 1995 staff report put forth an option that, if deemed appropriate,
the Redevelopment Agency identify up to 2 of its members to serve on the developer
selection review panel. This decision was deferred until staff could analyze the
impact that Agency Board member participation would have relative to the Brown Act.
FINDINGS
The City Attorney reviewed this matter and has advised that under the Brown Act, the
forma 1 appointment of a subcommittee would subject said subcommittee to the
requirements of the Brown Act. As an alternative, a review panel could be composed of
less than a quorum from the RDHAC and Redevelopment Agency, with members designated by
the chairperson of each entity. The review panel would not be subject to the
requirements of the Brown Act under this arrangement.
Therefore, if there are two Agency Board members wi shi ng to volunteer, staff is
prepared to initiate the developer selection process. In the event that there are more
that 2 Agency members interested in volunteering, then the Chairman would need to
select the 2 members to serve. Again, this direct participation is optional, as the

final decision regarding developer selection will be brought before the full Agency
Board for final approval.
