P-82-14 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING TENTATIVE PARCEL MAP 17097 ASSESSOR'S PARCEL NUMBER 321-180-69 W~EREAS, Tentative Parcel Map No. 17097, hereinafter "Map" submitted by Majid Hatami and Sharon Neal Ratami, applicant, for the purpose of subdividing the real property situated in the City of Poway, County of San Diego, State of California, described as Parcel 3 of Parcel Map 9919 into four (4) lots, regularly came before the City Council for public hearing and action on March 23, 1982; and WHEREAS, the Director of Planning Services has recommended approval of the Map subject to all conditions set forth in the Planning Services Department report; and WHEREAS, the City Council has read and considered said report and has considered other evidence presented at the public hearing. NOW, THEREFORE, the City Council of the City of Poway does resolve as follows: Section 1: Findings: The City Council makes the following findings in regard to Tentative Parcel No. 17097 and the Map thereof: ae The tentative parcel is consistent with all applicable interim and proposed general and specific plans; The design or improvements of the tentative parcel is consistent with all applicable interim and proposed general and specific plans; The site is physically suitable for the type of development proposed; de The design of the subdivision is not likely to cause substantial environmental damage and avoidable injury to humans and wild life or their habitat~ ee The tentative parcel is not likely to cause serious public health problems~ The design of the tentative parcel will not conflict with any easement acquired by the public at large, now of record, for access through or use of the property within the proposed subdivision. Resolution No. P 82-14 Page 2 The Draft Environmental Impact Report is hereby certified as complete and in compliance with the provisions of the California Environmental 0uality Act; and the mitigation for significant impacts associated with traffic and drainage are provided for in conditions under Utilities and Drainage and Flood Control (Section 2). he The Council hereby finds Condition 5, Section 2, is necessary because of eminent health and safety problems currently existing on the site. Section 2: Tentative Parcel No. 17097, a copy of which is on file in the Planning Services office, is hereby approved subject to the following conditions: Streets and Sidewalks The off-site portion of Adrian Street shall be improved by the construction of a 20-foot wide paved street section with curb and gutter on one side, extending from Eastern Street to the proposed cul-de-sac turnaround. The cul-de-sac shall be paved with a 30-foot radius. Common driveways shall be provided for Parcels 1 and 2, and for Parcels 3 and 4. Said driveways shall consist of portland concrete cement. Drainage and Flood Control The subdivider shall contribute $6,280.00 to the City of Poway Drainage Fund as his/her share of future area flood control/drainage improvements and complete the following to the satisfaction of the Director of Public Services: Grade the westerly end of Temple Street, between Temple Way and Eastern, tilting the road bed to carry water on the north side to Eastern Street. This would include removal of silt from the adjoining properties with the consent of the property owners. A gunnite "V" ditch and/or pipe or other drainage structure acceptable to the Director of Public Services shall be installed to his satisfaction to carry water along the southerly boundary of the property and off-site to Eastern Street. Credit for the off-site improvement will reduce the Drainage Fund contribution accordingly. Utilities Prior to recordation of the parcel map, the developer shall place a $1,374.00 deposit with the City of Poway to mitigate this development's traffic impact on existing and future Circulation Element roads under the major bridge and thoroughfare construction fee. Prior to the final map approval, all of the required improvments shall be guaranteed to be installed or provided by the execution of an agreement of covenant, which will require their installation prior to the issuance of building permits on any of the parcels. If the future alignment for SR125 adopted by the City Council should be determined to cross this property prior to finalization of the parcel map, that right-of-way, its improvement and the appropriate building setback line shall be shown on the parcel map. 3e A boundary adjustment shall be accomplished prior to recordation of the parcel map to insure a net area of two net acres for Parcel 1. 4e A parcel map pursuant to this tentative parcel map shall be recorded by September 23, 1983, or said map expires unless a written request for time extension is received prior to expiration. 5e Within thirty (30) days of the Tentative Map approval, the developer shall take remedial action (i.e. sandbags, temporary brow ditch, etc.) to the satisfaction of the City Engineer in order to correct the "washing out" of Adrian Way. If said remedial action is not accomplished within thirty (30) days to the satisfaction of the City Engineer, approval of the Tentative Map shall be deemed null and void. In the event said map is declared null and void the Director of Planning Services shall readvertise the Tentative Map for a rehearing before City Council. A minimum fifteen (15) foot-wide equestrian/pedestrian trail shall be provided along the southerly portion of the water easement to the satisfaction of the Director of Planning Services and shall be shown on the Parcel Map. Section 3: Tentative Parcel Map 17097, a copy of which is on file in the Planning Services office, is hereby approved subject to the attached Standard Conditions.
