Res 02-128RESOLUTION NO. 02-128 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA, APPROVING A TRAFFIC MITIGATION FEE FOR SOUTH POWAY SPECIFIC PLAN AMENDMENTS THAT CHANGE THE LAND USE DESIGNATION FROM LIGHT INDUSTRIAL TO INDUSTRIAL PARK (SPA 84-01DDD) WHEREAS, Chapter 17.47 (Specific Plan Regulations) of Title 17 (Zoning Development Code) of the Poway Municipal Code provides the requirements for the initiation, preparation and adoption of Specific Plans in accordance with Section 65450, et seq. of the California Government Code (Article 8, Specific Plan); and WHEREAS, on July 30, 1985, the City Council adopted Resolution No. P 85-44 approving the South Poway Planned Community (SPPC) Development Plan; and WHEREAS, on July 26, 1988, the City Council adopted Resolution No. 88-074, certifying the Final Subsequent Environmental Impact Report for the South Poway Planned Community Development Plan pursuant to General Plan Amendment GPA 88- 02A involving amendments to the text of the South Poway Planned Community Development Plan (Volume 1, Development Plan and Volume 2, Development Standards) that were adopted by Resolution No. 88-075; and WHEREAS, Section 17.47.020.C (Initiation) of the Zoning Development Code provides that the City Council may initiate the preparation of, or amendment to, a Specific Plan by Resolution; and WHEREAS, on November 30, 1999, the City Council initiated Specific Plan Amendment (SPA) 84-01QQ to amend the South Poway Specific Plan Industrial Park (IP) land use designation to allow more intense uses such as office buildings and to develop appropriate standards; and WHEREAS, a Traffic Analysis, prepared by VRPA Technologies and dated June 26, 2001, reviewed existing and proposed developments inside and surrounding the South Poway Planned Community, in conjunction with adopted SANDAG 2020 regional growth and traffic forecasts, to determine the potential unused number of vehicle trips in Scripps Poway Parkway necessary to accommodate anticipated revisions and redesignation of land uses in the South Poway Planned Community; and WHEREAS, the traffic analysis for SPA 84-01QQ concluded there are approximately 17,000 available average daily trips on Scripps Poway Parkway, or 143 acres available for revision or redistribution; and Resolution No. 02-128 Page 2 WHEREAS, on July 17, 2001, the City Council approved SPA 84-01QQ and identified 143 acres of property designated Light Industrial could be converted to Industrial Park provided such requests be required to mitigate the impact of the land use intensification through the payment of a traffic mitigation fee; and WHEREAS, on December 4, 2001, the City Council adopted Resolution No. 01- 111 initiating Specific Plan Amendment 84-01DDD to amend the South Poway Specific Plan to develop a process for the land use designation changes from Light Industrial to Industrial Park pursuant to SPA 84-01QQ, to modify the land use matrices and make other minor updates to the text of Volume 2 - Development Standards of the South Poway Specific Plan, and adopt a traffic mitigation fee for those requesting land use changes from LI to IP; and WHEREAS, on December 17, 2002, the City Council held a duly advertised public hearing to solicit comments from the public, both pro and con, relative to this application. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: The City Council has considered the Environmental Initial Study (ELS), Negative Declaration (ND) for the project. The subject ElS and ND documentation are fully incorporated herein by this reference. The City Council finds, on the basis of the whole record before it, that there is no substantial evidence the project will have a significant impact on the environment and that the ND reflects their independent judgment. Section 2: The City Council hereby establishes the following Traffic Mitigation Fee to be applied prior to issuance of a building permit issued to develop the land that has been redesignated from Light Industrial to Industrial Park pursuant to South Poway Specific Plan Amendment 84-01DDD: Land Use Change Daily Trip Mitigation Fee Generation Rate (Average Daily Trip) Light Industrial (LI) to 71 ADT/acre $55.00/ADT Industrial Park (IP) Resolution No. 02-128 Page 3 PASSED, APPROVED AND ADOPTED by the City Council of the City of Poway, State of California, at a regular meeting this 17th day of December 2002.
