A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING TENTATIVE TRACT MAP 82-01
ASSESSOR'S PARCEL NUMBER 275-270-07, 09
WHEREAS, Tentative Tract Map No. 82-01, hereinafter "Map" submitted by
Green valley Groves, applicant, for the purpose of subdividing the real
property situated in the City of Poway, County of San Diego, State of
California, described as Parcels 31 through 50, inclusive, and a portion
of Parcels 51, 55 and 56 of Record of Survey No. 3842. A portion of S36,
T135, R2W, San Bernardino Meridian, County of San Diego, State of
California into 75 lots, regularly came before the City Council for public
hearing and action on March 23, 1982; and
WHEREAS, the Director of Planning Services has reco~ended approval of
the Map subject to all conditions set forth in the Planning Services
Department report: and
WHEREAS, the City Council has read and considered said report and has
considered other evidence presented at the public hearing.
NOW, THEREFORE, the City Council of the City of Poway does resolve as
follows:
Section 1: Findings:
The City Council makes the following findings in regard to Tentative
Tract No. 82-01 and the Map thereof:
a. The tentative tract is consistent with all applicable
interim and proposed general and specific plans~
b. The design or improvements of the tentative tract is
consistent with all applicable interim and proposed general
and specific plans;
c. The site is physically suitable for the type of development
proposed~
d. The design of the subdivision is not likely to cause
substantial environmental damage and avoidable injury to
humans and wild life or their habitat;
e. The tentative tract is not likely to cause serious public
health problems;

The design of the tentative tract will not conflict with any
easement acquired by the public at large, now of record, for
access through or use of the property within the proposed
subdivision.
The DEIR and its accompanying Addendum is hereby certified
as complete and in compliance with the provisions of the
California Environmental Quality Act~ mitigation measures
for significant impacts associated with geology, cultural
resources, services and traffic are provided for by
Conditions 15, 21, 22, 23, 24, L-6 and K-6.
Section 2:
Tentative Tract Map No. 82-01, a copy of which is on file in the
Planning Services office, is hereby approved subject to all of the
followinq conditions and the attached Standard Conditions:
Grading of the subject property shall be in accordance with
the City Grading Code in effect at the time grading plans
are approved.
Erosion control plans shall be prepared and erosion control
measures implemented and necessary bonds and deposits posted
as requiired by the City's Grading Code in effect at the
time grading plans are approved.
Vehicular access rights to Midland Road shall be dedicated
to the City of Poway and labeled on the final map or by
separate documents, to the satisfaction of the Director of
Public Services.

Ail public and private street structural sections shall be
submitted to, and approved by the Director of Public
Services.
Street improvement plans prepared on standard sized sheets
by a Registered Civil Engineer shall be submitted for
approval by the Director of Public Services for private and
public streets. Standard plan check and inspection fees
shall be paid by the developer.

Water and sewer system plans shall be designed and
constructed to meet requirements of the City of Poway and
the Health Department of the County of San Diego.

Prior to final map approval annexation to the sewer
improvement district shall occur and all applicable sewer
fees shall be paid.

The developer shall construct a safety light system
conforming to City of Poway Standards along Midland Road at
the end of all culs-de-sac, at intersections and at other
locations where required by the City Engineer at no cost to
the public, subject to the following:
Cut-off luminaries shall be installed which will provide
true 90 degree cut-off and prevent projection of -
light above the horizontal from the lowest point of the
lamp or liqht emitting refractor or device.
b. All fixtures shall use a clear, high pressure sodium
vapor light source.
c. Advance energy charge shall be paid by the developer.
d. No mercury vapor, quartz, metal halide or diffuse coated
high pressure sodium lamps shall be installed.
Midland Road shall be dedicated to a 60-foot wide right-of-
way width through the entire tract, in a precise aliqnment
approved by the City Engineer. Dedication of the entire
roadway shal be made concurrently with the approval of the
Final Map for Unit 1.

Midland Road shall be fully improved with concrete curb,
gutter and pavement with a 40-foot curb to curb cross
section. Construction of Midland Road, southerly of "A"
Street shall be performed or secured concurrently with the
approval of the Final Map for Unit 1. Midland Road, between
"A" Street and the northeastern tract boundary, shall be
similarly improved or secured concurrently with the approval
of the Final Map for Unit 4.

An Irrevocable Offer of Dedication (IOD) shall be given on
the east half of Lime Grove Road, which shall be granted to
City Rural Street Standards, concurrent with the approval of
the Final Map for Unit 3, to the satisfaction of the City
Engineer.

All lettered private streets shall be offered for dedication
to a 32-foot right-of-way width, and shall be improved to
City Rural Street Standards to provide a pavement width of at
least 24 feet. The property line radius of the culs-de-sac
to be offered for dedication and the pavement radius therein
shall be 40 feet and 30 feet, respectively.

Prior to recordation of the final map, Development Review
approval shall be required for the existing agricultural
building and yard on Lot 1 and for the fence/wall to
encompass the property.
The granitoid rock outcropping, identified on page 17 of the
EIR shall be preserved in place, including all milling sites
identified in the DEIR (Env. Archaeology).
The soils report required by Condition I-3 of this
Resolution, shall also include appropriate mitigation
techniques for expansive soils and groundwater relative
to building and grading of house pads and roads (Env.
Geology).
Fire hydrants shall be spaced no greater than 500 feet apart
and in accordance with the requirement of the Department of
Safety Services (Env. Fire).
Backflow prevention devices on all houses shall be installed
to the requirements and satisfaction of the Department of
Public Services (Env. Public Services).
Co~ml~on driveway accesses shall be required for Lots 20/21,
25/26, 40/41, 59/60, and 69/70 and reciprocal access
easements shall be provided to the satisfaction of the
Department of Public Services.
This approval shall expire in two years unless a time
extension has been applied for 90 days prior to said
expiration date and approved by the City Council.
Access to Orchard Gate Drive from Parcel 1 shall be limited
to agricultural related traffic only.
The developer shall pay a pro rata share for the
installation of traffic signals to the satisfaction of the
Director of Public Services.
Private roads shall be maintained in accordance with
Resolution No. 99.

Pursuant to Section 66499.20-3/4 of the Subdivision Map Act,
approval of this subdivision will hereby render null and void
any previous division of land of said property upon recorda-
tion of the final map.
The final map shall show an equestrian/pedestrian trail along
the southerly boundary of the subdivision, to the satisfac-
tion of the Director of Planning Services and the City
Engineer.
Ail construction traffic shall use Midland Road during the
course of development of the tract and the CC&R's shall
require all construction traffic for the development of the
single family homes to use Midland Road.
The developer shall contribute $110,000 plus the construction
index, to mitigate the impacts of traffic from this map, to
be expended on the following projects in the order of
priority: the improvement of the Martincoit Road Bridge; "S"
curve improvements of Stone Canyon Road and foot paths on
Martincoit Road from Orchard Gate Drive to Painted Rock
School.
The agricultural building shall not be used for processing
the products raised on the property covered by tentative
tract map.
Sewer access stub shall be required to adjoining parcels to
the satisfaction of the Director of Public Services.
PASSED, ADOPTED and APPROVED by the City Council of the City of Poway,
California, at a regular meeting thereof this 23rd day of March, 1982.
