ABSTRACT
Alan Royster has requested the City of Poway to vacate a portion of a sewer easement
within Lot 2 of Map 12553. Granting the vacation will not adversely affect the sewer
main within the easement and will allow for a more desirable development of Lot 2.

The subject easement, Attachment 1, was dedicated to the City of Poway through
Map 12553, which was recorded in the Office of the County Recorder of San
Diego County on February 6, 1990. It was dedicated to provide for the
placement of a public sewer main, required as a condition of approval of the
final map for the subdivision. The easement is 20-feet-wide, of which 15 feet
is within Lot 2 and 5 feet is within Lot 1 to the west. The sewer main is not
centered in the easement, but is contained within Lot 2. (See Attachment 2.)
Alan Royster is the original subdivider and is the developer/owner of Lot 2.
In order to properly place a building on Lot 2, an additional 2.5 feet within
the subject sewer easement is needed.
FindinQs
Vacating a 2.5 foot strip of the subject easement will not adversely affect
the operation or maintenance of the existing sewer main, but greatly enhances
the potential building area for the applicant. There are no public utilities
within the area being vacated.

RESOLUTION NO. 95-
A RESOLUTION OF THE CITY COUNCIL Of THE CITY OF POWAY ORDERING THE VACATION
OF A SEWER EASEMENT LOCATED WITHIN LOT 2 Of MAP 12553, RECORDED IN THE
OFFICE OF THE COUNTY RECORDER Of SAN DIEGO COUNTY ON FEBRUARY 6, 1990
(VACATION 95-04)
WHEREAS, the City Council of the City of Poway desires to summarily
vacate a certain sewer easement in accordance with the procedures provided in
Chapter 4, Part 3, Division 9 of the Streets and Highways Code of the State of
California, commencing at Section 8330; and
WHEREAS, a sewer easement described by the attached legal description
and shown on the attached plat titled "Exhibit A" was dedicated to the public
on Map 12553 recorded February 6, 1990 in the Office of the County Recorder.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway
as foll ows:
1. This summary vacation is made under the provisions of Chapter 4,
Part 3, Division 9 of the Streets and Highways Code of the State
of Ca 1 iforni a.
2. The City Council hereby finds that the herein described sewer
easement is unnecessary due to the fact that the remaining sewer
easement is sufficient for the operation and maintenance of the
sewer main within the easement,
3. The City Council hereby declares that the following sewer easement
is vacated:
See attached legal description and plat titled "Exhibit A."
4. The City Clerk of the City of Poway is hereby directed to cause a
certified copy of this Resolution to be recorded in the Office of
the County Recorder of San Diego in accordance with the provisions
of Section 8336 of the Streets and Highways Code of the State of
Cal ifornia.
PASSED, ADOPTED, AND APPROVED by the City Council of the City of Poway,
California, at a regular meeting this 12th day of December, 1995.
