Res 02-102RESOLUTION NO. 02-102 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA AUTHORIZING THE OPEN MARKET PROCEDURE TO COMPLETE THE FIRE STATION #1 KITCHEN REMODEL PROJECT AND RESCINDING RESOLUTION NO. 02-099 WHEREAS, the City implemented a formal bidding procedure for the Fire Station #1 Kitchen Remodel Project pursuant to Section 3.28.070 of the Poway Municipal Code and received one bid which exceeded the Preliminary Architect's Estimate by 200%; and WHEREAS, it is determined to be in the City's best interest to reject the bid; and WHEREAS, Section 3.28.080 of the Poway Municipal Code provides that purchase of supplies, services and equipment may be made in the open market when the City Council has rejected all bids pursuant to Public Contract Code Section 20167; and WHEREAS, Section 20167 or the Public Contract Code provides that, after rejecting bids, the legislative body may pass a resolution by a four-fifths vote of its members declaring that the project can be performed more economically by day labor, or the materials or supplies furnished at a lower price in the open market; and WHEREAS, the City determines that the open market procedure will be most advantageous because it will provide a competitive process to complete the project, avoid further delays, and should result in an overall project cost that is considerably lower than the proposed bid amount. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as follows: Section 1. Resolution 02-099 is hereby rescinded. Section 2. The City Council of the City of Poway authorizes the Open Market Procedure to complete the Fire Station #1 Kitchen Remodel Project. The City Manager is hereby authorized and empowered to execute in the name of the City of Poway all necessary contracts to implement the project pursuant to Section 3.28.080 of the Poway Municipal Code Resolution No. 02-102 Page 2 PASSED, ADOPTED, and APPROVED by the City Council of the City of Poway, California, at a regular meeting this 3rd day of September 2002.
