P~82-10 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING TENTATIVE pARCEL MAP 81-03 ASSESSOR'S PARCEL NUMBER 314-240-76 & 77 WHEREAS, Tentative Parcel Map No. 81-03, hereinafter "Map" submitted by Fred and Carol Van Houten, applicant, for the purpose of subdividing the real property situated in the City of Poway, County of San Diego, State of California, described as a portion of the north 8 acres of the south 13 acres of the southeast quarter of Section 12, T 14 S, R 2 W, SBBM, County of San Diego, State of California into four (4) lots, regularly came before the City Council for public hearing and action on March 9, 1982; and WHEREAS, the Director of Planning Services has recommended approval of the Map subject to all conditions set forth in the Planning Services Department report; and WHEREAS, the City Council has read and considered said report and has considered other evidence presented at the public hearing. NOW, THEREFORE, the City Council of the City of Poway does resolve as follows: Section 1: Findings: The City Council makes the following findings in regard to Tentative Parcel No. 81-03 and the Map thereof: a. The tentative parcel is consistent with all applicable interim and proposed general and specific plans; b. The design or improvements of the tentative parcel is consistent with all applicable interim and proposed general and specific plans; c. The site is physically suitable for the type of development proposed; d. The design of the subdivision is not likely to cause substantial environmental damage and avoidable injury to humans and wild life or their habitat; e. The tentative parcel is not likely to cause serious public health problems; Resolution No. P 82-10 Page 2 f. The design of the tentative parcel will not conflict with any easement acquired by the public at large, now of record, for access through or use of the property within the proposed subdivision. g. That this project will not create adverse impacts on the environment and a Conditional Negative Declaration is issued with mitigation for aesthetics, drainage, noise and traffic, by Standard Conditions C3 and K1, and Noise and Utilities (Section 2). Section 2: Tentative Parcel Map No. 81-03, a copy of which is on file in the Planning Services office, is hereby approved subject to the following conditions: Streets and Sidewalks Midland Road shall be dedicated and improved to Circulation Element Road Standards and to the specifications of the Director of Public Services prior to Parcel Map approval. Janette Lane shall be improved to City Street Standards prior to the issuance of a building permit on either Parcels 2, 3, or 4. Somerset Road shall likewise be improved to City Street Standards prior to further division of Parcel 1 or issuance of any further building permits that are greater than fifty percent (50%) of square footage of the house on Parcel 1, whichever occurs first. utilities Prior to the issuance of building permits on Parcels 2, 3, or 4 (and prior to recordation of the final map for Parcel 1), the developer shall pay the Bridge and Major Throughfare Construction Fee and any applicable Traffic Signal Fee at the established rate. Noise Noise attenuation measures reducing noise to levels specified by the City's Noise ordinance shall be provided prior to occupancy of any new structures on Parcel 1 or any lots created by a further division of parcel 1.
