ABSTRACT
On October 17, 1995, City Council approved the final map for Watkins Trucking which lies within Tech
Business Center. At that time, the property was inadvertently omitted from the annexation process under
the belief that it lay within the already annexed portion of Tech Business Center, This property lies to the
east of Tech Center Drive and south of Scripps Poway Parkway.

- This item is not subject to CEQA review,
FISCAL IMPACT
The final map for this project creates two parcels from APN 317-280-62, Annexation will add revenues
to LMD 87-1 based on $790 per net acre according to the Fiscal Year 1995/96 District Engineer's
Report.

BACKGROUND
Under the State Landscape and Lighting Act of 1972, Landscape Maintenance District 87-1
was formed on January 27, 1987. Resolution No. 93-026, adopted by Council February 4,
1993, allows for the annexation of and the collection of annual assessments from new
commercial/industrial properties that are within a landscape maintenance district.
FINDINGS
The propeny, owned by Watkins Terminals, Inc., lies within LMD 87-1, and therefore is
subject to annexation. The project contains landscaping that is adjacent to Scripps Poway
Parkway, and as such, is subject to a 100 percent rate per City LMD policy based on net
acreage.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
ORDERING THE EXPANSION OF POW A Y
LANDSCAPE MAINTENANCE DISTRICT 87-1
WITH THE ANNEXATION OF TPM 95-03
WITH WRITTEN CONSENT OF PROPERTY OWNER
APN 317-280-62
WHEREAS, the City Council of the City of Poway desires to expand Poway landscape
Maintenance District 87-1 for the purposes of maintaining, servicing, and operating said
district as shown in Exhibit "A" pursuant to the Landscape and Lighting Act of 1972; and
WHEREAS, the record owner of all the real property within said expansion area has
given written consent to the formation and annexation into Poway Landscape Maintenance
District 87-1 pursuant to California Streets and Highway Code, Section 22608.1; and
WHEREAS, the public interest and convenience require the maintenance, service. and
operation of public landscape facilities within said territory.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Poway
does hereby resolve as follows:
1. The foregoing recitals are true and correct, and the City Council so finds and
determines _
2_ All of that certain territory shown in Exhibit" A," attached hereto, is hereby
added by annexation into Poway Landscape Maintenance District 87-1.
PASSED, ADOPTED, and APPROVED by the City Council of the City of Poway,
California, at a regular meeting this 19th day of December, 1995.
