Res P-82-41RESOLUTION NO. P 82-41 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING CONDITIONAL USE PERMIT 82-05 ASSESSOR'S PARCEL NUMBER 321-271-07 WHEREAS, Conditional Use Permit 82-05, submitted by Donald and Kathleen Mechling , applicant, requests the use of a lot size averaging design for an eight lot subdivision for the property located at Millards Boad, South of Poway Road, in the A-70-4, (Limited Agricultural); WHEREAS, on July 27, 1982, the City Council held a duly advertised public hearing to solicit comments from the public, both pro and con, relative to this application; NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: Findings: 2e That the location, size, design, and operating characteristics of the proposed use will be compatible with and will not adversely affect or be materially detrimental to adjacent uses, residents, buildings, structures, or natural resources because the residential use proposed is consistent with surrounding residential/agricultural uses. That the harmony in scale, bulk, coverage and density is consistent with adjacent uses because the lot sizes and density are the same as adjacent uses having the same General Plan designation. That there are available public facilities, services and utilities. 6e That there will not be a harmful effect upon desirable neighborhood characteristics because the single family residential character of the area will not be changed by this project. That the generation of traffic will not adversely impact the surrounding streets and/or the City's circulation element because traffic mitigation fees and street improvements will be requirements of project approval. That the site is suitable for type and intensity of use or development which is proposed because the project is consistent with the General Plan land use designation and no adverse conditions exist which cannot be mitigated. Resolution No. P 82-41 CUP 82-05 Page 2 That there will not be significant harmful effects upon environmental quality and natural resources because potentially significant environmental impacts will be mitigated as conditions of approval. 8. That there are no other relevant negative impacts of the proposed use that cannot be mitigated. 9e That the impacts, as described above, and the location of the proposed use will not adversely affect the City of Poway General Plan for future as well as present development because it is consistent with the General Plan. Section 2: Environmental Findings. The City Council finds that this project will not have a significant adverse impact on the environment because potentially significant impacts are mitigated by conditions of approval for Tentative Tract Map 81-03, and hereby issues a Mitigated Negative Declaration. Section 3: City Council Decision. The City Council hereby APPROVES Conditional Use Permit 82-05 subject to the following condition: All conditions of approval for Tentative Tract Map 81-03 shall be fulfilled and Conditional Use Permit 82-05 shall remain valid until the expiration of Tentative Tract Map 4278 (July 27, 1984), or any extensions granted for said map. Expiration of the tentative tract map shall result in expiration of the conditional use permit.
