ABSTRACf California Government Code Section 65865.1 requires that the City Council annually review compliance with the terms of Development Agreements that have been entered into with developers. It is recommended that the City Council find that Trident Homes of California, Inc. has complied with the terms of the Development Agreement for the development of Rolling Hills Estates. ENVIRONMENTAL REVIEW This item is not subject to CEQA review. - FISCAL IMPACf None. ADDITIONAL PUBLIC NOTIFICATION AND CORRESPONDENCE A copy of this report has been sent to Trident Homes of California, Inc. RECOMMENDATION It is recommended that the City Council find that has demonstrated good faith compliance with the terms of the Development Agreement entered into on November 27, 1990. BACKGROUND On May 14, 1991, the City of Poway entered into a Development Agreement with McMillin Equity Partners II to provide for the development of Rolling Hills Estates within the South Poway Community Plan Area. The requisite periodic review of compliance under the Development Agreement must take place prior to the calendar year-end each year hereafter. FINDINGS Attached is a letter from the developer which accurately describes the progress that has been made to date. Staff has determined that the work accomplished under the Development Agreement is in compliance with the provisions of the South Poway Community Plan and the Development Agreement. FISCAL IMPACT None. PUBLIC NOTIFICATION AND CORRESPONDENCE A copy of this report has been sent to Trident Homes of California, Inc. Box 789 Poway, CA 92074-0789 RE: Annual review of the poway 135 Development Agreement Dear John: Pursuant to your request, below is a brief description of the activity that has taken place on the Poway 135 project during 1995 relative to the Development Agreement as amended. The primary activity involved progress for the plan checks of Units 1 and 2. 1. Improvement Plans, Grading Plans and the Final Map for Unit #1 were re- submitted to the City of Poway for the continuation of the plan check for the property. 2. Improvement Plans, Grading Plans and the Final Map for Unit #2 were submitted to the City for the initial plan check. 3. Comments from both plan checks have been received from the City and have been or are being addressed. 4. Except for two or three issues, the resolution of which is expected soon, the plan checks are complete. The Final Maps and Subdivision Improvement Agreements are expected to be ready for City Council approval during the first quarter of 1996. Final Map recordings should occur shortly thereafter. This letter is provided for information purposes only, in accordance with Section 5.5 of the Development Agreement.
