P-81-10 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING TENTATIVE PARCEL MAP 17253 ASSESSOR'S PARCEL NUMBER 314-031-15 & portion of 24 W~EREAS, Tentative Parcel Map No. 17253, hereinafter "Map" submitted by Roger Mohling , applicant, for the purpose of subdividing the real property situated in the City of Poway, County of San Diego, State of California, described as Ail of Parcel 14 and a Portion of Parcel 2 of Parcel Map 5883, Sec. 1, Township 14 SWth, Range 2 West, San Bernardino Base and Meridian, According to USGS County of San Diego, State of California into 4 lots, regularly came before the City Council for public hearing and action on October 6, , 1981; and WHEREAS, the Director of Planning Services has recomended approval of the Map subject to all conditions set forth in the Planning Services Department report; and WHEREAS, the City Council has read and considered said report and has considered other evidence presented at the public hearing. NOW, THEREFORE, the City Council of the City of Poway does resolve as follows: Section 1: Findings: The City Council makes the following findings in regard to Tentative Parcel No. 17253 and the Map thereof: ae The tentative parcel is consistent with all applicable interim and proposed general and specific plans; be The design or improvements of the tentative parcel is consistent with all applicable interim and proposed general and specific plans; c. The site is physically suitable for the type of development proposed; The design of the subdivision is not likely to cause substantial environmental damage and avoidable injury to humans and wild life or their habitat; e. The tentative parcel'is not likely to cause serious public health problems; CITY OF POWAY NEGATIVE DECLA~TION Brief Description of Project: Division of 15.9i+ acres into 4 lots in the A-70-4 zone, located..25 miles from the terminus of Del Pointe Road. Name and Address of Applicant: Roger E. Mohling 13907 York Avenue Poway, CA 92064 3. Pursuant to the provisions of the California Environmental Quality Act of 1970, the City of Poway has determined that the above project will not have a significant effect upon the environment. An Environmental Impact Report will not be required. 4. Minutes of such decision and the Initial Study prepared by the City of Poway are on file in the Department of Planning Services of the City of Poway. 5. This decision of the City Council of the City of Poway is final. 6. This Negative Declaration is subject to the implementation of mitigat- ing measures (if any) as listed on the attachments. Dated: October 7, 1981 '~way EXHIBIT A CO)iDITI Oils Mohling The following conditions must be complied with before a parcel map is approved by the Department of Public Services and recorded. ROADS (Offsite) The sudvidider shall furnish to the Department of Public Services recorded documentation showing that the land division is connected to a publicly maintainted road by an easement for road purposes. This easement shall be 52 feet wide, and shall be for the benefit and use of the property being divided. Recordation data for said easement shall be shown on the Parcel Map. This requirement applies to offsite access to all proposed parcels. Easement "B" as shown on the revised map (per boundary adjustment) shall be relocated to the southern property line of Parcel 4. ROAD DKD'r(~AT~'OHS Make irrevocable offers of dedication for the right-of-way required for 52-foot wide road easement plus the right to construct and maintain slopes and drainage improvements as required beyond the 52-foot limit for 1/2 of the reach of the road and 26 foot for the remaining reach of the road. UTTL'rTY BASEMEliT 40 Where private easement roads are not being dedicated, or where each of the proposed parcels is not on a public street, the developer shall provide Director, Department of Public Services with letters from serving utility companies stating arrangements satisfactory to utility have been made to serve all parcels being created. No letter will be required from the Pacific Telephone Company. REQUIREMENTS The subdivider shall grant to the City of Poway an equistrian- trail easement for public use. Said easement shall be 15' wide and located at the Northern boundary line of Parcels 1 and 2, running east to west over the entire length of said parcels. EXHIBIT Cond it ions Page 2 Mohling 6e The offsite private road easement is required to be improved. In the event these improvements are deferred, the subdivider shall execute such documents as deemed necessary by the Director, Department of Public Services indemnifying the City of Poway from liability arising from the improvement of any offsite easement. This indemnification shall also be noted on the Final Parcel Map. 7o The developer shall place a cash deposit in the Bridge and Major Thoroughfare Construction Fund for Poway to mitigate this development's traffic impact on existing and future Circulation Element roads in Poway. The deposit is approximately $ 1,374.00 based upon data supplied on the Tentative Parcel Map. The actual deposit will be based upon the calculated areas determined for the Parcel Map. LPLOODYH~/DRATBAGE The subdivider shall contribute $6280.00 to the Poway Drainage Fund as his/her share of future master planned flood control/drainage improvements. 9e The following improvements may be completed prior to recording of a parcel map or they must be listed on the parcel map and the subdivider shall execute a "Covenant of Improvement Requirements" which shall list the conditions that remain to be completed. The covenant shall be recorded by the Department of Public Services prior to recording the parcel map. The covenant shall be noted on the parcel map. 10. If a covenant has been recorded, no building permit, and no further grant of approval for development may be issued until the applicant presents a copy of the Release of Improvement Requirements recorded by the Department of Public Services, stating all of the required improvements listed in the Covenant of Improvement Requirements and noted on the parcel map have been complied with, except a grading or construction permit and/or a permit to install utilities within the private easement, may be issued. EXHIBIT F3 Conditions Page 3 Mohling ROAD YMPROV F.I(.RlgTS 11. Onsite private easement roads to each parcel shall be constructed within the easement. Easement "A" shall be a graded and well- drained road with a graded width of 52', improvement width of 28', and surfacing of 3" of A.C. over approved base. Grades of over 25 percent are not allowed. All fill must be compacted to not less than 90 percent. Easement "B" shall be a paved width of 16' with asphalt or better at grades not to exceed 15%. Ail onsite roads regardless of percent of grade whall be paved. The subdivider shall enter into a private road maintenance agreement in the form adopted by the Poway City council as Resolution 99 and to the satisfaction of the City of Poway. 12. A registered civil engineer or a licensed land surveyor shall provide a signed statement that: "The private easement roads from Parcels 1 and 3 to the nearest publicly maintained road are constructed within the easements. 13. Dip sections and culverts shall be designed by a registered civil engineer to handle a 15-year strom. Dip sections shall be designed for a maximum water depth of 10" based on a 15-year storm and the formula "Depth in feet X velocity in feet per second is equal to 6 or less." A sketch of the dip section showing the above dimensions and the calculations shall be submitted with the deposit noted below. 14. The entire dip area must have a concrete slab with a minimum width of 2 feet wider than the required improved graded width but no wider than the required easement, 6" thick, 5-1/2 sacks of cement per cubic yard and 10x10x~9 wire mesh. Cutoff walls, 6" wide x 2' deep, on both upstream and downstream sides of the dip and along the entire length of the dip are required. Cold mix may be used if the flow is less than 5 cfs. and the velocity is less than 2 fps., A.C. hot mix may be used if the flow is less than 20 cfs. and the velocity is less than 5 fps. A registered civil engineer shall prepare and submit a sketch of the private easement road improvements to the Department of Public Services. ~he sketch shall show the graded width required, all drainage improvements with their approximate locations, signed calculations and a copy of a 200 scale topo map with the drainage areas outlined. Calculations based upon the ordinance criteria to determine the graded width shall be submitted to the Director, Department of Public Services, for approval. 16. A deposit of $300.00, two prints of the Tentative Parcel Map and a copy of the Final Notice of Approval will be forwarded to the Department of Public Services along with above sketch and any drainage calculations. The deposit is to cover the cost of a inspection of the required private easement road improvements. The applicant shall reimburse the Department of Public Services for any costs in excess of the deposit prior to recording of the Parcel Map or prior to the recording of the Notice of Completion. Any unused portion of the deposit will be refunded. 17. A grading permit will be required prior to commencment of the grading if the grading meets the criteria of Section 87.201 of the City Code. The above sketch and $300.00 deposit will not be required if a grading permit is obtained. 18. A permit shall be obtained from the Department of Public Services for the improvements to be made within the public right of way. The connection of the private easement road to the road will have to match the construction of the road. A copy of the permit and evidence from the issuing agency that all requirements of the permit have been met, shall be submitted to the Department of Public Services. 19. Domestic and irrigation water to serve Parcel (s) No. 1, 2 and 4 is presently available from an existing water main in portions of Easement "A". The applicant shall be required to provide domestic service to Parcel No. 3 as an extension from City facilities in accordance with City Standards. Fire hydrant for Tentative Parcel map No. 17253 shall be located in accordance with City Standard Specifications for Fire ~ydrant Assemblies dated 6/20/80. · wo-way (one 2-1/2 inch and one 4 inch hose outlets) steamer type: Clow Model 850, james Jones No. J-3700, Long Beach Iron Works Model 425, or approved equal. Satisfaction of the requirement for fire hydrant would necessitate extension of facilities to City's standards by the owner in accordance with Section 13 of Rules & Regulations Governing Water Service to provide fire flow requirements.
