SUBJEcr: Authorization for Acquisition of Abutter's Rights of Access
- Stephen and Marjorie King, APN 324-010-70 - Scripps Poway
Parkway East
BACKGROUND
The Scripps Poway Parkway East project is nearing start of construction. City
staff and our Expropriation Consultant, JANMAC, Inc., have been negotiating
with property owners along the Parkway for rights of way, easements, and
mitigation lands necessary for the construction of the Parkway. Most parcels
. have been acquired.
Some of the land required is in the County of San Diego. The County Board of
Supervisors on January 10, 1995, granted Poway, as the lead agency on this
project, the right to acquire rights of way and easements within their
jurisdiction for the Scripps Poway Parkway. Caltrans has further authorized
the City of Poway to act as their agent in acquiring State rights of way.
Rio Maria Road passes through a portion of APN 324-010-70 and intersects
Highway 67. With an earlier Parcel Map, the Kings relinquished their rights of
access to Highway 67 outside of Rio Maria Road. Caltrans has required that,
when Rio Maria Road is realigned to its new intersection with the Parkway, the
Kings relinquish their remaining rights of direct access to Highway 67 and
utilize the new Rio Maria Road.

Alan M. Wilson has prepared an independent appraisal of the value of the
taking and the impacts associated with the Parkway. Based on this appraisal
and discussions with the owners, staff and JANMAC, Inc., we have negotiated a
fair price for this taking.
Benefit Resolutions No. 94-071 and No. R-94-12 for this project were certified
by the City Council/Redevelopment Agency on June 8, 1994.
FINDINGS
Acquisition of these rights of access are necessary for the construction of
Scripps Poway Parkway East. The construction of the realigned Rio Maria Road
and a new access driveway provides equal or better access for the parcel.
The agreed-upon price is representative of the current market value of the
property.
FISCAL IMPACf
Funds for this project have been budgeted with the overall improvement program
for Scripps 'Poway Parkway East.
ENVIRONMENTAL REVIEW

RECOMMENDATION
It is recommended that the City Council/Redevelopment Agency approve the
