A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING VARIANCE 81-156 (BORRA)
FOR A REQUEST FORREAR YARD SETBACK
FROM 25 FEET TO 9 FEET FOR THE PROPERTY LOCATED AT
13319 TAWAN~(A DRIVE

WHEREAS, on June 22, 1981 the County of San Diego received Variance
Application V81-156; and
WHEREAS, the City Council of the City of Poway held a duly advertised
public hearing on August 11, 1981; and
WHEREAS, comments were invited and taken both pro and con relative to
variance 81-156
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Poway does hereby find:
Section 1 Findings required:

That there are special circumstances applicable to the
property or to the intended use of the property due the
strict application of the Zoning Ordinance that would deprive
the property owner of privileges enjoyed by other property
owners in the vicinity under identical zoning classifica-
tion.

That the granting of the variance is necessary for the
preservation and enjoyment of a substantial property right
possessed by other property owners in the vicinity and zone,

That the granting of the variance or its modification will
not be materially detrimental to the public health, safety,
or welfare or injurious to the property improvements in such
vicinity and zone in which the property is located.

That the granting of this variance will not constitute the
granting of a special privelege inconsistent with the
limitations on other properties in the vicinity and zone in
which that property is situated.

That the granting of this variance will not allow a use and
activity which is not otherwise expressly authorized by the
zoning regulation governing the parcel of property.
f. That the granting of this variance or its modification will
not be incompatable with the City of Poway General Plan.
Section 2
The request for Variance 81-156 is hereby granted at 12 feet from rear
property line.
PASSED, ADOPTED and APPROVED by the City Council of the City of Poway,
California, at a regular meeting thereof this 11th day of August, 1981.
