A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA,
AUTHORIZING THE REMOVAL OF THE POWAY OAK TREE, AND DESIGNATING
HERITAGE TREES IN THE CITY OF POWAY
WHEREAS, on April 4, 2000, the City Council adopted Ordinance No. 521, an
Urban Forestry Ordinance, which sets forth policies, regulations, and generally
accepted standards necessary for the planting, trimming and removal of trees; and
WHEREAS, the Urban Forestry Ordinance further establishes policies relating to
the protection of native trees and Heritage Trees in the City of Poway; and
WHEREAS, Section 12.32.040 of the Poway Municipal Code defines a Heritage
Tree as any mature tree or mature stand of trees designated by the City Council as
having historic or cultural significance; and
WHEREAS, pursuant to Poway Municipal Code Section 12.32.190, the City Council
appointed a Tree Committee on October 17, 2000; and
WHEREAS, the Poway Tree Committee shall identify Heritage Trees in the City
of Poway for recommendation to the City Council; and
WHEREAS, the Poway Tree Committee developed criteria to identify Heritage
Trees and established and implemented procedures for selecting those trees to be
recommended to the City Council for designation as Heritage Trees in the City of
Poway.
WHEREAS, the Poway City Council adopted Resolution No. 01-098 on October
30, 2001 which designated the Poway Oak Tree a Heritage'Tree in the City of Poway;
and
WHEREAS, the Poway Tree Committee voted on June 13, 2002 to recommend
that the Poway Oak Tree, found to be in an advanced stage of decay and a public
safety hazard, be removed.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway
as follows:
Section 1. The removal of the Poway Oak Tree is hereby authorized.
Section 2. The trees listed and attached hereto as Exhibit A shall be designated
Heritage Trees in the City of Poway.

Section 3. Once placed on the Heritage Tree list, said trees shall not be
relocated or removed by any other authority or without the approval of the Poway
City Council.
PASSED, ADOPTED AND APPROVED by the City Council of the City of Poway
at a regular meeting this 22"d day of October 2002.

1. Poway Oak Grove (located on public property on open space parcel on east side
of Espola Road)
