A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING TENTATIVE PARCEL MAP 17278
ASSESSOR'S PARCEL NUMBER 321-111-09
WHEREAS, Tentative Parcel Map No. 17278, hereinafter "Map" submitted by
Kiyoto Saisho, applicant, for the purpose of subdividing the real property
situated in the City of Poway, County of San Diego, State of California,
described as approximately 16.4 acres located approximately 500 feet north
of Poway Road, on the west side of Mina De Oro Road. APN: 321-111-09 into
four lots, regularly came before the City Council for public hearing and
action on May 18, 1982; and
WHEREAS, the Director of Planning Services has recommended approval of
the Map subject to all conditions set forth in the Planning Services
Department report; and
WHEREAS, the City Council has read and considered said report and has
considered other evidence presented at the public hearing.
NOW, THEREFORE, the City Council of the City of Poway does resolve as
follows:
Section 1: Findings:
The City Council makes the following findings in regard to Tentative
Parcel No. 17278 and the Map thereof:
A. The tentative parcel is consistent with all applicable
interim and proposed general and specific plans;

The design or improvements of the tentative parcel is
consistent with all applicable interim and proposed general
and specific plans;
C. The site is physically suitable for the type of development
proposed;

The design of the subdivision is not likely to cause
substantial environmental damage and avoidable injury to
htm~ans and wild life or their habitat;
The tentative parcel is not likely to cause serious public
health problems;
The design of the tentative parcel will not conflict with any
easement acquired by the public at large, now of record, for
access through or use of the property within the proposed
subdivision.

That this project will not create adverse impacts on the
environment and a Mitigated Negative Declaration is
issued with conditions Al, 2, 3, and J2, required for
drainage, rock outcroppings, wildlife, and traffic.
Section 2:
Tentative Parcel Map No. 17278, a copy of which is on file in the
Planning Services office, is hereby approved subject to all of the
following conditions and the attached Standard Conditions:
A. Mitigation Measures
No develo~ent shall be permitted within the
lines of innundation of a 100-year flood condition.
The lines of the 100-year flood course shall be
delineated on the final map and covenant shall be
recorded prohibiting any improvements within the
limits of the flood course.

The applicant and/or future developers shall
preserve the natural rock out-cropings, the clusters
of eucalyptus trees and significant vegetation
subject to the approval of the Director of Planning
Services.
Solid-board fencing shall be permitted around the
perimeter of the building envelope and usable yard
areas. In all other locations open-rail fencing or
a similar type may be installed, providing for the
unrestricted crossing of wildlife.
100-year flood free access shall be provided to each
parcel, to the satisfaction of the Director of
Public Services.
B. Streets and Sidewalks
The proposed private road easement adjoining the
parcels and the easement connecting to Poway road
shall be improved to City Rural Street Standards,
with AC pavement and graded shoulders, and an
Irrevocable Offer of Dedication (IOD) shall be
granted. The exact width and alignment of the
improvements and the offer of dedication shall be as
approved by the City Engineer.
The intersection of the the private road easement
with Poway Road shall be improved by grading,
paving, and other improvements as required by the
City Engineer, in order to improve sight distance
and ingress and egress to and from Poway Road.

The terminus of the 40-foot private road easement
between the adjoining properties shall be a
30-foot curbline radius cul-de-sac, to the
satisfaction of the Directors of Planning, Public,
and Safety Services.
C. General Requirements
Street, sewer, water and fire protection
improvements may be deferred until the time
building permits are issued on the parcels,
provided that a suitable covenant to this effect
is recorded concurrently with the final map and
the requirement is noted on the Map, to the
satisfaction of the Director of Public Services.
2. Parcel 1 shall waive the right to access from one
of the easements.
A parcel map pursuant to this tentative parcel map
must be filed within 24 months from the date of the
approval, unless a written request for a time
extension is received prior to that date.
4. Minor development review shall be accomplished
prior to the issuance of a building permit.
5. Street addresses shall be provided by the office of
Planning Services.

Grading of the subject property shall be in
accordance with the City Grading Codes, and
accepted grading practices.
Water, fire protection and sewer facilities shall
be designed and constructed to meet requirements of
the City of Poway and the Health Department of the
County of San Diego, prior to issuance of a
building permit on any parcel.
Prior to the issuance of building permit, the
developer shall pay the Bridge and Major
Thoroughfare Construction fee and any Traffic Signal
fee at the established rate in effect at the time
building permits are issued.

The applicant shall agree to join into a private road
maintenance district in accordance with Resolution No.
99, subject to the approval of the Director of Public
Services.
APPROVED and ADOPTED by the City Council of the City of Poway, State of
