A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY CALIFORNIA
APPROVING VARIANCE 81-01
FOR A SETBACK OF 1 FOOT, 6 INCHES FOR A BUILDING CANOPY
AND 10 FEET, 0 INCHES FOR A BUILDING
FOR POWAY SQUARE LIMITED ON POWAY ROAD AND COM/~ONITY ROAD

WHEREAS, the City Council has held a duly advertised public hearing on
September 1, 1981 to solicit and consider comments pro and con from the
public relative to said above referenced applicantion,
NOW, THEREFORE, the City Council of the City of Poway does hereby
resolve as follows:
Section 1: Findings

That there are special circumstances applicable to the pro-
perty, (size, shape, topography, location or surroundings) or
the intended use of the property, and because of this the
strict application of the zoning ordinance deprives the
property of privileges enjoyed by other properties in the
vicinity under identical zoning classification.

That granting the variance or its modification is necessary
for the preservation and enjoyment of a substantial property
right possessed by other 9roperty in the same vicinity and
zone and denied to the property for which the variance is
sought; and

That granting the variance or its modification will not be
materialy detrimental to the public health, safety or wel-
fare, or injurious to the property or improvements in such
vicinity and zone in which the property is located; and

The granting of this variance does not constitute a special
privilege inconsistent with the limitations upon other pro-
perties in the vicinity and zone in which such property is
situated.
The grantiing of this variance does not allow a use or
activity which is not otherwise expressly authorized by the
zoning regulation governing the parcel of property.

That granting the variance or its modification will not be
incompatible with the Poway City General Plan.
Section 2: Variance 81-02 is hereby apDroved for a 1 foot, 6 inch
setback from the building canopy to the property line; and a 10
foot, 0 inch front setback from the property line to the building
subject to the following conditions.

Development Review approval shall be accomplished prior to
the issuance of a building permit for the new 3,000 square
foot building, and remodel of existing shops. The design of
the 3,000 square foot building and remodel of existing shops
shall be a continuation of the new Safeway Center, in not
only design but landscaping, parking and signinq.
APPROVED and ADOPTED by the City Council of the City of Poway, State of
California, this 1st day of September, 1981.
