A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING TENTATIVE PARCEL MAP 17183
ASSESSOR'S PARCEL NUMBER 321-180-50
WHEREAS, Tentative Parcel Map No. 17183, hereinafter "Map" submitted by
Hiatt/Vahidi, applicant, for the purpose of subdividing the real property
situated in the City of Poway, County of San Diego, State of California,
described as Lot D of Belvedere Estates, Unit No. I, Map 4015 into four (4)
lots, regularly came before the City Council for public hearing and action
on October 6, 1981; and,
WHEREAS, the Director of Planning Services has recommended approval of
the Map subject to all conditions set forth in the Planning Services
Department report; and
WHEREAS, the City Council has read and considered said report and has
considered other evidence presented at the public hearing.
NOW, THEREFORE, the City Council of the City of Poway does resolve as
follows:
Section 1: Findings:
The City Council makes the following findings in regard to Tentative
Parcel No. 17183 and the Map thereof:
a. The tentative parcel is consistent with all applicable
general and specific plans;
b. The design or improvements of the tentative parcel is
consistent with all general and specific plans;
c. The site is physically suitable for the type of development
proposed;

The design of the subdivision is not likely to cause
substantial environmental damage and avoidable injury to
humans and wild life or their habitat;
The tentative parcel is not likely to cause serious public
health problems;

The design of the tentative tract will not conflict with any
easement acquired by the public at large, now of record, for
access through or use of the property within the proposed
subdivision.

That this project will not create adverse impacts on the
environment and a Conditional Negative Declaration is issued
(Exhibit A). The Conditions are contained within Exhibit
B--specifically mitigating traffic circulation (see
Condition C, and schools (see Condition K-4), and
landscaping/erosion control (see Condition K-7), and local
drainage (see Condition K-9 and 10),
SECTION 2: Tentative Tract Map No. 17183, a copy of which is on
file in the Planning Services office, is hereby approved subject
to all of the attached conditions(Exhibit B).
APPROVED and ADOPTED by the City Council of the City of Poway,
State of California, this 6th, of October, 1981.

Pursuant to the provisions of the Californla Environmental Quality Act
of 1970, the City of Poway has determined that the above project will
not have a significant effect upon the environment. An Environmental
Impact Report will not be required.
Minutes of such decision and the Initial Study prepared by the City of
Poway are on file in the Department of Planning Services of the City. of
Poway.
This decision of the City Council of the City of Poway is final.
This Negative Declaration is subject to the implementation of mitigat-
ing measures (if any) as listed on the attachments.

ACCESS ROADS (Offsite)
The subdivider shall furnish to the Department of Public Services recorded
documentation showing that the land division is connected to a publicly
maintained road by an easement for road purposes. This easement shall be 52
feet wide, and shall be for the benefit and use of the property being
divided. Recordation data for said easement shall be shown on the Parcel
Map. This requirement applies to offsite access to all proposed parcels.
DEDICATIONS
Make irrevocable offers of dedication for the right-of-way required
for 52-foot wide road easements plus the right to construct and
maintain slopes and drainage improvements as required beyond the 52-
foot limit.
C. BRIDGE AND MAJOR THOROUGHFARE CONSTRUCTION FUND

Prior to recordation of the Parcel Map, the developer shall place a
$1,374.00 deposit in the Bridge and Major Thoroughfare Construction Fund
for the City of Poway to mitigate this development's traffic impact on
existing and future Circulation element roads in the City of Poway.
MISCELLANEOUS
The developer shall obtain access rights into Donart Drive as shown on Map
4015. The Director, Department of Public Services will recommend the City
of Poway accept previously rejected offer of dedication.
ROAD
1.
IMPROVEMENTS (Private)
The onsite private easement road to each parcel shall be constructed
within the easement. It shall be a graded and well-drained road with a
graded width of 52', improvement width of 32', P.C.C. curbs and gutters
and surfacing of 3" of A.C. over approved base. Grades of over 25
percent are not allowed. Ail fill must be compacted to not less than
90 percent.
Dip sections and culverts shall be designed by a registered civil
engineer to handle a 15-year storm. Dip sections shall be designed for
a maximum water depth of 10" based on a 15-year storm and the formula
"Depth in feet X velocity in feet per second is equal to 6 or less." A
sketch of the dip section showing the above dimensions and the
calculations shall be submitted with the deposit noted below.

The entire dip area must have a concrete slab with a minimum width of 2
feet wider than the required graded width but no wider than the
required easement, 6" thick, 5-1/2 sacks of cement per cubic yard and
10 x 10 x %9 wire mesh. Cutoff walls, 6" wide and 2' deep, on both
upstream and downstream sides of the dip and along the entire length of
the dip are required. Cold mix may be used if the flow is less than 5
cfs. and the velocity is less than 2 fps., A.C. hot mix may be used if
the flow is less than 20 cfs. and the velocity is less than 5 fps.
A registered civil engineer shall prepare and submit a sketch of the
private easement road improvements to the Department of Public
Services. The sketch shall show the graded width required, all drainage
improvements with their approximate locations, signed calculations and
a copy of a 200 scale topo map with the drainage areas outlined.
Calculations based upon the Ordinance criteria to determine the
graded width shall be submitted to the Director, Department of Public
Services for approval.
A deposit of $300.00, two prints of the Tentative Parcel Map and a copy
of the Resolution of Approval will be forwarded to the Department of
Public Services along with above sketch and any drainage calculations,
to cover the cost of a inspection of the required private easement road
improvements. The applicant shall reimburse the Department of Public
Services for any costs in excess of the deposit prior to recording of
the Parcel Map or prior to the recording of the Notice of Completion.
Any unused portion of the deposit will be returned.
A registered civil engineer or a licensed land surveyor shall provide a
signed statement that: "The private easement road to Donart Drive are
constructed within the easements.
A grading permit will be required prior to commencement of the grading
if the grading meets the criteria of Section 87.201 of the City Code.
The above sketch and $300.00 deposit will not be required if a grading
permit is obtained.
A permit shall be obtained from the Department of Public Services for
the improvements to be made within the public right-of-way. The
connection of the private easement road to the City road will have to
match the construction of the City road. A copy of the permit and
evidence from the issuing agency, that all the requirements of the
permit have been met, shall be submitted to the Department of Public
Services with the Engineer's or Surveyor's statement.
In the event these improvements are deferred, the subdivider shall
execute such documents as deemed necessary by the Director of Public
Services indemnifying the City of Poway from liability arising from the
improvement of any offsite easement. This indemnification shall also
be noted on the Parcel Map.

The subdivider shall enter into a private road maintenance agreement
in the form adopted by the Poway City Council as Resolution 99 and to
the satisfaction of the City of Poway.
F. UTILITY EASEMENTS
Where all of the proposed parcels of the land division are not on a public
street, the subdivider shall provide the Director of Public Services with
letters from the serving utility companies stating that arrangements
satisfactory to the utility have been made to serve all parcels being
created. No letter will be required from the Pacific Telephone Company.
FLOODING/DRAINAGE
The subdivider shall contribute $4800.00 to the City of Poway Drainage
Fund.
SEWERAGE/WATER
1. Prior to the approval of the Parcel Map, water service commitment
shall be obtained.
Certification by the Public ~ealth Department with respect to sewage
disposal shall be shown on the Parcel Map.
2. The developer shall install a minimum water supply pipe to serve this
minor subdivision in accordance with the standards of the Poway Public
Services Department.
FIRE PROTECTION
A fire hydrant together with an adequate water supply shall be provided in
accordance with the specifications of the Poway Fire Department.

SOLAR ACCESS
The following note shall apear on the Parcel Map:
All lots within this subdivision have a minimum of 100 square feet of
solar access for each future dwelling/co~m~ercial/industrial/unit allowed by
this Subdivision.

K. OTHER REQUIREMENTS
Zoning regulations require that each parcel shall contain a minimum net
area of one acre. If, as a result of survey calculations, required
easements or any other reason, the area of any parcel shown on this
Tentative Parcel Map is determined by the Department of Public Services
to be below the zoning minimum, it becomes the responsibility of the
subdivider to meet zoning requirements by lot redesign, variance or
other applicable technique. ~he subdivider must comply with the zoning
area requirements in full before the Department of Public Services may
file a Parcel map with the County Recorder.
Prior to the approval of the Parcel Map the subdivider shall provide
the Department of Public Services with a copy of the deed by which the
subject property was acquired.
At the time of recordation of the Parcel Map, the name of the person
authorizing the map and whose name appears in the SURVEYOR'S
CERTIFICATE as the person who requested the map, shall be the name of
the owner of the subject property and shall be the same party or
parties as shown on the Tentative Parcel Map unless the Poway City
Council has approved the substitution of a successor in interest to
such party or parties.
The subdivider shall enter into agreements with the Poway Unified
School District in a form satisfactory to the City of Poway City
Council, which agreements shall provide for payments to the District
of such sums of money or other consideration which the City determines
will mitigate the impact of the subdivision upon said District.
Assessor Parcel Number 321-140-15 shall be shown on the Parcel Map as
a portion of Parcel 3.
The subdivider shall deposit fees with the City Clerk, or guarantee
payment of fees as may be required pursuant to Sections 810.106 and
810.107 of the City Park Lands Dedication.
Landscaping/Erosion Control: The applicant shall submit a landscape
plan prior to issuance of grading that incorporates drought resistant
non-invasive native and exotic species. This plan shall be to the
satisfaction of the Director of Planning Services. Bond or cash
deposit quarantying the maintenance of said landscaping to be paid to
the City until said landscaping is established.

Prior to the recordation of the final map, the applicant shall prepare
or cause to be prepared a hydrology study to determine the quantity of
water generated by this development and to propose a solution to the
downstream drainage problem at Melody Lane and Mark Stevens Road.
The applicant shall submit, prior to the recording of final map, his
prorata share of the costs of said drainage solution proposed by
Condition L9.
