It would be an excessive financial burden to require them to construct a public water main to service the property. Staff recommends that City Council approve their request for a temporary water connection. - ENVIRONMENTAL REVIEW This action is not subject to C.E.Q.A. review. FISCAL IMPACf None. RECOMMENDATION It is recommended that the City Council grant this request for a temporary water connection to serve Assessor's Parcel No. 314-350-30, subject to the conditions listed in the report. Tano, Assistant Civil Engine r I DATE: November 28, 1995 SUBJECT: Temporary Water Connection for APN 314-350-30, Kozy Crest Lane: Robin and Nancv Nelson. ADDlicants BACKGROUND: The subject property is located at 12310 Kozy Crest Lane approximately 450 feet west of Pomerado Road (Attachment 1). It is a vacant parcel approximately 0.73 acres in size. The nearest public water facility is a 12 inch water main located approximately 475 feet to the east in Pomerado Road. A temporary water connection for this property was approved by City Council on June 26, 1990. The applicant did not execute an agreement with the City within the allotted six months as required by the conditions of approval. As a result, the approval was considered null and void. Therefore, the Nelson's have resubmitted a request for a temporary water connection. In accordance with Section 12.1.12 of the Rules and Regulations governing water service, an application for a temporary water service from the nearest existing main, may be approved by City Council if, in it's opinion, an unusual condition exists. FINDINGS: 1. A requirement of the owner to construct a City water main to serve this parcel would be an excessive financial burden. 2. The standard "Agreement Respecting Temporary Water Connection" provides that should a City water main be installed adjacent to owner's property or at a location from which City then determines is to be the point of permanent connection, the temporary connection ACTION: NaV 28 1995 ITEM 14 2 OF 4 - Temporary Water Connection - APN 314-350-30 November 28, 1995 Page 2 shall be terminated and a connection to the new City main required. Also, provided for by this agreement is payment of the parcel's proportionate share of the cost of installation of such new main. 3. The rules and regulations allow the City Council to approve an application for a temporary service to account for unusual conditions. FISCAL IMPACT: None. ENVIRONMENTAL IMPACT: This action is not subject to C.E.Q.A. review. PUBLIC NOTIFICATION 1 CORRESPONDENCE: None. RECOMMENDATION: It is recommended that the City Council grant this request for a temporary water connection to serve Assessor's Parcel No. 314-350-30, subject to the following conditions: 1. Payment of all related fees and costs, including but not limited to, water meter, lateral, and base capacity fees. 2. Execution by the owner of a standard "Agreement Respecting Temporary Water Connection." A lot book report or title report shall be provided by the owner to verify ownership. 3. Acquisition of necessary private easements (a minimum of five-feet in width) across the properties wherein said line is being placed. Copies of the recorded easement documents shall be provided to the City's Engineering Services Department. 4. Acquisition of a right-of-way permit and payment of the related permit and inspection fees, and posting of a security deposit for connection to the public water main. 5.
