ADDlicant BACKGROUND: This project is located on Oak Knoll Road approximately 500-feet west of Pomerado Road (Attachment 1). TPM 92-05 was approved by City Council Resolution No. P 93-01 on January 5, 1993 (Attachment 2). The resolution approving the tentative parcel map requires that the project be annexed into Landscape Maintenance District 86-03B. The owner has consented to this annexation (Attachment 3). All other conditions have been met and all required fees have been paid or secured as allowed by the resolution of approval. FINDINGS: The final map has been examined and found to be technically correct, in compliance with State law and City ordinances, and is in conformance with the approved tentative parcel map and with conditions of approval. All fees, securities, or deposits have been made. FISCAL IMPACT: None. ACTION: ? " ASSESSOR'S PARCEL NUMBER 317-151-13 D(PARf",~-~"VICES t.:."r WHEREAS, Tentative Parcel Map 92-05, hereinafter .Map., submitted by Earl Hardesty, applicant, for the purpose of subdividing the real property situated in the City of Poway, County of San Diego, State of California, described as a portion of the Southwest Quarter of the Southwest Quarter of Section 14, Township 14 South, Range 2 West, San Bernardino Meridian, into three lots, regularly came before the City Council for public hearing and action on January 5, 1993; and WHEREAS, the Director of Planning Services has recommended appr6val'of the Map subject to all conditions set forth in the Phnning .SIj1"~ice.s D~partment report; and ; . WHEREAS, the City Council has read and considered said report, and has considered other evidence presented at the public hearing. NOW, THEREFORE, the City Council does hereby resolve as follows: Section I: Environmental Findinos: The City Council hereby issues a 'Negative Declarafion with mitigation measures for traffic and drainage impacts. Section 2: Findinos: 1. The proposed project will be consistent with the existing general plan in that it provides for the creation of commercial lots of a conforming size and configuration. 2. The tentative parcel map is consistent with all applicable general and specific plans, because the project will accommodate.a range of commercial uses which could appropriately locate in this arel. 3. The design or improvement of the tentative parcel map is consistent with all applicable general and specific plans in that the lot size and configuration and access to the site meet the standards contained in the Poway General Plan. 4. The site is physically suitable for the type of development proposed in that the property is flat and regularly shaped and can ultimately accommodate three separate buildings, one per lot. 5. The site is physically suitable for the density of the development proposed because each of the proposed lots is 1 arger than the minimum required by the zone in which it is located, thereby allowing for more flexibility in the placement of future buildings. The design of the parcel map is not likely to cause substantial environmental damage and avoidable injury to humans and wildlife or their habitat, because the site is wholly disturbed, contains no habitat or native plant or animal species. 7. The tentative parcel map is not likely to cause serious public hea lth problems because City water Ind sewer servi ce will be util ized. 8. The design of the tentative parcel map will not conflict with any easement acquired by the public It large, now of record, for access through or use of the property within the proposed subdivision. . Section 3: Citv Council Decision: The City Council hereby approves Tentative Parcel Map 92-05 subject to the following conditions: Within 30 days of approval the applicant shall submit. in writing that all conditions of approval have been read and understood. APPLICANT SHALL CONTACT THE DEPARTMENT OF PLANNING SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: SITE DEVELOPMENT 1. Site shall be developed in accordance with the approved site plans on file in the Planning Services Department and the conditions contained herein. 2. Approval, of this request shall not waive compliance with all sections of the Zoning Ordinance and all other applicable City Ordinance in effect at the time of building permit issuance. , 3. The storage sheds and debris which are present on the subject lot shall be removed prior to final map. 4. The freestanding sign shall be placed so as not to impede sight distance for vehicles exiting the subject property. A review of this requirement and permit will be processed prior to final map. 5. Prior to any use of the project site or business activity being commenced thereon, all conditions of approval contained herein shall be completed to the satisfaction of the Director of Planning Services. The following fees, including but not limited to, traffic mitigation, drainage, and park fees prior to occupancy. Permit ana plan check fees shall be paid upon submittal of a map, and/or grading plan as applicable. PARKING AND VEHICULAR ACCESS 1. Parking lot lights shall be low pressure sodium and have a maximum height of 18 feet from the finished grade of the parking surface and be directed away from all property lines, adjacent streets and residences. 2. All two-way traffic aisles shall be a minimum of 25 feet' wide" and emergency access shall be provided, maintained/free pn9 ~le~r, t minimum of 24 feet wide at all times during construction in accordance wi h Safety Services Department requirements. . 3. All parking spaces shall be double striped. lANDSCAPING 1. A Master Plan of the existing on-site trees shall be provided to the Planning Services Department prior to the issuance of building permits "and prior to grading, to ~etermine which trees shall be retained. 2. Existing on-site trees shall be retained wherever possible and shall be trimmed and/or topped. Dead, decaying or potenti ally dangerous trees" shall be approved for removal at the discretion of the City Landscape Architect during the review of the Master Plan of existing on-site trees Those trees which are approved for removal shall be replaced on a tree- for-tree basis as required by the Planning Services Department. 3. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. . SIGNS , Any signs proposed for this development shall be designed and approved in conformance with the Sign Ordinance. EXISTING STRUCTURES 1. Provide compliance with the Uniform Building Code for property line clearances considering use, area, and fire-resistiveness of existing buildings. 2. Existing bUilding(s) shall be made to comply with current bUilding and zoning regulations for the intended use of the bUilding. Page 4 ADDITIONAL APPROVALS REOUIRED Development review or minor development review shall be accomplished prior to the issuance of a building permit. APPLICANT SHALL CONTACT THE DEPARTMENT OF ENGINEERING SERVICES REGARDING COMPLIANCE WITH THE FOllOWING CONDITIONS: GRADING ~ . 1. Grading of the subject property shall be in accordance with the Uniform Building Code, City Grading Ordinance, approved grading plan and geotechnical report, and accepted grading practices.' ., , ., I, .# , . 2. A soils report shall be prepared by a qualified engineEr licensed by the State of California to perform such work at first submittal of grading plan. 3. The final grading plan shall be prepared on a standard sheet, shall be subject to review and approval by the Planning and Engineering Services Departments and shall be completed prior to issuance of building permit. 4. A pre-blast survey of surrounding property' shall ~e conducted to the satisfaction of the City Engineer prior to any rock blasting. Seismic recordings shall be taken for all blasting and blasting shall occur only at locations and levels approved by the City Engineer. 5. Site grading shall be certified by the project civil engineer prior to issuance of building permits. 7. All new slopes shall be minimum of 2:1 (horizontal to vertical). 8. If pad elevations increase by greater that two feet in height from.tho~e approved on the tentative map, City Council approval will required. 9. Non-supervised nor non-engineered fill is specifically not allowed. Rock disposal areas shall be graded in compliance with City-approved soils investigations and recommendations and grading plans. 10. Erosion control, including but not limited to desiltation basins, shall be installed. All damaged off-site public works facilities. inclu'ding parkway trees, sha 11 be repaired or replaced prior to exoneration of bonds and improvements, to the satisfaction of the Department of Engineering Services. 9. Prior to any work being performed in the public right..of-way. an encroachment permit shall be obtained from the Engineering Services" department and appropriate fees paid, in addition to any other p~rmits required. 10. The developer shall acquire an encroachment permit for any private improvements placed within the public right-of-way. . 11. A monumentation bond in an amount acceptable to" the City Engineer shall ~e posted prior to final map. DRAINAGE AND FLOOD CONTROL 1. Intersection drains will be required at locations specified by the City Engineer and in accordance with standard engineering practicp.s. 2. A drainage system capable of handling and disposing of all sJrfac; water originating within the subdivision, and all surface waters tnat may flow onto the subdivision from adjacent lands, shall be required. Said drainage system shall include any easements and structures as required by . the City Engineer to properly handle the drainage. 3. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Poway does hereby resolve as follows: 1. The foregoing recitals are true and correct and the City Council so finds and determines. 2.
