ABSTRACT
The proposed parcel map will divide a 1.25 acre property into two lots which meet the
performance standards of the RS-2 lone. Approval of the parcel map will result in the
extension of the City water system to the area.
ENVIRONMENTAL REVIEW
An environmental initial study was prepared for the project and it was determined that
,. the project will not have a significant impact on the environment. Staff therefore
recommends that the City Council adopt a Negative Declaration with Mitigation Measures.
FISCAL IMPACT
The project will result in an increase in property tax revenues of approximately $4,466.
ADDITIONAL PUBLIC NOTIFICATION AND CORRESPONDENCE
Notice of the public hearing has been sent to 48 property owners within 500 feet of the
project boundary.
RECOMMENDATION
It is recommended that City Council issue a Negative Declaration and approve Tentative
Parcel Map 93-02 subject to the conditions contained in the proposed resolution.

A request to divide a 1.25 acre property into two lots. The
subject property is located at 15050 Espola Road in the RS-2
zone. APN: 321-011-22
BACKGROUND
The project site is located on a private easement on the west side of Espola Road
approximately 300 feet north of Evergreen Lane. It will be the last in-fill lot
along the private easement to develop given the current RS-2 zoning. Parcel maps
have been approved on the properties located immediately north (TPM 88-17) and
south (TPM 85-01) of the site in recent years. .
FINDINGS
The subject property is 1.25 acres. It has been previously graded into three
terraced areas with elevations ranging from 718 feet to 654 feet. A residence
exists on the upper terrace along the westerly section of the lot, a supplemental
parking area has been developed on the mid-level terrace and a defined drainage
channel exists on the lower or easterly section of the property. Existing single
family development is located on the properties located immediately east, south
and west of the site.
The subject property is zoned RS-2 and as shown in the following table complies
with City zoning and development standards.

Development Facilities
The conditions of approval for Tentative Parcel Map 85-01, which was the most
recent map to develop along the private road easement required the developer to
extend the City sewer system to the area, construct a drainage culvert and
improve the private road. The subject lot is likely to be the last property to
develop along the easement. The City therefore is requiring that the project
developer extend the City water main to the site. This will allow permanent
water service to replace the temporary water meters located on Espola Road which
currently provide water to other lots along the private easement.
Development of the property will also require the developer to install a fire
hydrant on the southeast corner of Lot 2.
ENVIRONMENTAL REVIEW
An environmental initial study (See Attachment 2) was prepared on the property
and it was determined that the project should not have a significant impact on
the environment. Staff is therefore recommending that the City Council adopt a
Negative Declaration with Mitigation Measures.
A condition of approval for the project requires that an open space easement be
recorded over the area on Parcel 2 that is subject to inundation by a 100 year
flood event and includes riparian habitat.
FISCAL IMPACT
The subject property is located within the Redevelopment Area. If the new vacant
lot (Lot 2) were to be developed with a single family home comparable in size for
the area, the approximate assessed value of the lot would be $408,500. Therefore
the approximate property tax would be $4,466.

Public notice was published in the Poway News Chieftain and mailed to 48 property
owners in the project area.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING TENTATIVE PARCEL MAP 93-02
ASSESSOR'S PARCEL NUMBER 321-011-22
WHEREAS, Tentative Parcel Map 93-02, hereinafter "Map" submitted by ERB
Engineering, Applicant, William and Patricia Fabean, Owners, for the purpose of
subdividing the real property described as Parcel 1 of Parcel Map No. 6084, being
a portion of the east half of the southeast quarter of the northwest quarter of
Section 6, Township 14 South, Range 1 West, San Bernardino Meridian, in the
County of San Diego, State of California, according to the official plan thereof
into two lots, regularly came before the City Council for public hearing and
action on May 4, 1993; and
WHEREAS, the Director of Planning Services has recommended approval of the
Map subject to all conditions set forth in the Pl anning Services Department
report; and
WHEREAS, The City Council has read and considered said report and has
considered other evidence presented at the public hearing.
NOW, THEREFORE, the City Council does hereby resolve as follows:
-- Section 1: Environmental Findinas:
The City Council fi nds that thi s project wi 11 not have a significant
adverse impact on the environment and hereby issues a Negative Declaration
with Mitigation Measures as contained in the conditions of approval.
Section 2: Findinas:
The City Council makes the following findings in regard to Tentative
Parcel Map 93-02 and the Map thereof:
1. The proposed project will be consistent with the existing general
plan in that the proposed lots are for residential use.
2. The design or improvement of the tentative parcel map is consistent
wi th all app 1 i cable general and spec i fi c plans; because the lot
sizes created are larger than the minimum size required in the RS-2
zone.
3. The site is physically suitable for the type of development
proposed, in that one half of the property is currently developed
with a single family home and the vacant half can accommodate an
additional home site.
4. The site is physically suitable for the density of the development
proposed in that is an " in-fill" project completing a previously
established land use pattern in the area.

5. The design of the subdivision is not likely to cause substantial
environmental damage and avoidable injury to humans and wildlife or
their habitat; because the sensi t i ve mul efat scrub and ri pari an
habitats have been placed in an open space easement.
6. The tent at i ve parcel map is not 1 i ke 1 y to cause seri ous pub 1 i c
health problems in that the extension of the public water and system
are required as a conditions of approval. Low flow plumbing
fixtures will be required throughout future buildings on the site.
7. The design of the tentative parcel map will not conflict with any
easement acquired by the public at large, now of record, for access
through or use of the property within the proposed subdivision; and
overhead utilities will be undergrounded.
8. That this project will not create adverse impacts on the environment
and a Negative Declaration with Mitigation Measures is issued.
9. The effect of the Tentative Parcel Map 93-02 on the housing needs of
the San Diego region has been considered and balanced against the
public service needs of Poway residents and available fiscal and
environmental resources.
10. The design of the subdivision has provided, to the extent feasible,
for future passive or natural heating or cooling opportunity in the
subdivision.
Section 3: Citv Council Decision:
The City Council hereby approves Tentative Parcel Map 93-02 subject to the
following conditions:
Within 30 days of approval the applicant shall submit in writing that all
conditions of approval have been read and understood.
COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE
APPROVED BY THE DEPARTMENT OF PLANNING SERVICES.
SITE DEVELOPMENT
1. Site shall be developed in accordance with the approved site plans on file
in the Planning Services Department and the conditions contained herein.
2. Mail boxes shall be installed according to a plan which is acceptable to
both the Post Office and the Director of Planning Services.
3. Prior to any use of the project site all conditions of approval contained
herein shall be completed to the satisfaction of the Director of Planning
Services.

4. For a new residential dwell ing unites), the applicant shall pay
development fees at the established rate. Such fees may include, but not
be limited to traffic mitigation, drainage, water base capacity, and park
shall be paid in full prior to occupancy. Sewer line charges are waived
in consideration of installation of the water main.
Permit and plan checking fees shall be paid upon submittal of a map,
improvement, and/or grading plan, as applicable.
Sewer annexation and fire protection fees must be paid in full prior to
scheduling of parcel map for City Council approval.
All other fees, including but not limited to, school, water service fees,
remaining sewer connection, sewer cleanout and sewer inspection fees shall
be paid prior to building permit issuance.
5. Street names shall be approved by the Planning Services Department prior
to the recordation of the fi na 1 map, and street addresses shall be
provided prior to the issuance of building permits.
6. Building identification and/or addresses shall be placed on all new and
existing buildings so as to be plainly visible from the street or access
road; color of identification and/or addresses shall contrast with their
background color.
LANDSCAPING
1. A Master Plan of -the existing on-site trees shall be provided to the
Planning Services Department prior to the issuance of building permits and
prior to grading, to determine which trees shall be retained.
2. Existing on-site trees shall be retained wherever possible and shall be
trimmed and/or topped. Dead, decaying or potentially dangerous trees
shall be approved for removal at the discretion of the Planning Services
Department during the review of the Master Plan of existing on-site trees.
Those trees which are approved for removal shall be replaced on a tree-
for-tree basis as required by the Planning Services Department.
3. All landscaped areas shall be maintained in a healthy and thriving
condition, free from weeds, trash, and debris.
SIGNS
Any signs proposed for this development shall be designed and approved in
conformance with the Sign Ordinance.
RECREATION
The developer shall pay the Park Fee at the established rate at the date
of final inspection, or the date of the Certificate of Occupancy,
whichever occurs later.

ADDITIONAL APPROVALS REQUIRED
1. Development review or minor development review shall be accomplished prior
to the issuance of a building permit.
2. The developer shall display a current Zoning and land Use Map in the sales
office at all times, and/or suitable alternative to the satisfaction of
the Director of Planning Services.
3. All sales maps that are distributed or made available to the public shall
include but not be limited to trails, future and existing schools, parks,
and streets.
COMPLIANCE WITH THE FOllOWING CONDITIONS IS REQUIRED. COMPLIANCE SHAll BE
APPROVED BY THE DEPARTMENT OF ENGINEERING SERVICES.
GRADING
1. Grading of the subject property shall be in accordance with the Uniform
Building Code, City Grading Ordinance, approved grading plan and
geotechnical report, and accepted grading practices.
2. A soils report shall be prepared by a qualified engineer licensed by the
State of California to perform such work at first submittal of grading
plan.
3. A geological report shall be prepared by a qualified engineer or geologist
and submitted at the time of application for grading plan check.
4. The final grading plan, prepared on a standard size sheet, shall be
subject to review and approval by the Planning Services and Engineering
Services Departments and shall be completed prior to issuance of a grading
permi t.
5. A pre-blast survey of surrounding property shall be conducted to the
satisfaction of the City Engineer prior to any rock blasting. Seismic
recordings shall be taken for all blasting and blasting shall occur only
at locations and levels approved by the City Engineer.
6. All new slopes shall be a minimum of 2:1 (horizontal to vertical).
7. A fi na 1 compaction report shall be submitted and approved pri or to
issuance of building permits.
8. Site grading shall be certified by the project civil engineer prior to
issuance of building permits.
9. Buildings and parking lots shall be at least five feet from tops and toes
of slopes.

10. Non-supervised nor non-engineered fill is specifically not allowed. Rock
disposal areas shall be graded in compliance with City-approved soils
investigations and recommendations and grading plans.
II. Erosion control, including, but not limited to desiltation basins, shall
be i nsta 11 ed. The developer shall make provisions to insure the proper
maintenance of all erosion control devices throughout their intended life.
STREETS AND SIDEWALKS
I. Reciprocal access and maintenance and/or agreements shall be provided
insuring access to all parcels over private roads and maintenance thereof
to the satisfaction of the Director of Engineering Services prior to
parcel map approval.
2. All damaged off-site public works facilities, including parkway trees,
sha 11 be repaired or replaced prior to exoneration of bonds and
improvements, to the satisfaction of the Department of Engineering
Services.
3. Prior to any work being performed in the public ri ght-of-way, an
encroachment permit shall be obtained from the Engineering Services
Department and appropriate fees paid, in addition to any other permits
required.
4. A monumentation bond in an amount acceptable to the City Engineer shall be
posted prior to parcel map approval.
UTILITIES
I. All proposed utilities within the project shall be installed underground.
2. Utility easements shall be provided to the specification of the serving
utility companies and the Director of Engineering Services.
3. The developer shall be responsible for the relocation and undergrounding
of existing public utilities as required by the Department of Planning
Services.
4. Water, sewer, and fire protection systems plans shall be designed and
constructed to meet requirements of the City of Poway and the County of
San Diego Department of Health. A public sewer main was installed as a
condition of the adjacent Sanchez parcel map. A public water main and
fire hydrant (in a location satisfactory to the Fire Marshal) shall be
installed with this map as the fair share of public improvements.
s. The applicant shall pay for a water system analysis to establish the
proper size and location for the public water system. The amount will be
determined by the cost of the analysis and shall be paid upon demand by
the City.

6. The applicant shall, within 30 days after receiving approval of the
tentative parcel map apply for a Letter of Availability (LOA) to reserve
sewerage availability and post with the City, a nonrefundable reservation
fee equal to 20% of the appropriate sewerage connection fee in effect at
the time the LOA is issued.
7. Water main lines and appurtenances that will be installed at locations
other than within public streets shall have an easement, a minimum of 20
feet wide, dedicated to the City of Poway. Multiple parallel facilities
will require additional easement width for on-site facilities. Dedication
shall be made in the final map whereas off-site 1 ines shall have the
easement dedicated by a separate instrument recorded prior to final map
approval.
8. All public utility lines (i.e., water, sewer, drainage) not located within
public streets shall have an improved access over and along the respective
easement, the surfacing and width of which shall be acceptable to the City
Engineer.
COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE
APPROVED BY THE DEPARTMENT OF SAFETY SERVICES.
A new fire hydrant shall be installed at the southeast corner of Lot 2.
GENERAL REQUIREMENTS AND APPROVALS
l. Prior to recordation, a Notice of Intention to form Landscape and/or
Lighting Districts shall be filed with the City Council. The engineering
costs involved in district formation shall be borne by the developer.
2. A copy of the CC&R's and/or Articles of Incorporation of the Homeowner's
Association shall be subject to the review for compliance with conditions
herein, to the satisfaction of the City Attorney and Director of Planning
Services, and shall be fil ed wi th the Secretary of State, the County
Recorder, and the City Clerk at the time of final map consideration.
3. The applicant shall make an irrevocable offer of dedication for all
private road easements as shown on the tentative map. Said 100 shall be
recorded as part of the final map, rejected by the City Council, and held
for future acceptance at the City Council's discretion.
4. Final parcel maps shall conform to City standards and procedures.
5. By separate document prior to the recording of the final subdivision map,
or on the final subdivision map, there shall be granted to the City, an
open space easement over that port ion of Lot 2 that is shown on the
tentative map as an area subject to inundation by the 100 year storm.
Said open space easement shall be approved as to form by the City Attorney
and shall limit the use of said open space land to open space left in its
natural state.

6. Should this development be further divided, each fi na 1 map shall be
submitted for approval by the Director of Engineering Services.
5. All provisions of the Subdivision Ordinance of the Poway Municipal Code
shall be met as they relate to the division of land.
7. Prior to occupancy, all dedications shall be made and easements granted as
required above.
8. The tentative map approval shall expire on May 4, 1995. An application
for time extension must be received 90 days prior to expiration in
accordance with the City's Subdivision Ordinance.
APPROVED and ADOPTED by the City Council of the City of Poway, State of
California, this 4th day of May 1993.

DISCUSSION OF ENVIRONMENTAL EVALUATION
.1.. Soils and Geoloav. The project should not have a significant impact on soil or
geologic conditions of the area. The property has been previously graded and
developed with a single family home which is located on proposed Lot 1.
Additional grading may be required when Lot 2 is developed. In the event
additional grading is necessary, the developer will be required to comply with
the Poway Grading Ordinance.
2. Hvdroloav. The project should not have a significant impact on the hydrologic
conditions of the area.
3. Air Qualitv. The project will not a significant impact on the air quality.
4/5. Flora and Fauna. The subject property has been previously graded into three
terraced areas with elevations ranging in height from 718 feet to 654 feet. A
residence exists on the upper terrace, a supplemental paved parking area on a
mid-level terrace and a defined drainage channel exists at the lower end.
Existing single family development is located on the properties immediately east
and south of the property. The USGS Map for the area shows that the
drainage channel which is located on the easterly border of the property is a
blue line stream. This portion of the property is subject to inundation by the
100 year flood. Riparian vegetation exists along the banks of the stream.
Mitiaation. A condition of approval for the project will require that an open
space easement be recorded over the area that is subject to inundation by the
100 year flood ( includes riparian area).
6. PODulation. The project will not have a significant impact on area population
in that the proposal will be creating one additional single family lot.
7. Socio-Economic Factors. The project should not have an impact on the socio-
economic conditions of the area. The developer is required to pay development
fees as drainage, sewer and park fees to offset the costs to provide and
maintain public services to the area.
8. land Use and Plannina Considerations. The project complies with the Poway
General Plan and zoning standards. Therefore it will not have a significant
impact on land use or planning considerations for the area.

9. TransDortation The creation of one additional single family lot in the project
area will not have a significant impact on the existing transportation system.
10. Cultural Resources. According to the Map of Archaeologically Sensitive Areas
in the Poway General Plan, the project site is located in an area that has been
identified as having a high probability for the presence of archaeological
resources. An archaeological study was prepared for the property located
immediately north of the subject site. The records search prepared for the
study revealed no previous cultural resource sites had been reported on that
property or the subject site.
The General Plan requires that an archaeological survey be prepared for all
projects unless the project qualifies for an exemption. The subject project can
be exempted because the 1.25 acre site does not include any previously
identified and reported archaeological resources and the area has been
subjected to natural or human impacts that have eliminated any cultural
resource potential (Approximately 2/3 of property has been disturbed in the
development of a homesitel.
11. Health.Safetv. and Nuisance Factors. The project will not have a significant
health, safety or nuisance impacts.
12. Aesthetics. The project will not have a negative aesthetic impact on the area.
13. Utilities and Public Services. The project will not have a significant impact on
existing utility and public services. The developer is required to pay
development fees to offset the costs to provide and maintain public services.
14. EnerQv and Scarce Resources. The project will not have a significant impact
on energy and scarce resources.
