Res P-81-03PLANNING RESOLUTION NO. P-81-3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING VARIANCE 81-152 (BRANDALISE) FOR A 7 FOOT HIGH FENCE ALONG THE REAR AND SIDE PROPERTY LINES FOR THE PROPERTY LOCATED AT 13956 POWAY ROAD APN 323-203-19 WHEREAS, on June 16, 1981 the County of San Diego received Variance Request V81-152; and WHEREAS, the City Council of the City of Poway held a duly advertised public hearing on August 11, 1981; and WHEREAS, comments were invited and taken both pro and con relative to Variance 81-152 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Poway does hereby find: Section 1 Findings required: That there are special circumstances applicable to the pro- perty in the way of location and surroundings and because of the strict application of the zoning that would deprive the property owner of privileges enjoyed by other property owners in the vicinity, under identical zoning classification. That the granting of the variance is necessary for the pre- servation and enjoyment of a substantial property right possessed by other property in the vicinity in the same zone, denied to the property for which the variance is sought. Cw That the granting of the variance or its modification will not be materially detrimental to the public health, safety, or welfare or injurious to the property improvements in such vicinity and zone in which the property is located. That the granting of this variance does not constitute a special privelege inconsistent with the limitations on other properties in the vicinity and zone in which that property is situated. ee fe Planning Resolution No.P-81-3 Page 2 That the granting of this variance does not allow a use or activity which is not otherwise expressly authorized by the zoning regulation governing the parcel of property. That the granting of this variance or its modification will not be incompatable with the City of Poway General Plan. Section 2 That the City Council of the City of Poway does hereby approve the applicants request for a 7 foot high fence along the rear and side proprty lines of said property above herein described. Section 3 All required plans and specifications for the construction of the fence shall be submitted to the Building Department prior to the issuance of a building permit.
