This report proposes a program for the use of the 22nd-Year funding and the hearing provides an opportunity for public input, in accordance with CDBG Guidelines. ENVIRONMENTAL REVIEW As required by the National Environmental Protection Act (NEPA), County of San Diego - staff will complete an environmental review for each project which is approved for fundin9. City staff has preViously determined that the proposed projects are Categorically Exempt from CEQA requirements, with the exception of the Housing Rehabilitation Program. Housing Rehabilitation projects will be reviewed on a case by case basis at the time they are proposed for funding. FISCAL IMPACT It is anticipated that the City of Poway will receive an allocation of $236,780 in 22nd Year CDBG funding. Staff will bring forward a separate report to appropriate operating funds for the approved programs, prior to receiving CDBG reimbursements. ADDITIONAL PUBLIC NOTIFICATION AND CORRESPONDENCE Notice of the Public Hearing for this item was published in the Poway News Chieftain. Four non-profit organizations, who have previously contacted the City regarding CDBG funding, have been sent a notice of this hearing. RECOMMENDATION It is recommended that the City Council receive public input, allocate the $236,780 in funding to the projects and programs identified in the attached agenda report and authorize the City Manager to execute contracts with the County of San Diego for management and implementation of the projects listed above, subject to the City - Attorney's approval as to form. SUBJECT: Funding Allocation for the 22nd-Year (1996-97) Community Development Block Grant Program. BACKGROUND The City of Poway receives an annual allocation of Community Development Block Grant (CDBG) funds from the United States Department of Housing and Urban Development (HUD). In the past this funding has been used for a variety of projects throughout the City such as the pedestrian bridge at Bowron Road, Americans with Disabilities Act (ADA) improvements to public facilities and the CDBG funded Housing Rehabilitation Program. The County of San Diego has estimated Poway's 22nd Year (FY 1996-1997) CDBG allocation at $236,780. It is expected that the 22nd Year funding will be available sometime between September and November of 1996. FINDINGS A total of five projects have been proposed for 22nd Year funding. It is possible that additional proposals will be received in response to the public notice. Two of the proposed projects are ongoing Redevelopment Agency Programs to assist low and moderate income residents in locating or maintaining existing affordable housing. The remaining three projects are improvements to provide disabled access for existing public facilities. PROJECTS/PROGRAMS RECOMMENDED FOR FUNDING 1. AFFORDABLE HOUSING ASSISTANCE AND REFERRAL PROGRAM $14,218 This program was initiated in November of 1993. It is an expanded version of an earlier Shared Housing Program. Lifeline Community Services administers the program for the City and currently offers a broad range of emergency and ACTION: DEe 1 2 1995 rmII ? ) 2 of 7 "- Agenda Report December 12, 1995 Page 2 referral services for low- and moderate-income residents of all ages. Services provided by the program include: shared housing matches, referrals for board and care placement, housing in exchange for services, emergency and long term shelter referral, housing assistance for the disabled, tenant/landlord mediation, legal assistance, migrant housing assistance and emergency assistance with food, transportation, gas, clothing and counseling. The total annual cost for operating the program in FY 1996/1997 is estimated at $28,436. Staff proposes to continue the current funding arrangement with one half of the funding coming from the CDBG allocation and the balance from the Redevelopment Agency's Low- and Moderate-Income Housing Fund. 2. CDBG HOUSING REHABILITATION PROGRAM $120,000 In March 1994, the City Council approved a proposal to establish a Housing Rehabilitation Program, using 20th Year CDBG funding. The Program was desi9ned to assist low-income homeowners who want to correct code violations and health, safety or maintenance problems in their homes. In November 1994 the City Council approved additional funding for the Program from the 21st Year CDBG Grant. To date, the Agency has assisted 12 homeowners with the CDBG Housing Rehabilitation Program. We expect to assist another 16 to 20 households with 21st-Year funding, which was released in September 1995. All of the households assisted, to date, were on a list of 2B low and very-low income households who had applied for the Affordable Housing Rehabilitation Loan Program (funded by the Low- and Moderate-Income Housing Fund) but were found to be ineligible because their housing costs, in relation to their income, were too high to meet the State's definition of "affordable housing cost." With the approval of the 22nd-Year funding we will be able to utilize names from the existing Program waiting list. Currently there are over 380 names on the waiting list. Only a portion of these names will qualify because many of the households are moderate income and the CDBG guidelines require households to be low or very low income in order to be eligible. It is estimated that the $120,000 Grant should be adequate to assist from 12 to 16 households. 3. PUBLIC STREET ACCESS RAMPS $45,062 This project will modify a number of existing street intersections throughout the City by installing curb cuts and ramps to provide wheelchair access. This is an ongoing project which is a component of the City's transition program for compliance with ADA requirements. 4. COMPLETION OF 19TH-YEAR ADA IMPROVEMENTS $50,000 When the City Council approved the ADA Transition Plan on January 19, 1993, it was estimated that the necessary improvements could be completed within three years. CDBG funding from the 18th, 19th, 20th and 21st-Year grants was reserved to complete the items listed on the Plan. The shortfall is particularly serious for 19th- Year projects. The final engineer's estimate for renovation of the Lake poway Concession restrooms, the Hamburger Factory restrooms and Community Service's restrooms is more than twice the amount originally budgeted for this work. As a result of the expected cost overrun on these building alterations, an additional $50,000 in funding will be necessary to ensure that all of the other projects listed for the 19th-Year can be completed. Attachment 1 is a chart which lists the 19th-Year ADA projects and compares the budgeted amount to the most recent cost estimate. The total cost will actually be greater than the amount shown on the chart as the cost of design, inspection and administration has not been included in all of the estimates. 5. CITY HALL ADA SIGNAGE $7,500 As part of the ongoing self-evaluation process involved in implementing the ADA Program, staff has identified an additional project which was not included in the original implementation plan. ADA standards require that all public buildings provide signage for disabled persons. The original Transition Plan did not include interior signage for specific rooms and service areas, such as conference rooms, City Clerk's office, customer service areas, etc. It is proposed that $7,500 be allocated for purchase and installation of signage with braille and raised lettering for the City Hall Complex and Customer Services building on Poway Road. ENVIRONMENTAL REVIEW As a requirement of the National Environmental Protection Act (NEPA), the County of San Diego will complete an environmental review for each of the proposed projects. City of Poway staff have completed the environmental review required for compliance with CEQA guidelines. The Poway Affordable Housing Assistance Program was previously reviewed and found to be exempt from CEQA. The proposed ADA improvements and pedestrian ramps are modifications to existing facilities and qualify for a Class 1 Categorical Exemption from CEQA requirements. Most of the individual Housing Rehabilitation projects will also be exempt, however, the projects are required to be evaluated on a case by case basis. FISCAL IMPACT It is anticipated that the City will receive an allocation of $236,780 in 22nd Year Community Development Block Grant Funding. Because the County of San Diego administers Poway's CDBG allocation, the City will actually receive funding on a reimbursement basis after providing the County with proof of expenditures. Following City Council and Board of Supervisor approval for the 22nd Year Program, staff will bring forward a separate report to appropriate operating funds for approved programs until reimbursement is received from the County. DEe 1 2 1995 ITEM 5 I 4 of 7 Agenda Report December 12, 1995 Page 4 ADDITIONAL PUBLIC NOTIFICATION AND CORRESPONDENCE As a condition of CDBG administration and as required by HUD, a public hearing must be held to determine the use of the 22nd Year funding. A public notice was published in the Poway News Chieftain. Community Development Block Grant regulations also require notification of interested non-profit organizations regarding the availability of 22nd-Year funding. To date, staff has been contacted by four non-profit organizations interested in using CDBG funds. These organizations have been notified of the funding availability. We have not received any proposals as of the date of this report. In the event new proposals are received during the public hearing, this item should be continued to allow staff time to research the CDBG eligibility of new proposals. RECOMMENDATION It is recommended that the City Council receive public input on the use of the 22nd Year CDBG funds, close the public hearing, and allocate funding to the following programs: 1.
