P 82-18 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING DE~-ELOPMENT REVIEW 82-01 ASSESSOR'S PARCEL NUMBER 275-460-08 WHEREAS, Development Review 82-01, submitted by Rancho Bernardo Professional Park Ltd., applicant, requests approval of a two-story professional, medical, and dental office complex consisting of two buildings, for the property located at the west side of Pomerado Road, in the C-31 (Office-Professional); and WHEREAS, on March 30, ~982, the City Council held a hearing on the above referenced item, NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: Findings: 1. That the proposed development is in conformance with the Poway General Plan. 2e That the proposed development will not have an adverse aesthetic, health, safety or architecturally related impact upon adjoining properties. 3. That the proposed development is in compliance with the Zoning Ordinance. That the proposed development encourages the orderly and harmonious appearance of structures and property within the City. Section 2: Environmental Findings: The City Council finds that this project will not have significant adverse impacts on the environment and hereby issues a Conditional Negative Declaration, with mitigation measures for Traffic/Circulation (Standard Condition L6), Drainage (Standard Condition K6), and Geology/Soils (Condition 7 and 8, Section 3). The City Council hereby approves Development Review 82-01 subject to the following conditions: Twenty-three (23) additional street trees (15 gallon or larger) of a type approved by the Director of Planning Services shall be provided as part of the project landscaping plan. Tree wells every three (3) parking spaces in the northerly parking area shall also be provided to the satisfaction of the Director of Planning. The northerly driveway shall be relocated approximately 70 feet to the north, to align with the most northerly parking aisle prior to building permit issuance. Resolution No. P-~-i~ Page 2 The loading area in front of the southerly driveway shall be relocated or removed to the satisfaction of the Director of Planning Services, prior to building permit issuance. %~ne most northerly parking area shall be redesigned to provide a han~lerhead turnaround and landscaping shall be provided in the areas where driveways have been deleted prior to building permit issuance. A contribution in a secured form acceptable to the Director of Public Services and City Attorney for one-half the cost of a landscaped median on Pomerado Road along the frontage of this property shall be made prior to building permit issuance (estimated cost - $25,000). If another mechanism for insuring installation of this median becomes feasible during the time frame of the secured agreement (i.e., assessment district), that mechanism may be utilized in lieu of the previous agreement at the discretion of the Director of Public Services. Prior to grading permit issuance, a geologic and soils investigation shall be conducted to the satisfaction of the City Engineer. As a result of that investigation, any stabilization or other measures deemed necessary by the City Engineer shall be incorporated into the grading plans for the project. Prior to the issuance of a building permit, the grading and slope stabilization measures required by the City Engineer shall be completed and certified by the Soil Engineer/Geologist, to the satisfaction of the Director of Public Services. Any grading on adjoining properties will require written permission from their owners. Prior to the issuance of a building permit or prior to approval of the final condominium map (Tract 4211), whichever comes first, all of the required dedications shall be made, fees paid, and all improvements installed or guaranteed by the execution of a performance agreement secured by sufficient bonds.
