Res P-81-05RESOLUTION NO. P-81-5 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING A MODIFICATION OF MAJOR USE PERMIT P79-178 WITH CONDITIONS APN 323-201-14 WHEREAS, the City Council of the City of Poway held a duly advertised public hearing on September 1, 1981 to solicit and consider comments from the public, both pro and con relative to the above referenced project, NOW, THEREFORE, the City Council RESOLVES as follows: Section 1: Findings That the location size, design, and operatinng characteris- tics of the proposed use will be compatible with and will not adversely affect or be materially detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage and density; 2. The availability of public facilities, services and utilities; 3. The harmful effect, if any, upon desirable neighborhood character; 4. The generation of traffic and the capacity and physical character of surrounding streets; 5. The suitability of the site for the type and intensity of use or development which is proposed; 6. The harful effect, if any, upon environmental quality and natural resources; and to 7. Any other relevant impact of the proposed use; and That the impacts, as described in paragraph "a" of this secton, and the location of the proposed use will not adversely affect the Poway General Plan. Section 2: The City Council finds that the previously issued Negative Declaration for the project suffices for this modifica- tion. Resolution No. P-81-5 Page 2 Section 3: The City Council hereby approves said modification subject to the following additional conditions: 1. No concentrated flow of drainage shall be permitted across driveways. 2. Decorative wood fencing shall be required on the east, west and north property lines to the satisfaction of thd Director of Planning Services. 3. Minimum 15 gallon size trees 30' on center shall be planted along the westerly property line to the satisfaction of the Director of Planning Services. 4. All specimin trees existant on site shall be preserved in place, except for those determined by the Director of Plann- ing Services to be diseased, dying or dead or in the path of proposed buildings or streets. 5. Landscape planter islands shall be added as shown in Exhibit 6. An alley type return shall be required to be constructed for the private drive as it intersects with Poway Road. 7. The Private Drive shall be a crowned section or an off center crown section to the satisfaction of the Director of Planning Services. 8. The garage door elevations shall be revised to the satisfac- tion of the Director of Planning Services to show more variety. 9. Trash pickup shall be by individual unit. The trash areas now shown shall be eliminated and landscaping substituted. The C.C & R.s shall contain a provision prohibiting the keeping of trash containers in view of the Drivate drive, garage access or landscaped areas. 10. All landscaped areas shall be separrated from vehicular areas by a 6" high, 6" wide Portland Concrete Cement curb. 11. Condition 2 of the previous map approval is hereby removed. 12. The C.C.& R.s shall prohibit the storage of recreational vehicles on-site except those used as a primary or secondary vehicle, then they must be stored in a garage.
