A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING TENTATIVE PARCEL MAP 17082
ASSESSOR'S PARCEL NUMBER 321-180-68
WHEREAS, Tentative Parcel Map No. 17082, hereinafter "Map", submitted
by Richard and Helen Gilbert and Parviz Tabatabaeeepour, applicant, for the
purpose of subdividing the real property situated in the City of Poway,
County of San Diego, State of California, described as Parcel 2 of PM 9919
into four (4) lots, regularly came before the City Council for public
hearing and action on November 10, 1981; and
WHEREAS, the Director of Planning Services has recommended approval of
the Map subject to all conditions set forth in the Planning Services
Department report; and
WHEREAS, the City Council has read and considered said report and has
considered other evidence presented at the public hearing.
NOW, THEREFORE, the City Council of the City of Poway does resolve as
follows:
Section 1: Findings:
The City Council makes the following findings in regard to Tentative
Parcel No. 17082 and the Map thereof:

The tentative map is consistent with all applicable interim
and proposed general and specific plans;
The design or improvements of the tentative map is consis-
tent with all applicable interim and proposed general and
specific plans;
The site is physically suitable for the type of development
proposed;
The design of the subdivision is not likely to cause substan-
tial environmental damage and avoidable injury to humans and
wild life or their habitat;
e. The tentative map is not likely to cause serious public
health problems;
The design of the tentative map will not conflict with any
easement acquired by the public at large, now of record, for
access through or use of the property within the proposed
subdivision.

The Draft Environmental Impact Report is hereby certified as
complete and in compliance with the provisions of the Calif-
ornia Environmental Quality Act; and that changes or altera-
tions have been required as conditions or incorporated into
project design, which mitigate the significant impacts ident-
ified in the Draft Environmental Impact Report.
Section 2:
Tentative Parcel Map No. 17082, a copy of which is on file in the
Planning Services office, is hereby approved subject to all of the
following conditions:
A. Said tentative map is hereby approved pursuant to the City of
Poway Subdivision Ordinance and no waiver of any requirement
of said Ordinance is intended or implied except as specif-
ically set forth in this resolution as follows:

Section 81.702 which does not permit panhandle-
shaped or flag-shaped lots except where necessary
because of ususual conditions of tertian;
The approval of this tentative parcel map expires on May 10,
1983 at 5:00 p.m. The parcel map conforming to this condi-
tionally approved tentative parcel map shall be filed with
the City Council in time so that said Council may approve the
map before this approval expires unless prior to that date
the Council subsequently grants a one-year time extension for
obtaining such approval of said parcel map as provided by the
Subdivision Ordinance.
Said tentative parcel map of the proposed subdivision is
approved subject to the following conditions which shall be
complied with before a parcel map thereof is approved by the
City Council and filed with the County Recorder of San Diego
County
ACCESS ROADS (Offsite)
a. The subdivider shall furnish to the Department of
Public Servies recorded documentation showing that
the land division is connected to a publicly main-
tained road by an easement for road purposes. This
easement shall be 40 feet wide, unless proof is
furnished that a lesser width is applicable under
Section 81.703(B)(1) (2) of the Code and shall be
for the benefit and use of the property being
divided. Recordation data for said easement shall
be shown on the Parcel Map. This requirement
applies to offsite access to all proposed parcels.

2. ROAD DEDICATIONS
Make an irrevocable offer of dedication for the
rights-of-way required to complete a 30-foot wide
one-half right-of-way width on each side of the
ultimate centerline (minimum 200; radius) plus the
right to construct and maintain slopes and drainage
improvements as required beyond the limit for
Ramin/Adrian Road.

right-of-way required to complete a 40-foot wide,
right-of-way width plus the right to construct and
maintain slopes and drainage improvements as
required beyond the 40-foot wide, right-of-way
width plus the right to construct and maintain
slopes and drainage improvement as required beyond
the 40-foot limit from the westerly boundary of the
land division to Eastern Street, (minimum
centerline radius 200'), for the extension of
Ramin/Adrian Road.
3. BRIDGE AND MAJOR THOROUGHFARE CONSTRUCTION FUND
Prior to recordation of the Parcel Map, the developer
shall place a $1,374.00 deposit with the City of Poway
to mitigate this development's traffic impact on exist-
ing and future Circulation Element roads.
4. ROAD EASEMENTS
A 40-foot private road easement shall be proposed along
and centered on the above irrevocable offers of dedica-
tion.
5. ROAD IMPROVEMENTS (Private)

The onsite private easement road to each parcel
shall be construct within the easement. They shall
be graded and well-drained roads with graded width,
improvement width and surfacing equal to or greater
than that determined by the standards under Section
81.703(b) of the City Code. Grades of over 15
percent are not allowed. All fill must be compact-
ed to not less than 90 percent. Adrian Street will
ultimately be improved to a minimum public street
standard of 32 feet in width. The applicant shall
install a 20foot wide street with curb and gutter.
The applicant shall also provide a 30-foot radius
cul-de-sac at the easterly terminus of Adrian
Street to the satisfaction of the Directors of
Planning and Public Services.

The offsite private easement road to Eastern Street
shall be constructed within the easement. It shall be a
graded and well drained road with graded width, improve-
ment width and surfacing equal to or greater than that
determined by the standards under Section 81.703(b)(2)
of the Code. Grades over 25 percent are not allowed.
The surfacing shall consist of asphaltic concrete to
City standards and to the satisfaction of the Director
of Public Services.
Dip sections and culverts shall be designed by a regis-
tered civil engineer to handle a 15-year storm. Dip
sections shall be designed for a maximum water depth of
10" based on a 15-year storm and the formula "Depth in
feet X velocity in feet per second is equal to 6 or
less." A sketch of the dip section showing the above
dimensions and the calculations shall be submitted with
the deposit noted below.
The entire dip area must have a concrete slab with a
minimum width of 2 feet wider than the required graded
width but no wider than the required easement, 6" thick,
5-1/2 sacks of cement per cubic yard and 10 x 10 x 99
wire mesh. Cutoff walls, 6" wide and 2' deep, on both
upstream and downstream sides of the dip and along the
entire length of the dip are required. Cold mix may be
used if the flow is less than 5 cfs. and the velocity is
less than 2 fps., A.C. hot mix may be used if the flow
is less than 20 cfs. and the velocity is less than 5
fps.
A registered civil engineer shall prepare and submit a
sketch of the private easement road improvements to the
Department of Public Services. The sketch shall show the
graded width required, all drainage improvements with
their approximate locations, signed calculations and a
copy of a 200 scale topo map with the drainage areas
outlined. Calculations based upon the Ordinance criter-
ia to determine the graded width shall be submitted to
the Director, Department of Public Services for
approval.

A deposit of $300.00, two prints of the Tentative
Parcel Map and a copy of the Resolution of Approval
will be forwarded to the Department of Public
Services along with above sketch and any drainage
calculations, to cover the cost of a inspection of
the required private easement road improvements.
The applicant shall reimburse the Department of
Public Services for any costs in excess of the
deposit prior to recording of the Parcel Map or
prior to the recording of the Notice of Completion.
Any unused portion of the deposit will be
returned.
A registered civil engineer or a licensed land
surveyor shall provide a signed statement that:
"The private easement road to Adrian Street is
constructed within the easements.
A grading permit will be required prior to com-
mencement of the grading if the grading meets the
criteria of Section 87.201 of the City Code. The
above sketch and $300.00 deposit will not be
required if a grading permit is obtained.
A permit shall be obtained from the Department of
Public Services for the improvements to be made
within the public right-of-way. The connection of
the private easement road to the City road will
have to match the construction of the City road. A
copy of the permit and evidence from the issuing
agency, that all the requirements of the permit
have been met, shall be submitted to the Department
of Public Services with the Engineer's or Sur-
veyor's statement.
In the event these improvements are deferred, the
subdivider shall execute such documents as deemed
necessary by the Director of Public Services indem-
nifying the City of Poway from liability arising
from the improvement of any offsite easement. This
indemnification shall also be noted on the Parcel
Map.
Turnaround driveways onn Parcels 3 and 4 must be
provided as part of the building plans submitted
for Minor Development Review.

The subdivider shall enter into a private road
maintenance agreement in the form adopted by the
Poway City Council as Resolution 99 and to the
satisfaction of the City of Powayo
An irrevocable offer of dedication shall be given
to the City of Poway for Temple Way at a width of
15' with a 30 foot X 45 foot hammerhead to the
satisfaction of the Directors of Planning Services,
Public Services, and Safety Services.
6. UTILITY EASEMENTS
Where all of the proposed parcels of the land division
are not on a public street, the subdivider shall provide
the Director of Public Services with letters from the
serving utility companies stating that arrangements
satisfactory to the utility have been made to serve all
parcels being created. No letter will be required from
the Pacific Telephone Company.
7. FLOODING/DRAINAGE

The subdivider shall contribute $6,280.00 to the
City of Poway Drainage Fund as his/her share of
future area flood control/drainage improvements and
complete the following to the satisfacition of the
Director of Public Services (EIR):
Repair the existing siltation basins on site to
drain in the manner in which they were designed,
clean the 24' CMP, and grade to stop diversions.
Grade the westerly end of Temple Street, between
Temple Way and Eastern, tilting the road bed to
carry water on the north side to Eastern Street.
This would include removal of silt from the adjoin-
ing properties with the consent of the property
owners.
A gunnite "V" ditch and pipe or other drainage
structure acceptable to the Director of Public
Services shall be installed to his satisfaction to
carry water along the southerly boundary of the
property and offsite to Eastern Street. Credit for
the offsite improvement will reduce the Drainage
Fund contribution accordingly.

Certification by the Public Health Department with
respect to sewage disposal shall be shown on the
Parcel Map.
The developer shall install a minimum water supply
pipe to serve this minor subdivision in accordance
with the standards of the Poway Public Services
Department.
9. SOLARACCESS
The following note shall apear on the Parcel Map:
All lots within this subdivision have a minimum of
100 square feet of solar access for each future
dwelling/commercial/industrial/unit allowed by this
Subdivision.

REQUIREMENTS
Zoning regulations require that each parcel shall
contain a minimum net area of one acre. If, as a
result of survey calculations, required easements
or any other reason, the area of any parcel shown
on this Tentative Parcel Map is determined by the
Department of Public Services to be below the
zoning minimum, it becomes the responsibility of
the subdivider to meet zoning requirements by lot
redesign, variance or other applicable technique.
The subdivider must comply with the zoning area
requirements in full before the Department of
Public Services may file a Parcel map with the
County Recorder.
Prior to the approval of the Parcel Map the sub-
divider shall provide the Department of Public
Services with a copy of the deed by which the
subject property was acquired.
At the time of recordation of the Parcel Map, the
name of the person authorizing the map and whose
name appears in the SURVEYOR'S CERTIFICATE as the
person who requested the map, shall be the name of
the owner of the subject property and shall be the
same party or parties as shown on the Tentative
Parcel Map unless the Poway City Council has
approved the substitution of a successor in inter-
est to such party or parties.

Conditions C-5(a) and C-8(2) may be complied with
either prior to or after the approval of a Parcel
Map. However these conditions must be complied
with prior to the issuance of a building permit or
other grant of approval for development, including
further division, for any parcel created by the
Parcel Map.
If any conditions listed in the above paragraph
have not been complied with prior to approval of
the Parcel Map by the Department of Public
Services, such conditions shall be noticed on the
Parcel Map by a certificate acceptable to the
Department of Public Services. In addition, the
subdivider shall execute of "Covenant of Improve-
ment Requirements listing those conditions noticed
on the Parcel Map that have not been complied with.
This Covenant shall be recorded by the Department
of Public Services prior to the approval of the
Parcel Map. The Covenent shall be noted on the
Parcel Map. If a Covenant has been recorded, no
buildig permit may be issued or no further division
may be approved by any parcel created by the
approved Parcel Map unless and until the applicant
presents a copy of a Release of Improvement
Requirements, recorded by the Department of Public
Services, stating that all the improvements listed
in the Covenant of improvement Requirements and
noticed on the Parcel Map have been completed to
the satisfaciton of the Department of Public
Services, except a grading or construction permit
and/or a permit to install utilities within the
private easement may be issued.
The subdivider shall deposit fees with the City
Clerk, or guarantee payment of fees as may be
required pursuant to Sections 810.106 and 810.107
of the City Park Lands Dedication.
The subdivider shall enter into agreements with
the Poway Unified School District in a form satis-
factory to the City of Poway City Council, which
agreements shall provide for payments to the Dist-
rict of such sums of money or other consideration
which the City determines will mitigate the impact
of the subdivision upon said District.

The developer shall dedicate, improve and cause to
be maintained, a riding/hiking and bycycling trail
along Ramin/Adrian Road to City standards and to
the satisfaction of the Directors of Community and
Public Services.
APPROVED AND ADOPTED by the City Council of the City of Poway, State
