P-81-18 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING TENTATIVE PARCEL MAP 17006 ASSESSOR'S PARCEL NUMBER 323-030-12 WHEREAS, Tentative Parcel Map No. 17006, hereinafter "Map" submitted by John R. and Kathryn g. Voris, applicant, for the purpose of subdividing the real property situated in the City of Poway, County of San Diego, State of California, described as Lot 7 of Record of Survey map No. 3888 into four (4) lots, regularly came before the City Council for public hearing and action on October 27, 1981; and WHEREAS, the Director of Planning Services has recommended approval of the Map subject to all conditions set forth in the Planning Services Department report; and WHEREAS, the City Council has read and considered said report and has considered other evidence presented at the public hearing. NOW, THEREFORE, the City Council of the City of Poway does resolve as follows: Section 1: Findings: The City Council makes the following findings in regard to Tentative Parcel No. 17006 and the Map thereof: a. The tentative parcel is consistent with all applicable interim and proposed general and specific plans; The design or improvements of the tentative parcel is consistent with all applicable interim and proposed general and specific plans; Ce The site is physically suitable for the type of development proposed; The design of the subdivision is not likely to cause substantial environmental damaqe and avoidable injury to humans and wild life or their habitat; e. The tentative Darcel is not likely to cause serious public health problems; Resolution No. P81-18 TPM 17006 - Voris Page 2 The design of the tentative parcel will not conflict with any easement acquired by the public at large, now of record, for access through or use of the property within the proposed sub- division. That this project will not create adverse impacts on the environ- ment if the mitigation measures listed under Conditions C and I-1 are complied with and a Conditional Negative Declaration is issued. Section 2: Tentative Parcel Map No. 17006, a copy of which is on file in the Planning Services office, is hereby approved subject to all of the following conditions which must be complied with before a Parcel Map is approved by the Poway City Council and filed with the County Recorder of San Diego County: A. ACCESS ROADS (Offsite) The developer shall relinquish access rights into Garden Road (SA770) except for one ten-foot wide driveway opening for Parcel 1. A single ten-foot wide driveway may provide access to Parcel from the 28 foot private easement. A turnaround driveway on Parcel 4 must be provided as part of the building plans submitted for Minor Development Review. Resolution No. P81-18 TPM 17006 - Voris Page 3 B. ULTIMATE ROAD WIDTHS Prior to preparation of the Parcel Map, the engineer or surveyor pre- paring the map shall contact the Department of Public Services to determine the desired location of the centerline for Garden Road (SA770) which is shown on the Circulation Element of the City C~neral Plan as a Major Highway. The following shall be shown on the Parcel Map: The location of the centerline of the road as approved by the Director of Public Services. The width of the right-of-way which is 56 feet from the centerline and identified by a line drawn at the appropriate location and labeled "Limit of Proposed Street Widening". A building line which is 71 feet from the centerline of the road identified by a line drawn at the appropriate location and labeled "Building Line". C. BRIDGE AND MAJOR THOROUGHFARE CONSTRUCTION FUND Prior to recordation of the Parcel Map, the developer shall place a $1030.00 deposit with the City of Poway to mitigate this development's traffic impact on existing and future Circulation Element roads. D. ROAD IMPROVEMENT DISTRICT COVENANT The subdivider shall sign a covenant agreeing not to oppose the forma- tion of a road improvement district. E. ROAD EASEMENTS Private road easements shall be shown on the Parcel Map: A 28-foot private road easement shall be provided along the easterly boundary of Parcels 2, 3, and 4. ROAD IMPROVEMENTS (Public) Garden Road (SA770) shall be improved to a one-half graded width of 35 feet with concrete curb, gutter and AC pavement over approved base. Face of curb will be 32 feet from centerline. Improvement plans shall be prepared by a registered civil engineer and submitted to the Director of Public Services. The following items shall also apply: Street alignment and grade, including the change of any existing or proposed street alignment and grade, as required by the Director of Public Services. Construct a drainage system capable of handling and disposing of all surface waters originating within the land division and all surface waters that may flow onto the land division from adjacent lands. Said drainage system shall include any easements and structures required by the Director of Public Services to properly handle the drainage. Improve all drainage easements by culvert or drainage channel of adequate size, whichever is required by the Director of Public Services. Any required drainage channel shall be lined with a suitable material as specified by the Director of Public Services. All such drainage easements shall be monumented along property lines at locations approved by the Director of Public Services. An access easement shall be provided to each drainage system maintenance access point not directly accessible from a public roadway. Such access easement to be improved, fenced and aligned to the satisfaction of the Director of Public Services. 4m The installation of all underground utilities shall be completed before surfacing the streets and installing concrete curbs, gutters and sidewalks. This is not intended to include the undergrounding of existing overhead utilities. 5. Portland cement concrete cross gutters shall be required where water crosses the roadways. Resolution No. P -81-18 TPM 17006 - Voris Page 5 70 10. The exact depth of imported base material to be based on soil tests approved by the Director of Public Services. The installation of all street name signs. A street safety lighting system conforming to City of Poway Standards, to be installed at no cost to the public. There shall be deposited with the City of Poway, through the Director of Public Services, a cash deposit sufficient to: Energize, maintain, and operate the street lighting system until revenues begin to accrue from the land division for those purposes. be Augment the Reserve Fund of the existing District by an amount equal to three month's operating cost of the subdivision. Augment the C~ntingency Fund by one month's operating costs. Pay the cost of annexation including the cost of processing through the State Board of Equalization. The land division shall be annexed, without notice or hearing, to an existing special district to operate and maintain the system. Sight distance requirements at all intersections shall conform to the intersectional sight distance criteria as provided by the American Association of State ~i~hway Officials in the publication "Geometric Design for Local Roads and Streets - 1971" or as revised. That the plans and specifications for the improvement of all streets, riqhts-of-way, drainage easements and all culverts, drainage structures and drainage channels and all private easements meet with the approval of the Director of Public Services. IMPROVEMENTS (Private) The subdivider shall enter into a private road construction and maintenance agreement to insure that private roads will be main- tained to standards prescribed by law. The private easement road from parcel 4 to Garden Road be con- structed within the easement. It shall be a graded and well- drained road with 3" of A.C. over approved base with improvement width of 28 feet and surfacing equal to or greater than that determined by the standards under Section 81.703(b)(1) of the City code. Grades of over 25 percent are not allowed. All fill must be compacted to not less than 90 percent. Dip sections and culverts shall be designed by a registered civil engineer to handle a 15-year storm. Dip sections shall be design- ed for a maximum water depth of 10" based on a 15-year storm and the formula "Depth in feet X velocity in feet per second is equal to 6 or less." A sketch of the dip section showing the above dimensions and the calculations shall be submitted with the depo- sit noted below. The entire dip area must have a concrete slab with a minimum width of 2 feet wider than the required graded width but not wider than the required easement, 6" thick, 1-1/2 sacks of cement per cubic yard and 10 x 10 x ~9 wire mesh. Cutoff walls, 6" wide and 2' deep, on both upstream and downstream sides of the dip and along the entire length of the dip area required. Cold mix may be used if the flow is less tha 5 cfs. and the velocity is less than 2 fps., A.C. hot mix may be used if the flow is less than 20 cfs. and the velocity is less than 5 fps. A registered civil engineer shall prepare and submit a sketch of the private easement road improvements to the Department of Public Services. The sketch shall show the graded width required, all drainage improvements with their approximate locations, signed calculations and a copy of a 200 scale topo map with the drainage areas outlined. Resolution No. P-81-18 TPM 17006 - Voris Page 7 A deposit of $300.00, two prints of the Tentative Parcel map and a copy of the Final Notice of Approval will be forwarded to the City Department of Public Services along with above sketch and ~ any drainage calculations. The deposit is to cover the cost of a City inspection of the required private easement road improvements. The applicant shall reimburse the Department of Public Services for any costs in excess of the deposit prior to recording of the Parcel Map or prior to the recording of the Notice of Completion . Any unused portion of the deposit will be refunded. A registered civil engineer or a licensed land surveyor shall provide a siqned statement that: "The private easement road from Parcel 4 to Garden Road is constructed within the easement." A gradinq permit will be ~equired prior to commencement of the~ qrading if the grading meets the criteria of Section 87.201 of~ the City Code. The above sketch and $300.00 deposit will not be required if a grading permit is obtained. A permit shall be obtained from the Department of Public Services for the improvements to be made within the public right-of-way. The connection of the private easement road to the City road will have to match the construction of the City road. A copy of the permit and evidence from the issuinq agency, that all the requirements of the permit have been met, shall be submitted to the Department of Public Services with the Engineer's or Surveyor's statement. In the event these improvements are deferred, the subdivider shall execute such documents as deemed necessary by the Director of Public Services indemnifying the City of Poway from liability arisinq from the improvement of any offsite easement. This indemnification shall also be noted on the Parcel Map. Resolution No. P81-18 TPM 17006 - Voris Page 8 H. UTILITY EASEMENTS Where private easement roads are not being dedicated or where all of the proposed parcels of the land division are not on a public street, the subdivider shall provide the Director of Public Services with letters from the serving utility companies stating that arrangements satisfactory to the utility have been made to serve all parcels being created. No letter will be required form the Pacific Telephone Company. I. FLOODING/DRAINAGE The subdivider shall contribute $1338 to the City of Poway Master Plan of Drainage Fund as his/her share of future area flood control/drainage improvements per Ordinance No. 5856 (N.S.). Grant an access easement if necessary at no more than the westerly 10 feet of the property to the City of Poway to the satisfaction of the Director of Public Services. J. SEWERAGE/WATER 1. Certification by the Public Health Department with respect to water supply and sewage disposal shall be shown on the Parcel Map. The developer shall install a minimum water supply pipe to serve this minor subdivision in accordance with the standards of the Poway Department of Public Services. K. FIRE PROTECTION A fire hydrant together with an adequate water supply shall be provided in accordance with the specifications of the Poway Department of Public Services and City Standards in the vicinity of the common boundary of Parcel 2 and 3 and the private easement road. SOLAR ACCESS The following note shall appear on the Parcel Map: Ail parcels within this subdivision have a minimum of 100 square feet of solar access for each parcel and for each future building site within this subdivision as required by Section 81.401(n) of the Sub- division Ordinance. SETBACKS The applicant shall submit a variance application to the Director of Planning Services for a reduction in the exterior sideyard setback for the existing residence on Parcel 1 prior to recorda- tion of the Parcel Map. Said application fee is hereby waived. N. OTHER REQUIREMENTS 4e Zoning regulations require that each parcel shall contain a mini- mum net area of 6000 sq. ft. If, as a result of survey calcula- tions, required easements or any other reasons, the area of any parcel shown on this Tentative Parcel Map is determined by the Department of Public Services to be below the zoning minimum, it becomes the responsibility of the subdivider to meet zoning requirements by lot redesign, or other applicable technique. The subdivider must comply with the zoning area requirements in full before the Department of Public Services may file a Parcel Map with the County Recorder. Prior to the approval of the Parcel Map the subdivider shall provide the Department of Public Services with a copy of the deed by which the subject property was acquired. At the time of recordation of the Parcel Map, the name of the person authorizing the map and whose name appears in the SURVEYOR'S CERTIFICATE as the person who requested the map, shall be the name of the owner of the subject property and shall be the same party or parties as shown on the Tentative Parcel Map unless the Poway City Council has approved the substitution of a successor in interest to such party or parties. Existing barns and sheds shall be removed unless evidence is provied that they are not within the road easement or setback area. Resolution No. P -81-18 TPM 17006 - Voris Page l0 Conditions G-l, J-2 and K may be complied with.either prior to or after the approval of a Parcel Map. ~owever, these conditions must be complied with prior to the issuance of a~ building permit or other grant of approval for development, including further division, for any parcel created by the Parcel Map. If the conditions listed in the above paragraph have not been complied with prior to approval of the Parcel Map by the City Council , such conditions shall be noticed on the Parcel Map by a certificate acceptable to the Department of Public Services. In addition, the subdivider shall execute a "Covenant of ImDrovement Requirements" listing those Conditions noticed on the Parcel Map that have not been complied with. This Covenant shall be recorded by the City Clerk prior to the approval of the Parcel Map. The Covenant shall be noted on the Parcel Map. If a Covenant has been recorded, no buildinq permit may be issued or no further division may be approved for any parcel created by the approved Parcel Map unless and until the applicant presents a copy of a Release of Improvement Requirements, recorded by the City Clerk, stating that all the imDrovements listed in the Covenant of Improvement Requirements and noticed on the Parcel Map have been completed to the satisfaction of the Department of Public Services, except a grading or construction permit and/or a permit to install utilities within the private easement, may be issued. The Poway City Council has determined that, for reasons of public safety and as a necessary prerequisite to the orderly develo?ment of the surrounding area, Conditions F and I-1 should be complied with prior to approval of the Parcel Map or within a reasonable time followinq such approval. If any of these conditions are to be met following approval, a secured agreement must be executed with the City of Poway prior to the recordation of a Parcel Map. Such agreement requires postinq security in the form of a cash deposit, or instrument of credit, or irrevocable letter of credit valued at or more than estimated improvement cost. Resolution No. P81-18 TPM 17006 - Voris Page 11 It also requires the improvements be completed within 24 months from the date of recording the Parcel Map, and prior to the issuance of a permit or other grant of approval for the develop- ment of a parcel created by this map, except building and associated permits can be issued requiring the completion of public improvements prior to occupancy of the building. The subdivider shall deposit fees in the amount of $600.00 with the City Clerk, or guarantee payment of those fees as may be required pursuant to Sections 810.106 and 810.107 of the City Park Lands Dedication. The subdivider shall enter into agreements with the Poway Unified School District in a form satisfactory to the City of Poway City Council, which agreements shall provide for payments to such District of such sums of money or other considerations which the District determines will mitigate the impact of the subdivision upon said District. 9e The developer shall participate in the cost of traffic signal installation at the intersection of Poway Road (SF729) at Garden Road (SA770). ~ne amount of the developer's portion of the entire cost of the signal shall be $132. 10. A minimum 20 foot by 20 foot Portland Concrete Cement pad for parking shall be provided on all parcels.
