to the San Diego County Water Authority
ABSTRACf
Each of the member agencies of the San Diego County Water Authority (SDCWA) is entitled
to be represented on the Board of Directors. The General Counsel for SDCWA has
determined that the representative may be any individual appointed by a member agency
. except for an elected City Council member. Elected Water District board members may be
representatives to SDCWA. Since incorporation, the City of Poway has been represented
by either a public member or City staff member. Linda Brannon, who has been the City's
representative, resigned on September 7, 1995. (Exhibit A)
James R. Williams, Director of Public Services, has been attending meetings of the
Authority for two years and participated in a number of committees involving Authority
staff. With his background as the manager of the Poway water system, Mr. Williams
- would be an excellent representative for the City.

ADDITIONAL PUBLIC NOTIFICATION AND CORRESPONDENCE

RECOMMENDATION
It is recommended that the City Council approve the attached resolution
(Exhibit B) appointing James R. Williams as the City of Poway's representative
to the San Diego County Water Authority.

BACKGROUND
Each of the member agencies of the San Diego County Water Authority (SDCWA) is

board members may be representatives to SDCWA. Since incorporation, the City of

FINDINGS
Inasmuch as City Council members are specifically precluded from being appointed
as a Director representing the City of Poway, the options are a staff member or a
representative from the public. At this time, in order to ensure continuity, it
would be advantageous to appoint a representative who is familiar with the issues
being addressed by the Water Authority. James R. Williams, Director of Public
Services, has been attending meetings of the Authority for two years and
participated in a number of committees involving Authority staff. With hi s
background as the manager of the Poway water system, Mr. Williams would be an
excellent representative for the City.

Dear Mayor Higginson:
It is necessary for me to resign my position as Poway's Director to the San
Diego County Water Authority. My resignation is effective immediately.
I am submitting this resignation with great regret. because I have so enjoyed
the opportunity to represent Poway. It is an outstanding Board that is
motivated to serve unselfishly for the benefit of all San Diegians. I feel
privileged to have been part of it.
For over four years I have served with dedication to do the very best job for
Poway. While on the Board, I served as Chair of the Fiscal Policy Committee
and I currently serve as Chair of the Water Policy Committee.
Water is a very exciting and challenging issue for Califomia. It is of critical
importance to San Diego County due to the fact that 90% of our water is
imported. 1 will be happy to assist in any way I can to help with the
selection and transition for Poway's new Director.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPOINTING JAMES R. WILLIAMS AS ITS REPRESENTATIVE
TO THE BOARD OF DIRECTORS OF
SAN DIEGO COUNTY WATER AUTHORITY
AND RESCINDING RESOLUTION NO. 90-228
WHEREAS, Don Higginson, the Mayor of the City of Poway, has designated
and appointed James R. Williams to serve as the representative on the Board of
Directors of the San Diego County Water Authority; and
WHEREAS, this City Council desires to consent to approve said
designation and appointment.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway
as follows:
Sect i on 1. that the designation and appointment of James R. Williams as
representative to the Board of Directors of the San Diego
County Water Authority is hereby consented to and approved;
- Section 2. that Resolution No. 90-228 is hereby rescinded.
PASSED, ADOPTED AND APPROVED, by the City of Poway, California, at a regular
meeting thereof this 10th day of October, 1995.

VERY CHALLENGING TASK. WE LEARNED ABOUT THE AREA AND CAME TO A
DECISION THAT STAYING IN THE POW A Y AREA AND HAVING OUR
OPERATION CLOSE BY IS THE BEST SOLUTION FOR US.
WE WERE ABLE TO FIND A LOCATION THAT WILL SUIT OUR NEEDS, AND WAS
PREVIOUSLY USED FOR AUTOMOTIVE STORAGE. THIS PLACE IS LOCATED AT
12300 STOWE RD. SUITE A POW A Y, CA 92064 IN THE STOWE
BUSINESS PARK.

APPROVAL TO USE THIS LOCATION FOR LIGHT AUTOMOTIVE REPAIR, NOT
HEAVY MAINTENANCE OF VEHICLES.
THERE WOULD NOT BE ANY ENGINE OVERHAUL, TRANSMISSION
REBUILDING OR BODY WORK. LIGHT REPAIRS ARE MAINLY ALTERNATORS,
STARTERS, BATTERY, BELTS, LIGHT ELECTRICAL, TIRE, AND MINOR
TUNE UPS.
WE WILL PROVIDE OIL DRIP PANS FOR ALL STORED VEHICLES IN OUR
LOCATION. THERE WOULD NOT BE ANY OUTSIDE STORAGE OF CARS.

AGREEMENT OF UNDERSTANDING
City Council for the City of Poway, hereinafter referred to as 'City' and
("~\A~(J~a", \()...~~i'hereinafter referred to as 'Proponent' enter into this
Agreement of Understanding based upon the following facts:
Proponent owns or has an equitable interest in land described by tax Assessor's Parcel
Number(s) . Proponent desires to develop this
property in accordance with the will of the City and without the expense of a protracted
development.
City is concerned that Proponent will create development plans unsatisfactory to City
and consume time and effort of City employees needlessly on unsatisfactory development
plans unless City assists in directing Proponent.
Based upon the above-mentioned facts, City will grant Proponent a hearing prior to
filing any application for development upon the following understanding:
a. City will render no decision with regards to any development proposal or part
thereof.
b. City will receive no evidence, specific in nature, in support of a particular
development plan.
c. City will make no representations that will obligate the City to render a decision
in favor of or against any development proposal or part thereof Proponent may
subsequently submit.
d. If any development proposal is subsequently submitted, Proponent will proceed
at its sole and exclusive risk with the understanding that City has made no
representations upon which Proponent may rei .
