A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING TENTATIVE TRACT MAP 4267
ASSESSOR'S PARCEL NUMBERS 273-182-18, 19;
277-140-01, 23, 24: and 273-100-10, 11
WHEREAS, Tentative Tract Map No. 4267, hereinafter "Map," submitted by The
Allman Organization of Companies, applicant, for the purpose of subdividing the
real property situated in the City of Poway, County of San Diego, State of
California, described as the northeast 1/4 of the southeast 1/4 of Section 24
and the northeast 1/4 of the northeast 1/4 of Section 25 in T13S R2W, and a
portion of the northwest 1/4 of the northwest 1/4 of Section 30 in T13S, R1W,
San Bernardino Meridian, County of San Diego into 62 lots, regularly came before
the City Council for public hearing and action on March 30, 1982; and
WHEREAS, the Director of Planning Services has recommended approval of the
Map subject to all conditions set forth in the Planning Services Department
report~ and
WHEREAS, the City Council has read and considered said report and has
considered other evidence presented at the public hearing.
NOW, THEREFORE, the City Council of the City of Poway does resolve as
follows:
Section 1: Findings:
The City Council makes the following findings in regard to Tentative Tract
NO. 4267 and the Map thereof:
a. The tentative tract is consistent with all applicable interim and
proposed general and specific plans;
The design or improvements of the tentative tract is consistent
with all applicable interim and proposed general and specific
plans~
c. The site is physically suitable for the type of development
proposed;

The design of the subdivision is not likely to cause substantial
environmental damage and avoidable injury to humans and wild life
or their habitat;
e. The tentative tract is not likely to cause serious public health
problems;

The design of the tentative tract will not conflict with any
easement acquired by the public at large, now of record, for access
through or use of the property within the proposed subdivision.
The Focused DEIR and its accompanying supplements are hereby
certified as complete and in compliance with the provisions of the
California Environmental Quality Act; mitigation measures for
significant impacts associated with noise, visual impacts, biology
(to be determined), traffic, public services and drainage are
provided by Conditions 11, 13, 14, 15, 20, 22, and L-16.
Section 2:
'Tentative Tract Map No. 4267, a copy of which is on file in the
Planning Services office, is hereby approved subject to all of the
following conditions and the attached Standard Conditions:
1. Grading of the subject property shall be in accordance with the
code in effect at the time the grading plans are approved and to
the satisfaction of the City Engineer.
2. Erosion control measures shall be implemented, and necessary bonds
and deposits posted as required by the City Grading Code in effect
at the time the grading plans are approved and to the satisfaction
of the City Engineer.
3. Vehicular access rights to Espola Road shall be dedicated to the
City of Poway and labeled on the Final Map to the satisfaction of
the Director of Public Services or by separate document.
4. All interior and exterior public streets shall be dedicated and
constructed to public street standards, in substantial
conformance with the tentative map.
5. Sidewalks 4.5 feet in width, shall be required on one side of all
interior streets.
6. Sidewalks eight feet in width shall be required on the north side
of Espola BDad and on the west side of Old Coach Road, adjacent to
the subdivision boundary.
7. Paseo Buena vista and Paseo Buena Ventura (as identified on the
tentative map) shall require temporary culs-de-sac to be
installed to the satisfaction of the City Engineer.
8. Those easements shown on the tentative map to be vacated shall be
vacated prior to Final Map and approved by the City Council and
shall be recorded concurrently with the Final Map.

All sight distances shall be safe and meet the City's requirements
for all proposed streets.
Water and sewer system plans shall be designed and constructed to
the satisfaction of the Director of Public Services. All
necessary easements shall be dedicated.

Prior to approval of the Final Map, the developer shall pay any
required traffic mitigation and signal fees at the rate in effect
at that time (Env. Traffic).
12.
Developer shall annex to the lighting district and construct a
light system conforming to City of Poway Standards at no cost to
the public on all streets, subject to the following:
Cutoff luminaries shall be installed which will prove true
90 degree cutoff and prevent projection of light above the
horizontal from the lowest point of the lamp or light emitting
refractor or device.
b. All fixtures shall use a clear, high pressure sodium vapor
light source.
c. Advance energy charge shall be paid by the developer.
d. No mercury vapor, quartz, metal halide or diffuse coated high
pressure sodium lamps shall be installed.

An eight-foot noise barrier wall/earthern berm or other suitable
alternative shall be contructed along Espola Road to the
satisfaction of the Director of Planning Services and the City
Engineer (Env. Noise).
14.
A landscaped entry treatment on Espola Road shall be installed
subject to Minor Development Review approval (Env. visual
Quality).
15.
Prior to approval and recordation of the Final Map, sewer
commitment shall be obtained from the Department of Public
Services (Env. Public Services).

Ail required sewer and water fees shall be paid and annexation to
the City's sewer improvement district prior to Final Map approval
shall occur.

· A riding and hiking trail 15 feet wide shall be constructed along
Espola Road adjacent to the subdivision boundary, to the
satisfaction of the Director of Planning Services and the City
Engineer.

Common P.C.C. driveway accesses, maximum 20-feet wide shall be
required for Lots 27/28, 38/39, 40/41 and 48/49, and reciprocal
access easements shall be provided to the satisfaction of the
Department of Public Services.

Prior to approval of the Final Map all of the improvement
requirements shall be guaranteed to be installed by the execution
of a subdivision agreement secured with sufficient bonds for
performance, labor and materials, and final monumentation. All
dedications shall be made and all applicable fees, charges and
deposits shall be paid prior to Final Map approval.
The Master Plan of Drainage Fee shall be paid prior to Final Map
approval at the established rate in effect at that time and in
accordance with the Drainage Ordinance (Env. Hydrology).
A height variance shall be applied for and approved prior to
construction of the noise barrier required in Condition 13.
22. Homes constructed on Lots 28, 29, 38, 39, 40 and 41 shall be
limited to one-story in height (Env. Visual).

This approval is granted for a two-year period, to commence upon
the issuance of a Letter of Availability for sewer commitment to
the project.
24.
Tam O'Shanter shall be realigned westerly to be directly in
alignment with Orchard Bend Road and the lots redesigned to the
satisfaction of the Director of Planning Services and the Director
of Public Services.
25.
Lots 34 and 35, shall be redesigned to be oriented to Paseo Borrego
viejo, to the satisfaction of the Director of Planning Services and
the Director of Public Services.
26.
The Covenants, Conditions and Restrictions (CC&R's) shall require
that the roof peaks shall be no higher than the finished grade of
the lots on Cloudcroft Drive for lots 21-27.
