This project is cate90rically exempt from the California Environmental Quality Act
under Class 4e and Class 11(c).

A courtesy notice was sent by the applicant on or before September 5, 1995 to adjacent
businesses and land owners within the project area.
RECOMMENDATION
It is recommended that the City Council approve Temporary Use Permit 95-69 subject to
the conditions contained in the attached resolution.

Aoolicant: A request to allow a six month extension for the
temporary stationing of three tow trucks to be parked and
dispatched from the back parking lot of the Shell Service
Station located at 12365 Poway Road.
BACKGROUND
Ali Ganji of Guardian Towing is requesting approval of a six month extension
of the prior Temporary Use Permit that would allow for the temporary
stationing of three tow service vehicles (flat bed truck, wheel lift truck,
and service unit) to be parked and dispatched from the back parking lot of the
Shell service station. Approval of the Temporary Use Permit for six months is
reconvnended.
FINDINGS
Guardian Towing began handling the Automobile Club of Southern California
towing contract for poway and Penasquitos areas as of December 30, 1994. The
trucks will be dispatched from the Shell station until a permanent location
can be found that would allow a tow storage yard for inoperable and wrecked
vehicles as well as light auto repair.
This request involves the parking of the service vehicles only. No wrecked or
inoperative vehicles will be stored or parked on the Regent's Shell station
property. Guardian Towing currently transports its wrecked and inoperative
vehicles to a storage yard located at 7990 Miramar Road.

Guardian Towing will not conduct any maintenance or repair services at the
Poway Road location which would require an inoperative vehicle to remain over
night. There will be no oil or any other hazardous material spillage from
Guardian Towing's vehicles.
The tow vehicles will be parked according to the attached site plan which
calls for the two tow trucks to be parked in the southwest corner of the lot
and the service vehicle to be parked in the northwest corner of the lot.
Guardian Towing will operate a phone from the service station site from which
it will receive dispatch calls. A minimum of three employees will be employed
at the Poway site.
Since approval of the first TUP in March 1995, Mr. Ganji has b~en looking for
a permanent tow yard site. He is aware of the June 1995 City Council action
to designate outside storage lots in the South Poway Business Park and has
been provided with the exhibit showing those lots.
A vacant building within the Stowe Business Park is of interest to him for
light auto repair and storage of towed, but not wrecked, vehicles. A letter
will be sent soon to staff asking for guidance on a City Council
interpretation or Specific Plan Amendment to allow both uses at the Stowe
Business Park building. It was previously occupied by a car repossession
- business. If this proposed location or another within the business park were
to work out for Mr. Ganji, he intends to continue transporting wrecked
vehicles to a tow storage lot in the Miramar area.
ENVIRONMENTAL REVIEW
This project is categorically exempt from the California Environmental Quality
Act under Classes 4e and 11(c). The event will be a temporary use of land
having negligible or no permanent effects on the environment.
FISCAL IMPACT
None.

RESOLUTION NO. P-
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING TEMPORARY USE PERMIT 95-69
WHEREAS, Temporary Use Permit 95-69, Ali Ganji, Guardian Towing,
applicant, requests approval to allow the temporary stationing of three tow
trucks to be parked and dispatched from the back parking lot of the Shell
station located at 12365 Poway Road.
WHEREAS, on September 19, 1995 the City Council considered the above-
referenced item.
NOW, THEREFORE, the City Council does hereby resolve as follows:
Section 1: Environmental Findinas:
Pursuant to the procedures of the City of Poway, implementing the
California Environmental Quality Act of 1970, the above-referenced
project is categorically exempt, Classes 4e and 11(c).
Section 2: Findinas:
That the proposed use is in accordance with the purposes and standards
of Section 17.26.030 of the Poway Municipal Code.
Section 3: City Council Decision:
The City Council hereby approves Temporary Use Permit 95-69 subject to
the following conditions:
APPLICANT SHALL CONTACT THE DEPARTMENT OF PLANNING SERVICES REGARDING
COMPLIANCE WITH THE FOLLOWING CONDITIONS:
1. Site shall be developed in accordance with the approved site plans on
file in the Planning Services Department and the conditions contained
herein.
2. Approval of this request shall not excuse compliance with all other
sections of the Zoning Ordinance and all other applicable City
ordinances presently in effect.
3. No wrecked or inoperative vehicles shall be parked on the site with the
tow vehicles. No minor maintenance or repair services shall be
performed on the site which might result in the spillage of oil or other
hazardous materials.
4. This approval shall become null and void on March 19, 1996. If
additional time is desired, a new Temporary Use Permit must be obtained
with the application made at least 45 days prior to the expiration date.

APPLICANT SHALL CONTACT THE DEPARTMENT OF SAFETY SERVICES REGARDING COMPLIANCE
WITH THE FOLLOWING CONDITIONS:
1. Do not block emergency vehicle access to this site.
